INVESTIGATION REPORT re:

Alleged Carnapping Incident of one Juan

Dela Cruz vehicle.
I. AUTHORITY

 1. Spot Report dated 08 February

2022; and

 2. Complaint of one Juan Dela Cruz

dated 08 February 2022.
II. MATTERS TO BE
INVESTIGATED

 To determine the facts and circumstances

surrounding the alleged carnapping Incident
that transpired at Central Signal, Taguig City.
 To identify the perpetrators and determine the
extent of their liabilities, and
 To file appropriate criminal case against the
suspect.
III. FACTS OF THE CASE
6. On February 8, 2022 at about 1:30 am a
carnapping incident took place at the corner of
Rodriguez st. along Cuasay road Brgy. Central Signal
Taguig. Two identified man (suspects) was at the said
street pretending to be in pain and in need of
immediate medical attention. Mr. Juan Dela Cruz
(victim) a concerned citizen stopped his car to help
them. When Mr. Dela Cruz was reaching out for his
wallet the two men pointed a knife at the back of Mr.
Dela Cruz, immediately took his cellphone, wallet and
car.
7. After the incident Mr. Dela Cruz posted on his
Facebook account about the incident he
encountered. One of his Facebook friends Bryan
Malaque messaged him, informing about the
carnapped vehicle and the 2 unidentified men
who he named Aldwin Yepes and Andrew
Guiducos. (Attached is the Screenshot of My
post Place tab as “L”)

8. Another informant Jaymark Badjao messaged

Mr. Dela Cruz about his post and identified the 2
men who stole his vehicle. He is friends with
Aldwin Yepes and Andrew Guiducos.
9. The exact location of the incident located at Central
Signal, Taguig City. (Attached is the Pictures of the Place
tab as “F”)

10. The Toyota Vios 1.5 CVT with Plate number ABC
123 was registered and owned by Mr. Dela Cruz as
indicated in the LTO Certification (Attached is the copy
of LTO Certification Tab as “J” and Picture of the vehicle
Tab as “K”).
 IV. DISCUSSION/FINDINGS
11. The first issue to be resolve is to determine the facts and
circumstances of the alleged carnapping, at Central Signal
Taguig City. Based on the testimony of witness evidence at
hand, it was established that the Toyata Vios of Mr. Dela Cruz
was forcibly carnapped by two perpetrators at Central Signal on
or about 1:30 am.
12. The second issue to be resolve is the identity of the
perpetrators and determine their liabilities. The suspects were
identified by Mr. Malaque and Mr. Badjao, who saw them with
carnaped vehicle. The suspects were Aldwin Yepes, 25 yrs. old,
pedicab driver, Single and a resident of Brgy, North Signal and
Andrew Giducos, 26 yrs. old takatak boy, Single and a resident of
Brgy. North Signal Taguig City.
13. The last issue to be solve is to file appropriate
criminal case against the suspect, if the evidence warrant. Based
from the act of Aldwin Yepes and Andrew Giducos
 Section 3. Carnapping, Penalties – Carnapping is the taking, with
intent to gain, of a motor vehicle belonging to another without the latter’
s consent or by means of violence against or intimidation of persons, or
by using force upon things.

Any person who is found guilty of carnapping shall, regardless of the

value of the motor vehicle taken, be punished by imprisonment for not
less than twenty (20) years and one (1) day but not more than thirty (30)
years, when carnapping is committed without violence against or
intimidation of persons, or force upon things; and by imprisonment for
not less than (30) years and one (1) day but not more than (40) years,
when the carnapping is committed by means of violence against or
intimidation of persons, or force upon things; or when the owner, driver,
passenger or occupant of the carnapped vehicle is killed or raped in the
course of the carnapping shall be denied bail when the evidence of guilt
is strong.
V. CONCLUSION

14. Based on the evidence presented and the testimony

of the witness and complainant it was confirmed that
Aldwin Yepes and Andrew Giducos violated RA 10883 or
otherwise known as the New Anti Carnapping Act of
2016, when he with the intent to gain using violence
against or intimidation to person carnapped the Toyota
Vios vehicle belonging to Mr. Dela Cruz.
 VI. RECOMMENDATION
15. WHEREFORE, premises considered, it is
recommended that a case for violation of the New
Anti – Carnapping Act of 2016 be filed against
Aldwin Yepes and Andrew Giducos before the
Prosecutors Office of Taguig City.
