AFFIDAVIT I, the undersigned, beingfirst duly swol'n, hereby do state underoathandunder penalty periurythatthe factsaretrue: of
l ' I am over the age of 18 and am a resident of Arizona. The information containedin this affidavit is basedupon my own personalknowledge and, il. called as a witness, could testify competentlythereto. I arn an investigator with MaricopaCounfy Sherifl"sCold Caseposse 2' In August 2011,approximately 250 membersof the Surprise, Arizona,'I'ea Party, who are residentsof Maricopa County, presenteda signed petition asking Sheriff Joe Arpaio to undertakean inu.siigation to addr-ess conceffrs regardingPresidentBar-ack Obama's long-fornr birth certificatereleasedby tlre White HouseorrApril 27. 201I. 3' Residents Maricopa County were concernedthat document of released was suspected be a computer-generated to fbrgery, not a scanof an original I96l paper docurnent,as represented the White House when by the Iolg-form 'uvas birth certificate madepublic. 4' The Tea Party metnberspetitioned under the premise that if a forged birth certificatewas utilized to obtain a position foi Barack Obarna on the 2012 Arizona presidentialballot, their rights as Maricopa County voters could be cornprornised. 5' In October 2011._Sheriff Arpaio comrnissionedthe Maricopa County Sheriffs office Cold Case Posse, which is comprised of folner- law enfbrcementinvestigators and practicing attorneys,to investigatepresident Barack Obama's long-form birth certificatereleased the by wllte House on April 27, 2011. 'rhe purposeof this investigation was to determineif the documentwas, in fact, authentic. 6. As lead investigatorfor the Cold Case posse,I agreed to Sheriff Arpaio's request to undertake the investigation into President Obama's birth certificateand his eligibility to be president.

rl

7' In February,2012,ColclCasePosseinvestigators advisedSheriff Joe Arpaio that the forgers tnost likely cornmitted two crimes: first, in fraudulently creating a forgery that the White House characterized, knowingly o. unknowingly, as an officially produced governmental birth record; and second,in fi'audulentlypresentingto the residentsof Maricopa County and to the American public at large, a forgery the White House represented as "proof positive" of PresidentObama's authentic 196l Hawaii long-fonn birth certificate. These conclusionswere based upon, but not limited to, input from numerousexpertsin the areasof typesetting,.o-puter generated documents, forensic document analysisand Adob. .J-prrter programs, as well as, review of Hawaii state law, Hawaii Departmentof Health policies and procedures, and cornparisons with numerousother birth records. 8' The Cold Case investigators further detenninedthat the Hawaii l)epanment of Health has engagedin what Sheritfs investigators believe is a systematic effort to hide from public inspectionwhatev.. oiiginut 196l birth records the F{awaii Departmeut of t{ealth lnay have in their possession, inclucling changing policiesand procedures denyingvalid Freedomof Infbnlation and Act (FOIA) requestsfor infbnnation relatedto the l96l birth records(said requests were not for any birth records). 9' Among the evidencereleased the March 1,201?, pressconfbrence at were five videos the Cold Case Posseproducedto demonstrate why the Obama long-tbrm birth certificateis suspected be a computer-generated to forgery. l0'The videos provide a true and corect point-by-pointillustration of the investigators'conclusion that the featurei and anomaliesobserved on the Obama long-fbnn birth certil-rcate were inconsistent with t'eatures produced when a paper docuurentis scanned, even if the scan of the paper document had beenenhanced Optical Character by Recognition(OCR)'andoprirnized. I I 'Additionally, the videos demonstrated that the Hawaii Departmentof Health Registrar's narne stalnp and the Registrar's date stamp were computergenerated irnagesimportedinto an electronicdocument,as opposedto actual rubber stamp imprints inked by hand or machine onto a paper document. Basedupon this,.the docutnentpublishedon the White House'website, is, at a minimum' misleading the public as it has no legal import and to cannotbe relied on as a legal documentverifring the date, place and circumstance of BarackObama'sbirth.

2l

l2'The investigators also chronicled seriesof inconsistent misleading a and representations various that Hawaiigoverrrment officialshavemadeoverthe past five yearsregarding what, if any, original birth recordsare held by the HawaiiDepartmenl Health. of l3'The ColdCase Posse's enfbrcement law investigation Barack into Obama,s birth certificate his eligibilityto be presideni continuing, and is asadditional informationhasbeenobtained developed and suppofting currentfindings the of the Cold Case Posse. soonasthatinformuiion As is froperly sourced and verified, thatadditional infonnation will be released ihe pubiicat the to direction Maricopa of CounfySheriffJoeArpaio. Overdue: Shedding somelighton the GeorgeWashington library bookstory( BonnevilleMariner.com

(ht4t://bonnevillemariner.files.wordpress.com/2010/05/law-of-natrons.jpg) The copy of Vattel's The Law of Nations that was given to the New York SocietyLibrary by Gmrge Washington'sMount Vemon Estate I'm at once amusedand fascinatedby the matter of GeorgeWashington's overduelibrary books. Amused because, after all, Washington sewedseeds that changedthe world. Men of his honor and rarely grace the history pages. Consideringthe political scandaisof presenf it's fun to look caliber back on trivialities of the past. My fascinationwith this story is basedlesson the historical facts themselves and more on the process of connectingthe jigsaw puzzle. I hated history in high school(no offense,Mr. Madsen)because the work had been done for me. My grade dependedon memorization and regurgitatiory not investigation. I wonder how many kids who think they hate history would realue they actually love it if their teachersthought outsidethe textbook. My post (http:/honnevillemariner.wordpress.com/2010/05'^6/updategeorgewashingtons-22l-yearoverduelibrary-book-finally-retumed/) about Washington's library books last week was supposedto be a simple Friday blurb about an interestinghistorical factoid (a great date night conversation piece!). But the more I researched this story, the more questionsarose. Not big conspiratorialquestionr just curious questionsabout the timeline and someinconsistencies the pressreports.Somenews reports in had mentioned two books, othersmentioned only one. Beyond this, I wished somebodyhad taken time to fleshthe story out a little more. I startedby contacting the New York SocietvLibrary (http://www.nysoclib.org/) and the media officeat GeorgeWashington's Mount Vemon Estate& Gardens(http://www.mounwemon.org/) to ask for help. Both partieswere extremely helpful, taking time to answermy questionsand sendme all sortsof good information. The information presented below was culled from Washington's diary, presskitg and my interviewswith NYSL and Mor:nt Vemon staff. So, I'd like to presentyou r,rzhat the late Paul Harvey would call "the rest of the story." THE CONTEXT IrrL789,the U.S. goven'unent was basedout of FederalHall at Wall and Broad Streets Lower in Manhattan. Occupying the top floor of the building was the New York SocietyLibrary, which was founded :l:.7754.The library was a usefui resourcefor govemment officials and it was frequentedby the likes of AlexanderHamiltory Aaron Burr, JohnJay, and sometimesthe presidenthimself. By fall of 1789,Congresswas in recess and the presidentwas preparing to tackle the touchy issueof diplomatic affairs with Britain. In fac! he'd be meeting with Chief Justice John]ay and Treasury SecretaryAlexander Hamilton about thesematters on October 7. Given thesecircumstances, no it's zurprisethat Washington would check out library material on British parliamentary dealingsand intemational diplom acy.

The fine estimateof $300,000, according to Holliday, was calculatedby the Daily News, not the NYSL. She saysfine policieschangedover time, and that an exact total would be tough to determine.Anyway, it's something the NYSL has no interestin tracking. Upon hearing about the overduebooks, staff at Mount Vemon searchtheir own archiveswith no luck. ConsideringThe Law of Nations the much more significant of the two books, they pwchase an identical copy online for an undisclosed amount (I'm told the price reportedby one outlet and echoed in severalothersis inaccurate). J[l4ay 19,2010:In a ceremonyat NYSL, Mount Vemon PresidentJamesRees and Librarian Joan Stahl presentthe replacedbook. Most media reports focus only on the retum of TheLaw of Nations, making no mention of the still missingCommons Debates. THE EVIDENCE Holliday saysrestoring the ledger familiarized NYSL staff with habits of their 18th Century counterparts.Patrons from the Federalgovernment were commonly referredto by their titles, which is why the informal "President" appearsnext to Washington's checkoutsin the imagesbelow.

Washington is off the hook- at least for TheLaw of Nations. And that's where the media called it good and skipped out. But the father of our country still has one overduebook out, and though history has certainly forgiven this oversight,it's going to drive me nuts until somebodyfinds it. Maybe it's time to book a trip back east!
