ORDER AUTHORIZING EXAMINATION OF SUCCESSOR LAW FIRMS AND SUBPOENA OF DOCUMENTS PURSUANT TO FEDERAL RULE OF BANKRUPTCY PROCEDURE 2004 Upon the application dated July 21, 2011 (the Application) of Yann Geron (the Trustee), the trustee of Thelen LLP (Thelen or the Debtor), by his proposed special litigation counsel DiConza Traurig Magaliff LLP, for an order pursuant to Rule 2004 of the Federal Rules of Bankruptcy Procedure (the Bankruptcy Rules), authorizing the Trustee to examine, and subpoena documents from, law firms that allegedly succeeded as counsel to former Thelen clients (the Successor Firms) in matters constituting the unfinished business of the Debtor, and good, adequate and sufficient notice of the Application having been given to the United States Trustee and parties that filed notices of appearance in the case, and sufficient cause appearing, it is ORDERED, that the Application be, and hereby is, granted; and it is further ORDERED that the Trustee and his attorneys may examine the Successor Firms pursuant to Bankruptcy Rule 2004(b), and serve subpoenas to compel attendance and the production of documents (on 30 days notice) in accordance with Bankruptcy Rules 2004(c) and 9016; and it is further ORDERED, that this Order is without prejudice to the Trustees right to seek the turnover of documents and information from any party other than the Successor Firms.
