Faulconer Calls for Immediate Swearing-In of Port Commissioners


New City Attorney opinion says Mayors veto of bipartisan appointments is invalid
SAN DIEGO --- Today, Councilmember Kevin L. Faulconer released the following statement following the City Attorneys updated legal opinion that Mayor Filners veto of two City Council appointments to the Unified Port District Board of Commissioners is void. The Mayors veto of the City Councils two bipartisan Port appointments has been a disservice to San Diegans. It unnecessarily left San Diego without full representation on issues affecting San Diegos waterfront, economy and environment, said Faulconer, who represents San Diegos beach and bay communities. I stand by these extremely qualified Port Commissioners, and they should be sworn in immediately. The City Attorneys updated legal opinion states that the state law creating the Port District clearly grants appointment power to the City Council, and the Mayor does not have veto power over such appointments. The opinion further states that the Councils Port Commission appointments, Rafael Castellanos and Marshall Merrifield, should be certified by the City Clerk. ###
