Woman gets some relief after seven years

Nearly seven years after her application to the Chennai District Collector seeking refund for unused stamp papers for Rs.1.55 lakh, relief seems to be on the way for a woman, with the Madras High Court directing the official to return the sum after deducting the discount within 10 days. K.S.M. Aminath Sharifa led a writ petition seeking a direction to the authorities to pass an order of refund. She purchased stamp papers for Rs.1.55 lakh in 2004. As the seller of a property did not cooperate with her with regard to the sale, the proposed purchase got cancelled. She surrendered the stamp papers before the Collector on September 28, 2005 and requested refund. She was in nancial difficulties. If the sum was returned, it would help her meet her childrens educational expenses; but no steps had been taken by the authorities. Justice M. Venugopal said that under the Stamp Act if an application for refund of sum of the unused stamp papers had been made by the petitioner within two years from the date of purchase, as per rules, 10 per cent deduction could be made and the balance could be refunded. The Government Advocate informed the court that the proceedings to refund Rs.1,39,500 (after deducting a discount of 10 per cent) was under way. Following this, Mr. Justice Venugopal said that on the basis of equity, fair play, good conscience and prudence, he was directing the Chennai Collector to complete the exercise of issuing the refund order within 10 days. He disposed of the petition.
