In addition to the report filed on 06-10-2014, I also interviewed C.O. Finkes on
05-15-2014. C.O. Finkes asked me if he needed representation before speaking to me. I
advised C.O. Finkes that I could not make that decision for him, but he was entitled to
representation. C.O. Finkes explained he knew he did not do anything wrong, and had
nothing to hide; he agreed to speak with me.
I asked C.O. Finkes to explain as best as he could remember, what occurred on
the shift he worked on 05-13-2014, midnight to four a.m. C.O. Finkes said he recalled
being held over, and chose to work the segregation module. C.O. Finkes said he recalled
conducting the first headcount/area check that night. C.O. Finkes said when he logs an
area check, he always goes to every module in segregation, and checks both the area, and
the inmate. C.O. Finkes explained this is how he was trained, he knows policy, and this
is how he conducts all of his rounds. I explained to C.O. Finkes that the video of him
conducting his rounds had been viewed, and he was found conducting his rounds in a
proper manner, and according to policy. C.O Finkes and I went over his log, and he
explained he additionally logs if he is late conducting a round due to a distraction or
event that would cause him to be able to conduct a proper check within the time limit. He

then showed me an example from his log sheet from when he was on duty in the
segregation module to confirm what he was stating.
After speaking with C.O. Finkes concerning his shift, I thanked him for
conducting his rounds properly and ended the interview.
