AFFIDAVIT

I, PSSG SELDON SALAZAR of legal age, bona fide member of the Philippine
National Police, presently assigned at National Capital Region Police Office, EPD –
Mandaluyong, Station Intelligence Unit, under oath depose and state THAT:
1. That, I am being investigated for alleged SIMPLE NEGLECT OF DUTY
on January 3, 2021 in relation to NAPOLCOM Memorandum Circular 2016-002.

2. That, I respectfully and specifically denied the allegations imputed against

my person that I committed aforesaid infraction. That the true matter of facts, On
January 03, 2021 was my regular duty as member of Philippine National Police assigned
at Custodial Facility Unit of Mandaluyong City Police Station as a Jailer PNCO with the
duty of 6:00 AM to 6:00PM.

3. That, my duty as a Jailer PNCO was to monitor the entry, release and
transfer of custody of PUPCs and also to assist virtual or video conference hearing of
PUPCs. I was also strict to the visitors who give foods and necessary things to the
detainees.

4. That, during the tour of my duty, there were numerous visitors due to the
holidays, appeared at the entrance of the extension custodial facility unit and the
uninterrupted line reached on stairs of the said facility. Despite I was sole duty Jailer I
assisted the numerous volume of visitors, I religiously did my duties and responsibilities
as Jailer PNCO with strict and thorough inspections of each package of food. However,
amidst my utmost diligence to inspect and perform my duties and responsibilities, one of
the PUPC was allegedly able to smuggle a cellular phone inside the custodial facility
without detection, but the said allegations did not reach within my inspections and view.

5. That, during that time there’s a huge number of PUPC and reached the
capacity of allowable number of PUPC inside the said jail. Hence, one of the PUPC
fainted and loses her breath due to suffocation. I immediately allow them to step out to
give them time to get good condition. After which, I asked them to go inside the cell.
(Attached herewith photos marked as Annex-1 and made an integral part of this
affidavit.)

6. That, the subject facility or extension jail was under construction, there
were construction workers in and out the building including the cell where the
controversy emanated. Construction workers, working in the building has access to the
facility as part of their tasked. The subject cell is only a temporary cell for detainees due
to clogging of detainees because of Pandemic.

7. That, after the said incident, jailer and member of other units of
Mandaluyong police immediately conducted the oplan greyhounds and the cellular phone
used by the PUPC was not recovered.

8. That, again, that I humbly denied the allegations imputed by the

complainants against my person, it is beyond my control since the extension Custodial
Facility Unit is still under construction which cannot be overseen by one duty Jailer
alone. (Attached herewith photos marked as Annex 2 and made an integral part of
this affidavit.)

9. Relatively to preceding paragraph and to support my claim (Attached

herewith Sinumpaang Salaysay of Govany Espanola marked as Annex 3 and made
and integral part of this affidavit.)
 10. That, in my 24 years in service I received numerous of awards and
commendations to show my dedication to work.

11. I execute this affidavit to attest the truthfulness and veracity of the
foregoing facts.
