AFFIDAVIT

I, MARICEL Y. PELEGRINA, of legal age, single, a resident of #85

Magdaong Street, New Bilibid Prison, Poblacion, Muntinlupa City, 1776,
after having been sworn in accordance with the law, do hereby depose and
state THAT:

1. I am an active uniform personnel of the Bureau of Corrections with a

rank of Corrections Officer one, presently assigned at ALS-BLP
Education and Training Section, Medium Security Camp, New Bilibid
Prison.

2. I am one of the personnel addressed with a SHOW CAUSE ORDER dated

April 25, 2023 signed by ATTY. CEASAR ANTHONY S. SOLIS, Chief,
Internal Affairs Services, BuCor, RE: Alleged Removal of CCTV Camera
at the office of Work and Livelihood Division, NBP, Muntinlupa City
transpired on April 08, 2023.

3. I should not be accountable for the said incident (Alleged removal of

CCTV Camera at the office of Work and Livelihood Division) for reasons
that I did not take part nor assist in the perpetration of the said act.
Considering the facts laid down on the Investigation Report dated April
10, 2023 signed by MR. ANTHONY S. MORCILLLO, Investigation Officer,
specifically on paragraph number 7, which states, that:

“7. In a joint sworn statement of Mr. Meynard Baylon and

Mr. Marlon Ray Godoy, they explained that on April 8, 2023, at
about 11:45AM, while they were performing their official duty as
Security Officer at Director’s Quarters when they received report
from Mr. Ricky Santos, the duty personnel assigned to monitor
the CCTV Camera installed in the NBP Main Building. As a
result thereof, and with instruction of J/SINSP ANGELINA L.
BAUTISTA (Ret.), HEA/OIC, ODDGO, they were dispatched to
locate the office where CCTV Camera was removed and to
further identify those BuCor personnel involved in such
unauthorized removal of CCTV Camera. They found out that a
certain CO1 Jhun Jhun Andaya is the one who removed the
camera with instruction of their Chief of Work and
Livelihood Division, identified as C/CINSP ARTEMIO M.
MARTIN. Also present in that office when the incident took place
were C/SINSP MARIO FRANCIS REAS, CTO3 Eufroncina
Reynos, CO1 Raye Antonette Bautista, CO1 Maricel Pelegrina,
CO1 Glaiza Hermoso, CO1 Missielle Ramos and CTO1 Brenda
Valentin. CO1 Andaya immediately fixed back said removed
camera.”
 4. Notwithstanding the facts alleged on the Investigation Report that,
nonetheless the presence of mind was actually there, it does not
automatically presume that the non-intervention to pacify the act of
removing the CCTV Camera would constitute misconduct on my part.
Consequently, the impression and my presumption, that the removal of
the CCTV Camera installed at the WLD office by CO1 ANDAYA was done
in good faith considering that it was an instruction coming from
C/CINSP ARTEMIO M. MARTIN, our former Chief, WLD, not until and
upon the presence of Mr. Meynard Baylon and Mr. Marlon Ray Godoy to
our office (WLD Office) who then inquire on the unauthorized removal of
CCTV Camera installed therein.

5. In view of the foregoing, I am praying that an Administrative Case sought

to be filed against me will be DROP and therefore EXONERATE me from
case at bar.
