LEAST RESTRICTIVE ENVIRONMENT (LRE)

. . . To the maximum extent appropriate, children with disabilities
. . . are educated with children who are nondisabled; and . . .
special classes, separate schooling or other removal of children with
disabilities from the regular educational environment occurs only if
the nature or severity of the disability is such that education in
regular classes with the use of supplementary aids and services
cannot be achieved satisfactorily. [300.114(a)(2)(i)]
Placement Continuum
In the case of an individual with exceptional needs who has an IEP
and transfers into a district from a district not operating programs
under the same local plan...the LEA shall provide the pupil with a
free appropriate public education, including services comparable to
those described in the previously approved IEP, in consultation with
the parents, for a period not to exceed 30 days, by which time the
LEA shall adopt the previously approved IEP or shall develop, adopt
and implement a new IEP that is consistent with federal and state
law.
