The Government side would like to ask to the court to decide that,
1.

Whether the discourse of the premium limitation for private Cars is the best solution

2.

for fuel dependency


Whether subsidized fuel should no longer be provided

Statement of Facts
In terms of limitation of premium for private cars, Natural resource exactly
premium, is less than other natural resources which is had by Indonesia. Such as coal or
natural Gas. They are more existed in Indonesia. Even, right now Government relies on the
import of Petroleum which is in a high cost in world. When, Government tries to decrease
premium cost, subsidization is done, which in any manner becomes a big burden for APBN.
Summary of Pleadings
First, The Government team would like to ask the court to decide that Whether the
discourse of the premium limitation for private Cars is the best solution for fuel
dependency. Limitation of Subsidized fuel is going to reduce APBN fund for 200 billions
IDR. Automatically this thing is going to harm society indirectly. When people who have
private cars which is supported by good income, indeed its unfair when they have to take
the rights of The Poor, means subsidy which is purposed only for them
Second, The Government side would like to ask the court to decide that Whether subsidized
fuel should no longer be provided. If subsidized premium can be reduced, it is enable to
use, as Government programs to handle Poverty. To handle The high cost of Premium,
Government should really erase subsidy of fuel for private car. Indirectly, Poor people can
be treated well when they get more funds from APBN to handle their poverty which is the
most urgent problem in Indonesia right now.. We can change to utilize and use BBG
( Natural Gas ) which is being prepared by Government. Because, BBG is cheaper, more
efficient, and less carbon.

Statement of Facts
In Indonesia, premium is used by Civilians after being subsidized by Government. What
happens in fact is that Very high cost of petroleum/ fuel. So, it is going to harm government
if fuel should longer be subsidized. APBN will get the primary adverse effects which
indirectly harm the society. Considering those things, More than 50% of civilians rejevt this
policy.
Summary of Pleadings
First, we would like to ask to the court that whether the discourse of the premium
limitation for private Cars is not the best solution for fuel dependency.. When Civilians
who have private car should not get unsibsidized, It creates refusing and rejection from
people. Whether it also comes from drivers of public transportation. This is what has to be
cared by government. Civilians have social participation in making collective decision/
policy. The consequency is that Civilians buy Pertamax which is indeed imported. This is
directly increasing importing of Pertamax. Limitation does mean forcing from Government
to buy imported petroleum which overseas company gains the benefits. Petroleum product
in Indonesia means the premium will not be used, and changed by imported product,
exactly Pertamax which is more expensive. Truely, Benefits are lost from us. Furthermore,
Government efforts the banckrupty of Pertamina as petroleum state corporation in
Indonesia which truely helps 30% of APBN.
Second, The Government team would like to ask to the court to decide Whether subsidized
fuel should longer be provided. Mainly, Policy which is going to be made by government
should treat evryone fairly People still need subsidy because it doesnt guarantee if they use
unsubsidized fuel, they can gain cheaper fuel.

Mostly, SPBU in Indonesia is unready to do government policy in terms of
unsubsidized premium limitation. Some countries in Europe already used this program,
They used different cost of premium for Public transportation and civil vehicles. But it was
failed. This is what Government should learn. That The Civilians still need subsidy from
Government in terms of fuel. Indeed people in Indonesia are still disble to buy pertamax
whether they have good income.
