5. Or stop people from peacefully
assembling
6. Or petitioning the government for
wrongs committed.

McCollum vs. Board


of Education

1948 Supreme Court Case


Questioned power of the state to use its
tax supported public school system
resources in aid of religious instruction.
Early test of separation of church and
state.
Decision 8-1 in favor of McCollum.
Unconstitutional to use public
school facilities by religious
organizations to give religious
instruction to students. Violation of
Establishment Clause.

What isnt protected?
o Free Speech that threatens National Security.
o Treason!- Your right to free speech does not mean you can commit
treason.
o Treason is an act of disloyalty against your own country.
More specifically it is the act of aiding and/or comforting an enemy
of the U.S. in a time of war.
o Sedition-language or actions that call for or encourage resistance or
rebellion against a lawfully established government.
o Hate Speech?
