Dear Sir,
TAWARAN BAGI KERJA-KERJA PEMBAIKAN MENGGANTI DUA (2) UNIT LIF
KAPASITI 20 ORANG PENUMPANG DI IPD TIMUR LAUT,PULAU PINANG.

Hereby we,Dataran Subur Enterprise hereinafter known as The Main

Contractor of one part are pleased to award this sub-contract to you,Eita
Elevator (Malaysia) Sdn Bhd as The Company of the other part for the
above mentioned work in the sum of Three Hundred Twenty Thousand Only
(RM320,000.00) is accepted subject to the terms,conditions and stipulations of
the Consultancy Agreement upon which the Agreement is based and of this
Letter.
TERMS AND CONDITIONS :
1. SCOPE OF WORK
i) As follow to The Bill of Quantity

2. CONTRACT PERIOD
The Contract Period shall be Six (6) Month from the Date of
Possession of site which shall be 05th Jun 2014 .Consequently,the Date
of Completion shall be before on 31st Disember 2014.
3. DEFECT LIABILITY PERIOD.

The defect liability period is inclusive Twelve (12) months and three (3)
months fourteen (14) days thereof after the issuance of Certificate of
Partial Completion.during this period,the Company shall make good all the
defects at your own cost unless the defect that bee done other parties or
in case of force majeure.
4. TERMS OF PAYMENT AND RETENTION (PERFORMANCE BOND)
I.

The Main Contractor hereby agrees to pay the company the sum of
Three Hundred Twenty Thousand Only (RM320,000.00),all
inclusive,staggered of progress on site.

II.

Retention (Performance Bond) shall be made in the amount of five

pecent (5%) from your total certified work done and shall be release
upon expiry of Defect Liability Period (DLP)

III.

The retention (Performance Bond)(or any balance therof remaining for

the credit of the company) may be released of refund to the company
on the completion of making good of all defects,shrinkages or other
faults which may appear during the DLP and upon the giving of the
certificate of Completion of making good defects for the whole of the
Works unde Clause 3 hereof.

This Letter is issued to you in duplicate.Please signify you acceptance by signing

on the space provided and thereafter to return the copy to us for our record,and
have agreed to all the terms,conditions and stipulations therein.
