SEMUNGKIS, 43100 HULU LANGAT, SELANGOR
- Letter of Award

We, Perbadanan Kemajuan Negeri Selangor (PKNS) (hereinafter named as “The

Employer”) are pleased to award the aforesaid works to Reaver Sdn. Bhd. (hereinafter
named as “The Main Contractor”) subject to the following terms and conditions hereinafter
stated, comprising:

1. The total Contract sum is RM 4,866,840.00 (Four Million Eight Hundred Sixty-Six
Thousand Eight Hundred and Fourty Only) and details of which are expressed in
the attached Summary of Price (Appendix “A”).

2. The payment for works shall be subject to final re-measurement and paid based on the
actual work done carried out on site by both delegated parties according to the contract
drawings and specifications. The final site measured quantity will reflect the actual
payable amount to the contractor.
3. The date of commencement of this contract is on 1st November 2021. The
completion period is 11 months from the date commencement. The date of
completion is on 1st October 2022. The contractor is contractually obliged to perform,
execute, complete and handover the completed works before / on the date of
completion.

4. The monthly claim shall be reach to Employer’s office on / before the end of each
month. No advanced payment will be entertained. No out-front / preliminaries claim
shall be allowed. The monthly claim shall reflect the actual physical work done on site.

5. The defect liability period is 12 months, effective from the date of the issuance of
certificate of practical completion. The contractor shall comply with all the instructions
issued to him from the Employer and shall carry out and complete / make good the
defects within fourteen
(14) days from the date of issuance of the said instruction. Failing in compliance with
the said instruction will result the consequence, in which the Employer reserves rights
to engage other contractors to carry out the defective works and all costs incurred shall
be deducted from any monies due to the Contractor.
 6. You shall be responsible for all contributions to SOSCO and Employees Provident
Fund (EPF) in respect to your employees and shall indemnify us against all claims
and penalties for non-payment. You are not allowed to employ any foreign workers
within work site. You shall be fully responsible for any liabilities or consequences
imposed by the authorities arising from their non-compliance.

7. You shall deem to have full knowledge of the site situation in respect to your works.
Any claim for additional costs and / or extension of time arising out of any ignorance
of the existing site conditions will not be considered whatsoever.

8. Any precaution and safety measures as required by the authorities shall be fully
provided by you. You shall hold responsible for all injury and damages incurred due
to your negligence in providing proper precautions and safety measures.

9. You are responsible to clear all rubbish and superfluous material from site and clean
the site progressively including final cleaning work, rectification and touch up prior to
hand over, failing which we will appoint other contractors to rectify the works and the
cost incurred will be borne by the Sub-Contractor.

10. We reserve the right to take out any portion of works and award the same to others
should your workmanship and work progress are not up to our satisfaction and you are
not entitled claim any loss and expenses.

Please confirm your agreement to the foregoing terms and conditions by signing on the space
provided which shall constitute a legal and binding contract and returning the duplicate of this
letter to us.
