Changes in IT systems of the Supreme Court and the District and Magistrate Courts
(Net-HaMishpat) were at the heart of corruption of the courts.

DearAttorneyFeldman,
Iwantedtoadd,relativetoyourrecentFacebookpost,whichspokeofanenormously
wealthyjudge,whoheadedtheadministrationofcourts,andwhoconceivedNet
HaMishpatITsystemofthecourts(youprobablyreferredtoMosheGal,whoserved
asDirectorofAdministrationofCourts20062012).
Inmyopinion,thekeyfiguresbehindNetHaMishpatandmassivecorruptionofthe
courtsoverthepastdecade,partlyrepresentedbyNetHaMishpatsystem,are
PresidingJusticeoftheSupremeCourtAharonBarak,MagistrateoftheSupreme
CourtandlaterDirectoroftheCourtsBoazOkon,andJusticeMinisterTommyLapid.
Myrecentpublication,regardingBankHaPoalimvStateReceiver(JudgeVarda
AlSheikh'sReconstructedProtocolaffair)intheTelAvivDistrictCourt,showsthat
thereisnowaytoperceivetherecordsinthiscourtfileinNetHaMishpateventoday,
butfalserecords.[1]Thatis5yearsaftertheaffairerupted,and4yearsafterthe
renderingoftheJudiciaryOmbudsman'sdecisiononthismatter.Moreover,
MagistrateEinatRavidcontinuesthefabricationofcourtrecordinNetHaMishpatin
ordertocoveritup...
ThegeneralfeatureofNetHaMishpat,whichItriedtoemphasizeinthatpublication,
wasthesystematicremovalofanytraitofauthenticityandvalidityofcourtrecordsin
NetHaMishpat.

SuchisalsothecentralthemeinthehistoricsignificanceoftheOmbudsmanofthe
Judiciary'sdecisioninthereconstructedprotocolaffair:[2]TheOmbudman
describesingreatdetailthemannerinwhichdecisionsandprotocolrecordsare
handledinNetHaMishpat,andreachestheconclusionthatthejudgesfabricatetheir
decisionandprotocolrecordsonaroutinerecords,sincethesystemwasdeveloped
andisoperatedinamannerthatpreventsparties,counsel,andthepublicfrom
distinguishingbetweenanauthenticandafabricatedcourtrecord.
SuchconductcouldnotbepossibleundertheRegulationsoftheCourtRegistration
Office(1936).ThoseRegulations,whichwerepromulgatedundertheBritish
MandateinPalestineperiodprescribedingreatdetailthemannerinwhichcourt
recordsshouldbehandledbytheOfficeoftheClerk.The1936Regulationsreflected
thechecksandbalancesbetweenthejudicialandclerialarmsofthecourts,whichhad
beendevelopedovercenturiesinordertosafeguardintegrityofthecourts.
Obviously,theRegulations,underthesamefundamentalprinciples,couldbeadapted
foravalidandhonestITsystem.
Instead,concomitantlywiththeinitiationofdevelopmetnofNetHaMishpatproject,
theMandateperiodRegulationswereabolished,andnewRegulationsoftheCourt
OfficeoftheClerk(2004)werepromulgated.The2004Regulationssaycloseto
nothingregaringthehandlingofcourtrecords.The2004Regulationswere
promulgatedunderthetenureofSupremeCourtPresidingJusticeAharonBarakand
JusticeMinisterTommyLapid.
PerhapsthemostabsurdandcorruptingRegulationisRegulation5:
Mechanicalsystems
5.Anyoftheprovisionofinstantregulationsshallbeupheldinanymechanical
systemofthecourtsandinelectronicmeasures,withthenecessarychanges,if
soorderedbytheDirectoroftheCourts.
Suchregulationstandscontraryto:
a.TheprincipleofSeparationofPowers,sinceitprovidesafreehandforthejudiciary
topromulgatetheRegulationsoftheCourts,and
b.TheprincipleofPublicityoftheLaw,sinceitfailedtorequirethepublicationof
changes,andtheAdministrationofCourtrefusedtoansweronFreedomof
Informationrequests:WhatwerethenecessarychangesintheRegulations,
orderedbytheDirectoroftheCourts?
SuchregulationofcoursesinglesoutthecentralpositionoftheDirectoroftheCourts
incorruptionofthecourtsoverthepastdecade.However,inmyopinionMosheGal
wasnotthekeyfigureinthismatter.First,oneshouldseeallDirectorsoftheCourts
asmereadministratorsofthewishesofthePresidingJustice,inthiscasefirstand
foremostAharonBarak.Second,theseriesofDirectorsoftheCourtsintherelevant

Accordingtothelistabove,DanArbelwasDirectoroftheCourtsatthetimethatof
abolishmentoftheMandateperiodRegulationsoftheCourtsandthepromulgationof
thenew2004Regulations.However,accordingtotheStateOmbudsman'sReport
60b(2010),pertainingtocomputerizationofthecourts,BoazOkonwasthekey
figureinlaunchingtheproject.
RegardingBoazOkon,Wikipedia(oftenclosetoitssubjects)says:
Wasconsideredtheprotege'ofPresidingJusticeAharonBarak.Withthe
retirementofPresidingJusticeBarakin2006,Okonretiredfromhispositionas
DirectoroftheCourtsaswell...
BoazOkonalsoservedasMagistrateoftheSupremeCourtunderPresidingJustice
AharonBarakintheyears20002002.In2002,underthetenureofOkonas
MagistrateoftheSupremeCourtandfollowingthesuddendeathofChiefClerk
ShmaryahuCohen,massivecorruptionofITsystemsoftheSupremeCourttookplace.

Thefigureaboveshowsthematerialchangesthatwereimplementedinthetemplate
ofalldecisionandjudgmentrecordsoftheSupremeCourtaroundMarch2002,
followingthesuddendeathofChiefClerkShamryahuCohen,underthetenureof
{residingJusticeAharonBarakandMagistrateoftheSupremeCourtBoazOkon.
BothPresidingJusticeAsherGrunisandtheAdminsitrationofCourts(Freedomof
Information)refusedtoanswer:Whatwasthelegalfoundationforsuchchanges?
Andunderwhoseauthoritytheywereimplemented?
Expertsseesuchchangesasunderminingtheintegrityandvalidityofalldecisionsof
theSupremeCourtafterMarch2002.

Additionally,oneofthekeyfindingsinITsystemoftheSupremeCourtfromthe
relevantperiod,isthemultitudeoffalsified/forgedcourtrecords,tiedtoBoazOkon.

Forexample:InJudithFrancoSidietalvAuthoritypursuanttotheHandicappedby
NaziPersecutionAct(9073/01)(inthefigureabove),falserecordswerediscoveredin
ITsystemoftheSupremeCourt.ChiefClerkShmaryahuCohenpurportedlycertified
records5yearsafterhisdeath,andBoazOkonpurportedlysigneddecisions5years
afterheleavingtheCourt.InordertoprovedecisivelytheforgeryintheJudith
FrancoSidicourtfile,Iaskedtoinspecttherecordsinthepapercourtfile(original
records)oftheSupremeCourt.SuchrightisguaranteedbyIsraelilawtoevery
person.
Myrequestwasdulyentered.Butlateritwasrejectedfromfilinginviolationof
DueProcessandintegrityoftheSupremeCourt.Thereisnodocumentationunder
whoseauthoritytherequestwasrejectedfromfilingandthereisnodue
documentationofit.
Additionally,IwasverballyinformedthatIwouldnotbepermittedtofileany
additionalpapersinthecourtfile.Thereason:Thecourtfilewasshredded.
ShreddingofacourtfilefromthatyearintheSupremeCourtisunusual.Moreover,
thereareregulations,whichprescribethatanycourtthatintendstoshredcourtfiles
mustpublishanoticeintheStateRegister(Reshumot)andmaintainprotocolsofthe
shredding.
However,bothPresidingJusticeoftheSupremeCourtMiriamNaorandthe
AdminisitrationofCourts(FreedomofInformation)refusetoansweronrequestsfor:
Thereferenceforthenoticeofshredding.
Copyoftheshreddingprotocol.
Inshort:
Inmyopinion,NetHaMishpatisthebrainchildofAharonBarak,andBoazOkonwas
hisrighthandmaninthismatter,asinthecorruptionofITsystemsoftheSupreme
Courtin2002.
Theconceptisnotoriginaleither.IhavedemonstratedsimilarfraudinITsystemsin
theUSstartinginthemid1980s.However,thefraudinITsystemsoftheIsraeli
courtsissurprisinglysimpleandcrude.Inmyopinion,itwasmadepossibleonlydue
tothecoverprovidedbytheHebrewlanguageandtheHebrewscript.
