RE: Public Access and Integrity of Court Records in Israel in the Digital Era
Following our discussion of this matter, here is an update – anecdotal testimonies and
related notes.
I would be grateful to further discuss this matter, which I believe is at the foundation of
Human Rights in a democratic state, and also a matter that requires careful examination
in the Digital Era.

a) Anecdotal Testimonies:
1) On August 11, 2010 I visited the District Court, Haifa. I requested to inspect and to
copy data from the Index of All Cases of the Court for the year 1995.
2) I was first directed to the Archive. I tried to simply explain to the clerk my request –
to examine a list of civil files, which were opened in 1995, including court file number
and party names, nothing more.
3) The clerk responded: “You are dreaming. There is nothing like that.”
4) Later, I was directed to the Office of the Clerk. There were 3-4 Clerk Deputies sitting
in the office, each assigned to a different department: Civil, Criminal, Probate, etc. I
again tried to explain my request. The Deputies discussed the matter, and then one of
them answered: “You are asking for something from the Stone Age… Have you seen
Flintstone?”
5) Consequently, I asked to speak with the Clerk of the Court. First she said nothing like
what I asked for existed. Later, after I claimed that it was impossible, and that no
court could operate without such list, she said: “You are probably referring to the
“Alfon” (Alphabetical Index). She then went to a back room and came back with two
large books, marked “1995”. She instructed me that I was not permitted to leave the
room with the books.
6) On the right side of each page the court file numbers were listed sequentially, and next
to them, in hand writing, the opening date, and party names. On the left side, columns
were set for the Judgment Date, Abstract of the Judgment, and Notes. However, in the
two Indices, which I examined, no data were entered in these columns.
7) When I wanted to return the Index books, the Clerk told me that she was busy, helping
a judge, who was sitting with her, in a search. She asked me to leave the Index books
on the counter.
8) I waited until they were done, and then I asked to examine the same books for the year
of 1996.
9) To my surprise, the Clerk, in the presence of the Judge, who was still standing in the
room, said that I had misled her, and that I was prohibited from examining the Index
of 1995 either. She then added that since 1996 the District Court, Haifa, was
computerized, and no Index books were maintained any longer.
10) There was no public access to computer terminals in the Office of the Clerk, and
therefore, no access at all was permitted to the Index records.

11) On August 12, 2010, I went again to the Office of the Clerk, District Court, Haifa, and
asked to inspect records from two court files:
12) I selected these filed since it appeared to me that the chance of sealing of these court
file was minimal.
13) Deputy Clerk expressed her surprise that I asked to inspect court records, since, as she
stated, I had been told already on the previous day that I will not be permitted to
examine any records at all.
14) I again asked if the law in Israel prohibits public access to inspect and to copy any
court records at all, and she repeated her explanation: Neither she, nor anybody else is
making up the law. She asked me if I thought that I could go to a hospital and ask to
examine patients files. I told her that the analogy was misguided. She told me that the
analogy was correct – in both cases there would have been violation of privacy if I had
been permitted to inspect any records.

1) On August 19, 2010 I visited the Office of the Clerk, District Court, Jerusalem.
2) I asked the Deputy Clerk to inspect and to copy data from the Index of All Cases of
the year 1995. I explained that it was a book were court file numbers and party names
in the court files were listed.
3) I was told that I was referring to the “Foundation Books” of the Court [Books of Court
–JZ].
4) I was told that the Foundation Books for 1995 are in the Archive, not in the Court. I
was told that public access is permitted to the Foundation Books.
5) Consequently I asked to inspect and to copy the Foundation Books of later years. I
was told that since the Court was computerized, Foundation Books are no longer
maintained. I was told that the Court has gone through several systems, the first name
“Alef Bet”. The one that was installed this year is name “Net Ha-Mishpat”. I was told
that under the circumstances even the Office of the Clerk has no access to the
Foundation Books of previous years, which were part of previous systems.
Regarding the current system – no access was permitted to me in the Office of the
Clerk to the Index of All Cases.
6) In the Office of the Clerk no terminal at all was provided for public use.
8) I was told that public access to court files to those who are not parties to the case,
unless pursuant to judicial decision to permit access to the files.
9) The Clerk understood that I had no interest at all in any particular court file, and that I
was just testing public access to court records. She offered to me to contact the Judge
in Charge of Freedom of Information in the Courts – Moshe Gilon [sic, in fact – Alon
Gilon – JZ], 22 Kanfey Nesharim St, Jerusalem, Fax: 02-655-6897.
10) In my opinion the staff of the Office of the Clerk of the District Court, Jerusalem, was
versed in their tasks, and they answered patiently my many questions.

אשמח לדון בנושא ,שלפי דעתי עומד בבסיס זכויות האדם במדינה דמוקרטית ,וכן נושא שנראה זקוק לבדיקה
קפדנית בעידן המחשב.

.12לגבי הספרים מלפני – 1996נראה ששולבו בספרים אלה שני ספרים כאחד :הספר שנודע במשך
מאות שנים כ Index of All Cases -עם הספר שנודע כJudgment Book, or Index of -
.Judgmentsיחד עם זאת ,נראה שכבר בשנת 1995לא תוחזק למעשה Judgment Book or
Index of Judgmentsבבית המשפט המחוזי בחיפה .אם אכן מצב זה שורר בבתי המשפט
בישראל ,יש לראות בכך פגיעה מהותית בזכויות האדם – שכן הספרים האחרונים Judgment -
Booksהם חלק בלתי נפרד מ – .Law of the land
.13ב 12-באוגוסט דנתי בנושא עם שני עו"ד בקיאים .האחד בת"א והשני בחיפה .שניהם היו בדעה
שעל פי החוק זכותי לבחון ולהעתיק את מראה התיקים.
.14שניהם דווחו שגם בחיפה וגם בת"א נמנעת באופן קבוע גישה לתיקי בתי המשפט.
.15העו"ד החיפאי היה ברור בדעתו שמניעת גישה לתיקי בתי המשפט היא בניגוד לחוק .אולם הוא
הסביר שאין עו"ד מעזים להתעמת בנושא זה עם בתי המשפט .העו"ד מת"א לעומת זאת היה ברור
בדעתו שאין בחוק הישראלי זכות גישה לתיקים.
.16אשמח ללמוד את דעת IDIבנושא בסיסי זה.
.17בכל מקרה ,הופתעתי למצוא חילוקי דעות כה קוטביים בין שני עו"ד בקיאים בנושא כה בסיסי.
.18ראוי לציין שנוהלי בתי המשפט ,שקבעו את זכות גישת הציבור למסמכי בתי המשפט ,הם מן
הנוהלים הבסיסיים שנועדו להבטיח את תקינותם ויושרם של בתי המשפט .כן גם לגבי חתימת
שופט וחותמת וחתימת מזכיר על פסקי הדין .יתרה מזאת – חובה הייתה שחתימות וחותמות אלה
יהיו נגישות לציבור.
.19סקירה מקרית של פסקי דין במאגרי מידע ממוחשבים בישראל הראתה שלעיתים תכופות אין
חתימות וחותמות מופיעות במאגרים – בין בצורתן הגרפית ובין בצורתן הדיגיטלית .שלוב מצב זה
עם מניעת גישה לתיקי בתי המשפט למעשה מונע מן הציבור כל אפשרות לוודא חד-משמעית את
אמיתות פסקי הדין.
.20נוהלים אלה – זכות הגישה לכתבי בתי המשפט ,ובכלל זה הגישה לחתימות וחותמות ,נחשבים
לבסיסי ה – .Due Processלכן ,לדעתי ,אם אכן היתה כוונה לשנותם עם מחשוב בתי המשפט
בישראל ,מן הראוי היה להבהיר זאת בחוק או בתקנות .אי-וודעות בנושאים כה בסיסיים נחשבת
לפגיעה בזכויות האדם ,לכשעצמה.
.21אין ספק כלל ועיקר שניתן ליישם מערכות דיגיטליות שתשמרנה את זכות הגישה של הציבור,
ובכלל זה זכות הגישה לחתימות וחותמות ,וזאת – במסגרת מערכות בטוחות ואמינות יותר מאי
פעם.
.22אין ספק שישראל היא מן המובילות בעולם הן בתחום אבטחת מאגרי מידע והן בתחום החתימות
הדיגיטליות והצפנתן .לכן ישראל יכולה בקלות להפוך למובילה בתחום נוהלים תקינים של בתי
המשפט בעידן המחשב.
