SUIT FOR DECLERATION OF TITLE BY ADVERSE POSSESSION

The plaintiff respectfully states as follows: 1. That Plaintiff, a Govt. Servant working in Patna, has acquired the possession of Plot
No. 123 at Ashiana Nagar, Patna,(hereinafter the property) since Twelfth Day of
September, Two Thousand (12.09.2000).
2. That the respondent, the title holder of the said property, resides in Plot No. 124 at
Ashiana Nagar, Patna, adjacent to above mentioned property, since January, 1993
and had the knowledge of possession of above mentioned property by the plaintiff.
3. The boundaries of the said propertyis as under:
East: Road
West: Plot number 124
North: Road
South: Colony wall

4. That the plaintiff acquired possession of the property by installing fence on the above
mentioned property with the intention of acquiring the property, and has paid all the
property taxes of the property from the date of possession.
5. That the plaintiff had the continuous and uninterrupted and exclusive possession of
the property, and the property has been continuously used by the plaintiff for
personal farming without any objection from the respondent.
6. That the respondent on Fourteenth Day of Feburary, Two Thousand Fifeteen filed a
suit praying permannent injuction against the plaintiff and before the said date no suit
was filed by the respondent against the adverse possesion of the plaintiff
7. Cause of Action and Limitation

8. The suit is valued for the purpose of jurisdiction and court-fee at Rs. 300000/-.
9. The plot is located in Patna, which is within this Court's territorial jurisdiction.
10. The value of the plot is Rs.4,00,000/- which is within this court's pecuniary
jurisdiction.

The plaintiff, therefore prays that


Title be declared in favour of the plaintiff on the basis of adverse possesion
Continuation of possesion to the property may be granted.
