Information to Substitute Teachers/Lecturers working in Colleges in

India

I (a UGC-NET qualified faculty in Commerce subject) have been working as


a substitute Teacher/lecturer in an FIP Vacancy in a Govt. College affiliated
to University of Kerala in Trivandrum, Kerala and have been drawing the
prescribed salary since my date of appointment (16/10/2009) upto March,
2010. When I asked my salary of April 2009, the clerk told me that I will
receive it along with my salary in May on the first week of June. When I
asked it on 01/06/2010, he told me that I will get my salary of two months
(i.e., April and May) when the UGC fund is received and the salary of June
onwards will be given regularly. Therefore, I searched the rules regarding
payment of salary to a substitute Teacher/lecturer in net and I got the
following information. Moreover, I decided to ask this matter in University
of Kerala and the Directorate of Collegiate Education in Trivandrum, Kerala
State under the provisions of the Right to Information Act, 2005. The rules
which I got from net and the format of seeking information under RIT, 2005
(which I - myself prepared) are given below for the information of other
faculties working like me in colleges in India. If this information is useful

Leave Rules

Substitute Teacher will be entitled to vacations/ holidays of the College/


University and casual leave as per rules. Substitute lady teachers would be
entitled to maternity leave. If another Substitute Teacher is appointed in her
place, she will not be eligible to receive any salary during that period. A
Substitute Teacher will not be entitled to earned leave.

Grant towards the salary of the Substitute Teacher (if appointed) will be paid
to the College where the Teacher Fellow was working (Parent Institution)
immediately before joining Teacher Fellowship.

Salary of the Substitute Teacher


The College will make a fresh appointment of a Substitute Teacher in
accordance with the prescribed procedure of the UGC, in the minimum pay
scale prescribed for a Lecturer (with no increments). If the Substitute
Teacher is appointed on a pay scale higher than the minimum pay scale of a

Lecturer, the grant towards reimbursement of the salary of the Substitute
Teacher will be paid by the UGC in the minimum scale and the balance
amount will be met by the respective Institute/ College or by the respective
State Government. Moreover, Substitute Teachers will not be entitled to
yearly increments. The salary claim of Substitute Teachers, where posts are
filled by transfer or deputation, will not be considered. The Substitute
Teacher must be appointed on a full-time basis. The salary of the Substitute
Teacher will be paid by the UGC in advance on receipt of the joining report
of the Teacher Fellow and salary claim for the Substitute Teacher, along
with the following information:
i) Name of the Substitute Teacher
ii) Date of Birth
iii) Qualifications (UGC Guidelines may be adhered to).
iv) Experience
v) Date of Joining
vi) Details of pay including allowances payable per month in the approved
pay scale
vii) Amount payable during the financial year
viii) A certificate from the Principal that the appointment of the Substitute
Teacher has been made in accordance with the procedure prescribed by the
University/State Government
ix) Specific approval letter of the affiliating University/State Government
regarding the appointment of the Substitute Teacher.
In case it is not possible to appoint a Substitute Teacher at the initial stage,
or, if the appointment of a Substitute Teacher is delayed, then lectures may
be arranged on the basis of honorarium of Rs.250/- per lecture, subject to a
maximum of Rs.10,000/- per month. Approval of affiliating University /

State Government will not be necessary. However, all efforts should be
made for the early appointment of a Substitute Teacher.

PROCEDURE FOR RELEASE OF GRANTS BY UGC:


………….Grant towards salary of the substitute teacher (if appointed) will
be paid to the University where the Teacher Fellow was working (parent
institution) immediately before joining Teacher Fellowship on receipt of the
month-wise detail salary statement.

(1) Whether a UGC-NET qualified substitute teacher/lecturer who is

working in an FIP vacancy in a Govt. college in Kerala and who has


been drawing the prescribed salary regularly since the date of his
appointment (16/10/2010) upto 31st March, 2010 is eligible to receive
the prescribed salary during Summer Vacation (i.e., April and May)
when the same person without terminating his service continues to do
his service in the same college from June, 2 010 onwards?
(2) Is there any restriction regarding payment of salary during the
aforesaid period?
