INTRODUCTION
An introduction should outline what an essay will be about – you should use the words of the question to
make it clear to the marker you know what the question is and your response will answer it directly.

PARAGRAPH 1 (Common Law)


In this paragraph you need to outline what common law is, choose an example of a precedent from the list
provided below, outline what this precedent is about, explain how this precedent became part of common
law in Australia.
Examples of precedents to choose from: Mabo or Donoghue v Stevenson

PARAGRAPH 2 (Statute Law)


In this paragraph you need to outline what statute law is, find an example of a statute law that applies to
either the NSW jurisdiction or the Commonwealth jurisdiction (you can find your example of a statute law on
the Austlii website), briefly outline what your chosen statute legislates.

PARAGRAPH 3 (Delegated Legislation)


In this paragraph you need to outline what delegated legislation is, find an example of a delegated
legislation, identify the body that has made this piece of delegated legislation and briefly outline what the
delegated legislation covers.

PARAGRAPH 4 (Analysis of significance)


In this paragraph you need to analyse (see the HSC glossary of key terms) the significance of each of these
three sources of law in the Australian legal system today – consider why we have each source, what the
benefits/disadvantages of each is, etc.
