TYPES OF LAND ACQUISITION


Two types of acquisitions State land by the Federal Government under the provisions of the Federal Constitution Allienated land by the State Government under the provisions of the Land Acquisition Act 1960

Article 83 - Land needed for federal purposes ( Federal Government & public authorities ) Article 85 - Grant to Federation of land reserve for federal purpose Article 86 - Disposition of land vested in the Federation

Article 87 - Determination of disputes as to land values Article 88 - Application of Article 83 - 87 to States not having a Ruler


Sec. 3 State Authority Decide to acquire

Sec. 7 LA prepare plan and List of the said land

Sec. 5 Survey the land

Sec. 4 Land Administrator (LA) Issue Notice (published in the Gazette that land is likely to be needed)

Sec. 8 Declare in the Gazettee the State decide to acquire land

Sec. 6 If anything damage, pay damages

Sec. 9 LA marked out the area concerned

Procedure at Inquiry:
See. 12 full inquiry (value of land) See. 13 Summon witnesses Sec. 14 Make award Sec. 16 Serve the award Sec. 10 LA gives Public Notice for an Inquiry for hearing of claims to Compensation (after 21 days of Issuing Notice) Sec. 11 Serve Notice
