Statement from Len Even and Peter Malouf January 5, 2012 We wish to offer you our best wishes

for 2012 and welcome you back to what promises to be an exciting new semester at Marianopolis College. At the same time, we wish to advise you that over the holiday period a 2003 graduate of Marianopolis College launched a lawsuit against the College and against Victor Garaway. Mr Garaway has been a well-regarded member of faculty for over 35 years, as an English and theatre teacher and Chairman of the English Department. In essence, the lawsuit alleges two key points. Firstly the plaintiff maintains that when he advised Mr. Garaway of a sexual relationship he had been having for several years with a man having no connection to the College, Mr. Garaway did not take the necessary steps to ensure that the young man benefited from professional support. Secondly the former student is alleging that he had an inappropriate relationship with Mr. Garaway for several years which started when he was a student in his class. We were informed of this situation in the spring. In the ensuing months we have examined the situation carefully, requesting full details from the plaintiff, as well as interviewing Mr. Garaway and other members of the College community and reviewing our files and records. The versions of Mr. Garaway and the plaintiff differ. We have concluded that Mr. Garaway did not fail to comply with any obligations with respect to information shared with him by the plaintiff and that sexual contact between Mr. Garaway and the plaintiff was the act of consenting persons of full age outside the College and when the plaintiff was no longer a student in Mr. Garaways class. We expect that this matter will take some time to wend its way through the court system, and we will do our best to keep you informed of its progress. During this period, however, we do not intend to comment further publicly on the substance of the case. You should be aware, however, that Mr. Garaway and the College have agreed that he will no longer be working at the College from now until his retirement in June 2012. In the interim please rest assured that our focus remains on providing students with a dynamic and supportive environment so that they continue to grow and excel.
