Death toll of Cebu ship collision rises to 40


MANILA -- Twentysix people were killed after two vessels collided on Friday evening off Lawis Ledge in Cebu, the Philippine Coast Guard (PCG) said Saturday. The Coast Guard said on it official Twitter account that as of Saturday 5:50 pm , 40 persons were confirmed dead, 629 were rescued and 171 remain missing. Coast Guard spokesman Commander Armand Balilo said two sea marshals were among the reported missing. Cebu Governor Hilario Davide III said Saturday hes hoping more survivors will be rescued. He added that he will head a meeting with the disaster council Saturday to address the needs of the survivors. Rear Admiral Luis Tuason Jr., PCG vice commandant for operations, said the Coast Guard has deployed teams to contain the oil spill at the site of a deadly ship collision on Friday evening. MANILA (Updated) -- Businesswoman Janet Napoles could no longer access and withdraw money from her 107 financial accounts after the Court of Appeals (CA) granted the governments petition on Friday. Also covered by the six-month freeze order issued by the CA Second Division were accounts of Napoles children and brother Reynald Lim, other relatives and staff, as well as those of the 28 non-government organizations (NGOs) identified with JLN Corp., Napoles trading firm. Overall, more than 400 accounts were seized by the government to avoid being withdrawn and placed beyond reach of authorities. The petition was filed by the Office of the Solicitor General on behalf of the Anti-Money Laundering Council (AMLC). As per AMLC and the OSG, all concerned banks have been served with copy of the freeze order this Friday afternoon, said Justice Secretary Leila de Lima in a text message. The court order surprised Napoles counsel Lorna Kapunan, chiding De Lima for being despotic and denying her client due process. This shows that Secretary De Lima has exceeded her bounds. This is clearly despotic. She should be giving us the benefit of the doubt, said Kapunan, while welcoming the inclusion of questionable NGOs as this will help them prove that these are not owned by Napoles. Ready, Get Wet, Go! Braving a treacherous stretch of strong river currents just to go to school might sound too disconcerting to most people, especially if the danger is suffered by small children. But for students of Casili Elementary School, its the price they are willing to pay to enjoy the perks of formal education. The usually sleepy sitio of Casili in San Mateo, Rizal is home to schoolchildren who ride on makeshift lifesavers or salbabidas just to get to their school on the other side of a river. Navigating through the waterway exposes these children to potential risk to life and limb, some of whom are as young as 6 years old. What compounds the ordeal is that a permanent solution, like the construction of a foot bridge, or even possibly relocating the school, is nowhere in sight due to the peculiarity of the sitios location. Casili is situated in the Upper Marikina River Basin Protected Landscape, which was recently declared by Malacanang as a protected area. Infrastructure development is restricted in protected areas. Given the circumstances, how can anyone help in the plight of the Casili schoolchildren? For one, swimming lessons are in order. A composite group of volunteers from the goTOTO Foundation, UP Mountaineers and Smart Communications, Inc. (Smart) has been conducting swimming lessons not only for the children, but for adults in the area as well. Under the project called Langoy Pinoy, the group has been making headway in transforming these salbabida riders into experienced swimmers as part of initiatives of the Philippine Disaster Recovery Foundation, a group that has been advocating for the rehabilitation of the Marikina Watershed. The project has been receiving a lot of support from members of the community, who recognized the importance of training the children how to swim in order to minimize their exposure to danger when they go to school. Avitas knows this and experiences this fear firsthand being the mother of 6-year-old Kenji, a grade schooler at Casili Elementary School. Kenji, along with other kids in the community, has undergone the swimming program and now knows how to swim, which has somehow lessened his mothers worries. During the first session, around 30 children from the lower grade levels were able to attend. In the coming weeks, more advanced sessionsincluding survival training together with older students and some of the parents and teachers will be conducted. Pending a permanent solution, training the kids at swimming is the best we can do to keep them safe, says Darwin Flores, Smart department head for community partnerships. Smart conducted a series of consultations with Casilis leaders and together they agreed that survival swimming lessons, targeting the students themselves, will be an efficient and relevant intervention that they can do for now. Were equipping them with a skill that they can use not only now but for the rest of their lives as well, adds Flores. Meanwhile, Romy Garduce, a UP Mountaineer and survival expert and whos also part of the program, gave a sobering perspective on the situation of Casili. Its estimated that 8 out 10 Filipinos dont know how to swim. And in a town like Casili, knowing how to swim can make all the difference. If one knows how to swim, one may save oneself or even others during accidents in water activities or dangerous incidents like flash floods, says David. goTOTO is an advocacy named after Muelmar Toto Magallanes, an 18-year-old who sacrificed his life saving more than 30 people from being swept away by the ravaging flood waters brought on by tropical storm Ondoy. He kept on coming back to save more people until a solid wall collapsed and killed him. He was named one of the Top Ten Heroes of Time Magazine in 2009. David and his fellow goTOTO volunteers are hoping that through this advocacy, more kids will be able to learn not just survival swimming but also the value of helping others in times of need. Smart, goTOTO, UPM and the PDRF are also looking at raising funds to buy safety flotation devices for the use of the children. Other groups have already heeded the call and have donated additional rubber tubes and even a boat to ferry up to 10 school children. This is a temporary solution but eventually we hope that all the schoolchildren of Casili can go to school without having to go through the risk of crossing the river, says Flores. (PR)

Yes, why not? Why not launch an anti-greed campaign and keep it going like some lifelong maintenance mechanism in a world that has become rickety with all sorts of moral sicknesses, with greed among the prominent ones? We just have to look around, and see greed and avarice and their many faces proliferating like anything, from the individual level to the farthest global ends. Many people are trapped in an almost invincible grip of selfishness, pursuing nothing other than their own self-interest and

throwing any consideration for the common good to the wind. This is not to mention that many have forgotten to relate their earthly business to God, to consider it as a prayer and even an act of worship that is not only pleasing to God but also most beneficial to everybody else. We have been reminded in the gospel about this aspect of our life. Take care to guard against all greed, Christ said, for though one may be rich, ones life does not consist of possession. (Lk 12,14) We have been

warned against storing up treasure for oneself but not being rich in what matters to God. Nowadays, many, in fact, do not even know the idea of common good. And if there is anything they do that would contribute one way or another to the common good, its by sheer coincidence that it happens. Any deliberate effort to do things for the common good is practically absent, if not openly avoided. The world is drowning in a sea of materialism and consumerism, with the spiritual values and the supernatural destination of human life all but forgotten. Its still working under an increasing infusion of deceptive economic tricks, but the illusion is also getting so increasingly untenable that things now are approaching breaking point. It seems that we are being set up higher and higher in our materialistic and consumeristic ways for a deeper and more painful

crash sooner or later. The signs are already there, and many of our leaders in politics, business, media and even in the church are hesitant to give the bad news. The predicament is practically left unattended. Productivity is dropping, even in an accelerated rate in some places, mainly because without the support of the spiritual and supernatural elements of our life, people have no way but to tend to become lazy, and simply wanting to be comfortable, rich and continually entertained, and with narrow and shallow understanding of things. In the corridors of power and influence, graft and corruption have practically become the SOP. Just read the papers, and thats just the tip of the iceberg. The banking and financial sector continues to blow bubbles in the hope of stimulating productive economic activity. But

Whistleblowers protection is great


Rewards and protection are motivations to ferret out hidden secrets. Corruption among government officials is the target. may have trial could not attend to the preparation of the judicial affidavit. I do not know how many among the practicing lawyers have done the supervision of their paralegal personnel in preparing the judicial affidavit. Some I know have conscientiously follows the Supreme Courts rule. How about the Efficient Use of Paper Rule? Pleadings and the like for the court are required to be encoded in an 8.5 x 13 white bond paper with indention on top 1.2 and right 1.5; while the left and bottom at 1 indention. I transferred to another sheet with the indentions as required. You know what happen? I have not yet enlarged the font from 12 to 14, but the words: .The thing I dislike in the judicial affidavit.... started the second page. Then I increase the font to 14, it moved from the words .gather the documents, especially securing certified copies. This shows that the Efficient Use of Paper Rule has not been studied carefully. With due respect to the justices of the Supreme Court, the planned paperless filing of pleadings through the use of electronic transmittal may be better than the Efficient Use of Paper Rule, however, not all lawyers can efficiently use the Internet. There are lawyers who do not even know how to type by the so-called touch system. I have seen some if not few of them using the tuldok system. Tuldok means using one or two fingers touching the keyboard. Before enrolling in law course, I suggest study first typing to a speed of 35 words per minute with 90% accuracy. Before I forget, I quote Senator Escudero: By strengthening the protection of the citizen whose testimony is necessary and indispensable for the successful prosecution of a case, we also strengthen accountability and reduce corruption in the public and private sectors. The whistleblowers will surely welcome SBN 425, but how about those corrupt? Will they appreciate the good senators Bill? From the inner sanctuary of my heart, I am sorry to discuss this to the public, but that is the only way I can expressed myself for the right of the public to know. I hope the reader will understand I am not undermining the wisdom of our justices, but merely part of my constitutional right for Freedom of Expression and Freedom of the Press. Cest la vie! Provinces need elbow room, in law and budget allocations, to plan and implement programs with the democratic accountability that autonomy entails. Dealing with local governments, from barangay to provinces, to catalyze local ingenuity and resolve problems plaguing these areas can likewise be draining. n I hope policy makers read the PHDR report. I hope this begins a mind shift which produces better health for people down in the ground

Will Senate Bill No. 425 (SBN 425) of Senator Chiz Escudero resolve the increasing corruption in the government? Will having whistleblowers protected and rewarded a guarantee for the corrupt to land in jail? The Bill is great encouragement and protection for whistleblowers to denounce corrupt government officials and employees. However, some whistleblowers were disappointed not only to the uncertainty of those who will protect them, but to the lackadaisical court processes. Foremost of the motivating factor is to see the court moves speedily in hearing cases. Taking too long a time to decide on cases lost the enthusiasm of whistleblowers. A whistleblower has to be a witness on the case that takes years before being resolved. It ruins the expectation that justice is only around. There should be a law that will stop judges or justices to dismiss cases by technicality. It is the practice of some lazy or bias judge to render decisions based on technicality, leaving the real aggrieved party to pain and heartache with no other recourse left, except to raise the head up towards heaven and wish for Armageddon falls. Something more might be learned by carefully perusing the 1987 Constitution in relation to the mandate to the judiciary. In Article VIII we read: Section 14. No decision shall be rendered by any court without expressing therein clearly and distinctly the facts and the law on which it is based. No petition for review or motion for reconsideration of a decision of the court shall be refused due course or denied without stating the legal basis therefor. From a laymans understanding the Constitution mandated any court to render decision expressing therein clearly and distinctly the facts and the law on which it is based. However, several decisions from lower to higher courts, merely dismissed cases because of failure to follow the Rules of Procedure. Some decisions have not resolved the controversy or issue; some

did not declare categorically what the rights and obligations of either party. Aggrieved party seeks the intervention of the court because they want justice, but dismissing the case based on technicalities is not justice at all. Parties to a case spend their hard earned money just at end of it no fair judgment is received. By dismissing a case through technicality, the Supreme Courts backlogs increased. Either of the litigants could accept the decision believing their cause have not been resolved. If the Supreme Court will only stop the lower court from rendering decisions based on technicality, cases will be speedily decided. They have to decide the case on the merit. However, if technicality is based on not filing or answering on time, it is enough justification for courts to dismiss the case. Only, the period should be at least one month to reply. The fifteenday period is not sufficient to gather the documents, especially securing certified copies that needs time to travel. Like, decisions from the Court of Appeals will need travel time from Leyte to Cebu or even filing of petitions to the Supreme Court have to be brought personally to Manila. Several lawyers have aired their disgust to the procedures like the preparation of judicial affidavit and the efficient use of paper rule. I have talked with lawyers regarding the judicial affidavit. It is additional work for them, they said. As for me it may be additional work for them, but additional income, because of additional time and effort they have to collect more than the usual fee. It may not be too much for the lawyers to prepare the judicial affidavit, because it is similar to a policemans question and answer method of taking statements. Once getting used of it will be easy to do. Only it is cumbersome for the client and the lawyer to spend extra time in preparing the judicial affidavit. Nacar airs side of issue about the police


TACLOBAN CITY -- In response on claims of sluggish action of the police based in this city, Police Inspector Romuel Nacar, media relations officer of Police Regional office (PRO) 8, aired their side of the issue. Our line units especially those who are designated as first responder or those who are in mobile patrols were directed to immediately respond to phone calls for police assistance as soon as possible. However, there are some factors that affect the amount of time for them to respond, he said in an interview. One of the factors for the slow response of the police is the deficiency of gasoline on patrol cars. In connection with this, Nacar said that the 146 police stations over the region were provided with gasoline monthly. Since it is given monthly, there is a big possibility for a shortage on gasoline. The patrol cars are also roaming or patrolling. In Tacloban, the PNPs have patrol units and they are assigned to areas where they will patrol. This causes the insufficiency of gasoline, Nacar said. He said that it is one of their crime prevention strategies. Nacar said that based on the reports that they received from Tacloban City Police Office (TCPO), they were able to respond to calls for police assistance and the suspects were arrested. He admitted that there was a shortage in the polices part not only in Tacloban but in the entire region. DZR airport X-ray machine out of order


TACLOBAN CITY For three days already, the X-ray machine of the Daniel Z. Romualdez (DZR) Airport has not been working that leads security to do manual inspection of baggage and passengers. The X-ray machine at the check-in counter has not been functioning since August 15. However, the designated security officers still manage to manually inspect the baggage even if it takes time. Neri Cortiz, SSO supervisor, said in an interview that it will take a lot of time before the machine gets back to its normal operation. But they have doubled up the security to ensure the safety standards of the airport and of every passenger. Its hard to do the inspection manually but we have to do our work for the sake of safety and security of the passengers, Cortiz said.
