he role of chief law officer -i#ht 8e referred to as the Attorney @eneralGs overall responsi8ility as the independent le#al advisor to the $a8inet H and so-e have even su##ested that the role possi8ly e%tends to the "e#islature as well2 he i-portance of the independence of the role is funda-ental to the position and well esta8lished in co--on law& statutes and tradition2 As chief law officer& the Attorney @eneral has a special responsi8ility to 8e the #uardian of that -ost elusive concept H the rule of law2 he rule of law is a well esta8lished le#al principle& 8ut hard to easily define2 It is the rule of law that protects individuals& and society as a whole& fro- ar8itrary -easures and safe#uards personal li8erties2 he Attorney @eneral has a special role to play in advisin# $a8inet to ensure the rule of law is -aintained and that $a8inet actions are le#ally and constitutionally valid2 In providin# such advice it is i-portant to keep in -ind the distinction 8etween the Attorney @eneralGs policy advice and preference and the le#al advice 8ein# presented to $a8inet2 he Attorney @eneralGs le#al advice or constitutional advice should not 8e li#htly disre#arded2 he Attorney @eneralGs policy advice has the sa-e wei#ht as that of other -inisters2

Qne of the -ost pu8licly scrutini7ed aspects of the Attorney @eneralGs role is the responsi8ility for cri-inal prosecutions enco-passed in section 5 .d0 and s2 *4 of the $onstitution Act& ');=2 !ection *4 #ives the provinces authority to le#islate in -atters related to the ad-inistration of cri-inal 1ustice and there8y #ives the provincial Attorney @eneral authority to prosecute offences under the $ri-inal $ode2 he Attorney @eneral does not& however& direct or cause char#es to 8e laid2 While the Attorney @eneral and the Attorney @eneralGs a#ents -ay provide le#al advice to the police& the ulti-ate decision whether or not to lay char#es is for the police2 Qnce the char#e is laid the decision as to whether the prosecution should proceed& and in what -anner& is for the Attorney @eneral and the $rown Attorney2 It is now an accepted and i-portant constitutional principle that the Attorney @eneral -ust carry out the 9inisterGs cri-inal prosecution responsi8ilities independent of $a8inet and of any partisan political pressures2 he Attorney @eneralGs responsi8ility for individual cri-inal prosecutions -ust 8e undertaken H and seen to 8e undertaken H on strictly o81ective and le#al criteria& free of any political considerations2 Whether to initiate or stay a cri-inal proceedin# is not an issue of #overn-ent policy2 his responsi8ility has 8een characteri7ed as a -atter of the Attorney @eneral actin# as the TueenGs Attorney H not as a 9inister of the #overn-ent of the day2 I+
