sensory delights a semi-exposed riverbed has
to offer. Remember to thank former Mayor Gale
Pospisil for allowing San Antonio to pump the
springs down to an average fow of 30cfs!
Summer Wrap Em-Up
City Council got its season recap at last Mondays
meeting at City Hall, with Parks Director Stacey
Dicke, Solid Waste Manager Mike Mundell
and Police Chief Tom Wibert breaking down
the numbers relevant to their positions in easy-
to-understand tidbits for the Gang of Seven.
(Ooh, thats good. Gang of Seven. Thats City
Councils new nickname. #keeper)
First up, Mike Mundell laid out the trash
numbers, which were telling. See, the City took
the trash boats away to see if litter would increase
if the public were given fewer options for proper
disposal of waste. Guess what the SCUBA divers
found? Guess. Seriously, take a shot.
Week of 7/31, with boats: 158 pounds
of litter
Week of 8/7, without boats, but with
signs that encouraged people to place litter
Here, which, in the absence of boats, seemed
to mean in the water: 341 pounds of litter.
More than double. Duh. But now we know
people read the signs and follow directions.
Week of 8/14, no boats, no signs: 181
pounds of litter
Week of 8/21, no boats, no signs: 248
pounds of litter
The verdict: Fewer trash
receptacles = more litter. WHO
COULD HAVE POSSIBLY SEEN
THAT COMING?
So yeah, the trash boats
work. Here in the newsroom, we
imagined this might be the case
because the boats were often flled with
trash. Had they been empty all the time, well
then, we would have had reason to suspect
they werent serving their purpose.
Now that City Council is convinced that
having places to dispose of trash properly is
90% of the solution to litter problems, the next
steps are to put more trash boats on the river
and to empty them more often, as any garbage
receptacles effcacy diminishes after it becomes
full. Obvious? Yes, but only to you and me. But
now that its clear to everybody that removing
trash cans leads to more litter, we can move
forward with an actual waste management
plan that doesnt include a series of rotating
blades installed at the bottom the Tube Chute.
Well done, City Hall. Heres a balloon.
Stacey Dicke was up next, with a report
of 401 tickets issued by park rangers to people
who parked at Prince Solms Park without paying
for the privilege. Or at least playing tennis.
Then it was Chief Wiberts turn at the
podium. 75 river-area arrests this year, up a
staggering 11 over last year. See what happens
when you let people bring disposable containers?
SEE? Massteria! Actually, the big jump was in
citations, with 660 this year versus 528 last
year. Hey, none of those were for Possession of a
Juice Box, so were not complaining. 411 river-
area parking tickets issued by NBPD this season,
but thats just money in the bank.

Update: Justin Carter
A young New Braunfels man argued that the
judge should dismiss his case over comments
he made on Facebook about attacking a
kindergarten because there is no proof his
comments actually represented a true threat.
Justin Carter appeared in court Tuesday,
arguing that his comments on Facebook do
not meet the law enforcements burden of
probable cause.
The State argues that Carters comments
meet the defnition of a terroristic threat.
Carters Facebook exchange with
Hannah Love, who notifed authorities, reads,
verbatim (mistakes, profanity and capital
letters included):
Justin Carter: Im fucked up in the head
alright, I think Ima SHOOT UP A FUCKING
KINDERGARTEN.
Justin Carter: AND WATCH THE BLOOD
RAIN DOWN.
Hannah Love: I hope you fucking bring in
hell you fucking prick.
Justin Carter: AND EAT THE BEATING
HEART OF ONE OF THEM
Carters lead attorney, Don Flanary,
called on two experts on Internet speech to
validate his point that his clients comments
didnt represent a true threat.
Jeffery Treem, an assistant professor
with the University of Texas at Austins
Communications Department, said the thread
appeared to him to refer to previous comments.
I cant tell anything from the thread,
Treem said. There is no additional context on
what the conversation is about. You couldnt
draw any conclusions from that thread alone.
The full Facebook thread has since disappeared.
The UT professor also noted that Carters
avatar, which is a cartoon drawing of a girl
and a snowman, cannot lead one to say for
certain if it represented the Justin Carter on
trial. However, prosecutor Chari Kelly showed
Treem a photo from Carters Facebook page
that sports a banner photo of Carter.
Kelly also questioned Treem about trolling
and cyber-bullying. Treem defned trolling as
disruptive behavior online and said that
cyber-bullying is a form of trolling but not all
trolling is cyber-bullying.
Is it against the law to be a troll? Is it
against the law to be mean? Flanary asked.
No, Treem said.
Flanary also called another UT professor,
Sara Kimball, who is an expert in cyber-speech.
Dan Van Brunt, another Carter attorney, asked
Kimball her views of the thread.
Whoever wrote it is obviously playing
around, using stock phrases, she said. Its almost
as if the comments are out of a horror movie.
Kimball also referred to Carters comments
as gross hyperbole.
Of particular importance, Kimball noted,
was the use of a kindergarten rather than
the kindergarten, saying that the would
represent a specifc kindergarten and would
be a more serious threat.
Kelly asked Kimball if she would change
her views of Carters comments if she knew
that Carter had threatened his former girlfriend
and once told a school counselor that he would
shoot up the school and that were all going
to die. I will make it happen.
Kimball said that information still wouldnt
alter her opinion of the thread because she
couldnt see the full context in which the
comment was made.
When Flanary asked the linguist if it is
against the law to be mean, Kimball said if
it was, most of us would be in jail.
Judge Jack Robison asked Flanary if
he was arguing that Carters comments
were conditional.
I am, your honor, Flanary responded.
Good luck with that, the judge said.
The lawyer then pointed out that the word
alright obviously is in response to someone
elses comments. Also, Flanary argued, that the
phrase I think Ima shoot up a kindergarten
shows it is not a statement of actual intent.
Another contentious moment between
Flanary and Robison came when the lawyer
argued the judge had the authority to dismiss
the case. Robison however, disagreed, saying
that he could not so so at the pre-trial stage
and that it was up to a jury to decide if the
comments represented a true threat.
Flanary, however, pressed his argument,
saying case law said the judge is allowed to
make such a ruling. Robison mightily disagreed,
at one point telling Flanary to sit down.
Another issue brought up during Tuesdays
hearing was how Comal County law enforcement
offcers questioned Carter without his attorney
when he was in Travis County Jail, where he was
incarcerated before his transfer to Comal.
Transcripts show that Carter was told he
had the right to have an attorney present, but
was concerned that the interview would be
postponed if he had counsel present. More than
once during the interview, Carter said he was
glad his case was fnally being investigated
and hoped he would be able to go home.
Carters attorney at the time, Mindy
Montford, said she didnt know offcers from
Comal had questioned her client until he told
her after the interview.

This is a photo of a fountain darter that was
found in the Comal River. Some people, like
Bob Fee, believe we are lying. But a guy
named Stan, who swore to us that he is an
ichthyologist, says it is. Bob Fee is not an
ichthyologist. We have feelings, Bob.

In the citizen issue 34 of 8/21/14 on
page 3 in the 1st word article you show a
fle photo of what looks like the biggest
and most ferocious looking fountain
darter I have ever seen. I must say that if
that thing is swimming in the Comal river
then I need to fnd a diferent place to
swim. At the top left corner of the picture
just above the hand there appears to be
an oil platform in this body of water.
Please correct me if Im wrong but
this must be a big ugly ocean fsh, not a
small minnow like creature that lives in
our beautiful river.

Dear Bob:
You need to fnd a different place to swim.
The fountain darter is a vicious beast
that has devoured a number of swimmers
throughout the years. In fact, the Tonkawa
used to refer to it as That Messed Up Fish.
You Know, The One With All The Teeth.
I understand your reticence. None of us
want to believe that our little river holds such a
monster, but to ignore the terrors around us is
to go into the waters unprepared.
The fountain darter comes from the areas
where the Comal is deepest, some two miles
down in spots. Here, you can also fnd fountain
perch, which are similar to hunchback whales.
Other beasts that lurk in these depths are the
fountain snails, which are massive things that
have eight arms and a nasty beak.
And, lets not fail to mention the Fish Man.
We, at the TX Citizen, are hurt hurt at
the insinuation that we would attach a picture
of a non-fountain darter to a story about the
Comal River fountain darter.
TX Citizen staff went above and beyond
their duties to get a picture of the nasty thing
for our fles. Chase Cochran had to dive
and weave through the waters of the Comal,
searching through dark waters, made darker
by the millions upon millions of cans below
the surface. In the end, he captured the
monstrosity and took a photo. Chase, who
sports several stitches for his troubles, has
been waking up in the middle of the night,
screaming and weeping.
Thanks, Bob. Thanks for dismissing the
diffcult and dangerous work done by the TX
Citizens staff. I hope youre satisfed.
You also question the validity of the
photo because you see an oil platform in
the background.
Well, yes, there is an oil platform
there. However, you have made a mistake
in perception. There are thousands of oil
platforms along the Comal, but theyre really,
really small about the size of a beer can.
On these platforms, teeny men drill for
sewing machine oil. That oil is then conveyed
by tiny ships down the Comal to a wee
refnery that turns the oil into gasoline for
remote-controlled cars. That is, if the fountain
darters dont eat the ship.
Next, I guess youll deny the behemoth
raccoons that roam the woods around New
Braunfels, or the duckbilled dinosaurs that
wander through Landa Park. Or, maybe youll
deny that Elvis is alive and plays pretend guitar
on the side of the street.
No one likes a skeptic, Bob.

Dear Mexican: I see lots of Mexican-
Americans struggling in grade school
and high school. Many Mexican-
American activists claim its because
they dont speak English at home or
the schools dont teach them well. But I
see lots of Asian-Americans in the same
schools who do really well. Many of them
also dont speak English at home. Te
last time I went to a hospital, it seemed
like Asians were 30% of all the doctors.
I didnt see a single Latino one. Why is it
that one group consistently does better
than the other? I dont understand.

studies activists can offer examining the myths
of model minorities and Mexican apathy

they dont even care about solutions to the

course you are! However, just because you
wish something to be verdad doesnt make

what happened to Mitt Romneys dream of
Mexicans self-deporting.

of learning English. Tey often speak
Spanish annoyingly loud in public.
Sometimes, the KIDS speak better
English than their PARENTS! And, if they
dont understand you, they just smile
and say, No, si, no. What is that crap
anyway! How about learning enough
of our language to say, Im as proudly
Mexican as you are American. Screw
you, muchacho! While this would be
totally obnoxious, at least itd be more
HONEST than No, si, no.

Although it is August up here in Alaska, it is still cold and autumn-like. The temperature is consistently
in the 50s and it rains almost every day. Therefore, Chef April and I fnd ourselves in a galley
that smells like we are preparing a big Thanksgiving dinner each and every day. Here is a very
popular apple tart dessert that I make each week for our guests. As you know, I am a big fan of
brown butter and I incorporate it into as many sweet dishes that I can.
For this recipe you may use pre-made pie crust but I recommend making your own tart
crust from scratch. You can also make your own caramel with just a small can of sweetened
condensed milk, water, and a slow cooker. Please feel free to e-mail me for the tart crust and

Brown Butter Apple Tart
1 pre-made pie crust
4 large eggs
1/4 cup sugar
1 cup (2 sticks) unsalted butter
1 vanilla bean, split lengthwise
1/2 cup all-purpose four
1/2 tsp kosher salt
3 frm, tart apples (such as Pink Lady or Braeburn),
peeled, cored, cut crosswise into 1/4 in think rings
Vanilla ice cream and caramel for topping
Preheat oven to 350. Coat your pie pan or tin with nonstick spray.
Place butter in a medium saucepan over medium heat. Scrape in seeds from vanilla bean
then add the bean. Cook while stirring often, until butter foams then browns; about 5 min. Do
not let butter burn. Remove from heat. Let cool for about 10 min then remove the vanilla bean
and discard. Slowly whisk brown butter into egg mixture. Whisk in four and salt.
Line you pie pan with your chilled pie crust. Cover crust with a single layer of apple slices.
Pour flling over the apples and bake until apples are a deep golden brown, the flling is puffed,
and the crust is browned. Allow to cool until just warm. Top with scoop of vanilla ice cream and
drizzle with melted caramel.
