Richard Hubbell, his marke.
Sealed and delivered in ye presence of
ISAAK Knapp,
The following is from the back of the foregoing will:
Knapp, Jones Pitmans psonally apped before me and made
Oath that ye within written instrument was sealed and delivered by ye within named Richard
Hubbell, as his last will and testamt in their sight and presents.
Richard Blacklash (Blackleach) Justice."
In the original will his name is spelled Hubwell, and Walter Hubbell suggests that is how
he pronounced it, theorizing that the scribe who wrote the will evidently did not know liow to
spell the name, so wrote it phonetically. There is certainly no other evidence to support that
curious thesis, nor is there an immediately apparent reason for the equally curious spelling
Lei^s just cite it as another example of the violence so often done our name by the uninformed
,fc of the History, was made by Elizabeth
Hubbell Schenck, Town Historian for Fairfield. I have examined the will, a fragile but still
cl^ and readable document mthe archives of the State Library at Hanford. The seal is faded
red wax, representing what I would like to think is an American turkey and not a peacock
N;rEia"d of

of my father, Sarg't Richard Hubbell, deceased, the sum of Seventy seven Pounds, Five
Shillings and Nine pence, the same being the present due proportion of sd Estate, in right
belonging to my selfe, as son to sd Richard Hubbell, deceased. I say it was Rec'd March 25th,
1700 by me.
Richard Hubbell. '
An inspection of the early records might reveal reasons for the court's decision not to allow
the probate of Richard Hubball's will. The fact that a well known and presumably highly
respected member of the community left his estate in disarray, at least in the court s opinion,
is perplexing. Now follows the will of Abigail (Prudden) Walker Hubbell, 3rd wife of Richard,
who survived him. Named early are Robert Walker, Abigail Bostwick and Johannah Odell, her
children by her first husband Joseph Walker of Stratford. This has also been taken from the
History.
"In'the name of God Amen. The eleventh day of February, 1705, I. Abigail Hubbell, of
Stratfield. being of Perfect mind and memory, thanks be given unto God therefor, calling
unto mind the mortality of my body, and knowing that it is appointed for all men to die,
do make and ordain this my last will and testament; that is to say, principally and first.of
all, I give and recommend my soul into the hands of God that gave it. and my Body I
recommend to the earth to be buryed in deseni Christian buryall at the discretion of my
Executors, nothing doubting but at the general resurrection I shall receive the same again
by the mighty power of God. And as touching such worldly estate wherewith it hath
pleased God to bless me with In this life, I give, demise and dispose of the same in the
following manner and form;
Item. I give ten shillings in money towards buying a flagon for the communion table in
this place.
Item. I give all my wearing apparall to my two daughters, Abigail Bostwick and Johannah
Odell, to be equally divided to them, 'and if either of them die before this will takes
place, which isat my decease, then their daughter, or daughters, shall inherit their mother's
part; and in case either of my daughters decease and leave no daughter, then it is my Will
that mv daughter that hath out Lived of the two above named shall have all my wearing
apparel) if she that dieth first leave no daughter to inherit at my decease.
Item. I give all the rest of my Estate that I shall die possessed of, after Just debts and my
funerall charges paid, unto my living son John Hubbell, but if it please God to take him
away bv death, And he leave no issue of his body to Inherit, then it is to be equally
divided between my three children, to my son Robert Walker, Abigail Boswick. Johannah
Odell. or their children, in case any of them dye before this my will take place. I likewise
constitute, make and ordain my son Robert Walker my sole Executor of this my last
Will and testament; and J do hereby utterly disavow all former wills whatsoever. Ratifying
this and no other to be my last Will and testament, confirming that deed of gift of a small
annuity in England to my son Robert Walker and his heirs forever, to ye full of his por
tion. which deed of gift bears date 17th April. 1688; in witness whereof I have set to my
hand and seal the day and year above written; note before signing, that m\' son John is
not to inherit until twenty-one years or marriage.
Signed, Sealed and declared in presents to us.
Abagail Hubbell.
James Bessett, Sen. j December the iOth. 1717.
Mary Bennett. )
These may satisfy all concerned that I. Abigail Hubbell, Subscriber to the within written
Will, do make and ordain this as a Codicel to the same not to alter the within will, nor remove
the Executor of the same.
Item. I give and bequeath to my two daughters Abigail Bostwick and to Johannah Odell, in
addition to what I have given them allready by my Will aforesaid, that is to say. 1 Chair,
1 pair Sheets marked with A. H., 2 pillows. 2 pillow beers marked with .A. H.. 1 small
table cloth, 2 towells. I new bason of 3 pints, 1 quart bason, 2 pint basons. 1 porringer, 1
Stone Jugg. 1 glass bottle, 3 Earthern potts. I pair drinking potts. 1 cup. I porringer, 1
lamp, pair bellows, 1 water pail, 1 hand pal. and for the confirmation of this Codicell I
have Set to my hand the day and date above.
Widow Abigail Hubbell.
In presents of us,

( declared and noted before Signing that the
< above particulars here given shall not bear
[ any part of paying my debts or charges."
"Mr. James Bennett and Mrs. Mary Ben- "
nett appeared before the Court of Probate j
held in Fairfield, February 5th, 1717-18. and
made oath that they saw the above Testator,
Abigail Hubbell sign and seal the above writ
ten Will, and that they Judged her to be in
mitted to him, wherefore this Court do ap-
point and Impower John Hubbell, son of the deceased Abigail Hubbell. to administer on the
Estate, with the Will anne.xed. to make, or cause to be made, a true Inventory, and the same
to Exhibit to the Court in Fairfield within 6 months next after this date.
And John Hubbell acknowledged himself bound to Nathan Gold, Esqr., Judge of the probate
in the Recognizance of 100 for a faithfull discharge of his Administering, According to the
above order of Court."

He was Ensign of the Stratfield company Oct 1709, Lieutenant May 1714; Deputy for Fairfield

Benjamin Fairweather and Robert Silliman held land which later became the southern portion
of Kent Conn. The History says that Richard Hubbcll was a wealthy planter and held many
olTiccs of trust His will and the inventory of his estate bear out that he was indeed an aflluent
man of that lime. Descendants will wish to consult a splendid little volume of Lucy Curtis
entitled Two Humlrcil Fifty Years fref Til which g'vcs many interesting insights into the
participation in the early Congregational -
Church by Richard Hubbell Jr. He was the
donor of a silver communion tankard, men-
tioned in his will. This tankard is still used -

a contraction and phonetic rendition of ||H||ff ^

He was with Capt Hitchcock's militia co Aug 1757 in relief of Ft. William Henry "and else
where." Enoch Hubbell served in the Revolutionary War in Connecticut units, according to
sources. He "owned the Covenant" May 11 1755 [Pi] in the Newtown Congregational church
where his children were baptized. He went to New York state after the war, probably after
the area was pacified and Indians and Tory agitators were chased out. (Hubbell Hill is in the
Catskills, and when I visited the Hubbells in Kelly Comers NY (1977) Mrs. Bertha Hubbell
pointed out the hill to me).
Enoch's military service is as follows: he prob served with 5th Regiment of Col. David
Waterbury, raised April-May 1775, mainly from Fairfield county, and the service expired
December 1775, but sickness caused many to leave in October of that year. He is recorded as
enlisting as a Private May 8 1775, discharged Oct 30 1775 in 8th company Capt Joseph Smith
of Newtown?. He is also recorded as in the Continental service in 1775 when he was exempted
from certain taxes in December of that year. A slightly uncertain reference gives him as
"Cor(net?)," on the pay roll for horse travel with Capt Jabez Botsford's company, and also
shows him with the 16th Regiment of Col. Nehemiah Bardsley, which travelled to Fairfield,
Norwalk, and Stamford in 1779, probably in response to General Tryon's invasions of the
Connecticut coastal towns that year.

According to the pension application of David Hubbell, dated 1818, he enlisted at Woodbury
Ct for 1 year 1776-7, and served with Capt Tuttle's company. Col. Webb s Continental
regiment. In 177- he was sick and received leave at White Plains NY "until cured" but may not
have returned to his regiment as a note in his service jacket says "deserted" Sep 1776, In a
supplemental declaration of 1820 also signed by his mark, he says he is a shoemaker, and
unable to work constantly because of a rupture which for many years afflicted him. He lives
with his wafe, dau Sarah ae 20, and grandson Hiram Cogswell ae 2; his schedule of property is
valued at $30.80. Other papers in the file give family history data; a roll dated 1777 at Ft.
Schuyler alias Ft. Stanwix. indicates lie served from Apr 1776 to Jan 1777 perhaps in Capt
Chapman's company, Col. Elmore's battery. His wife was a pensioner in 1840, living with son
Chester in Kent. fThere are other references to a David Hubbell in the main sources of
Revolutionary War service which descendants will want to examine since some may apply to
this David.
