The Court has taken judicial notice that:

1-. Defendant FLORfDA BIUE KEY has historically undertaken a

political function in connection with student government affairs at
the University of Florida in addition to its other functions
invorving Gator Growl, Homecoming, and other matters.
2. Defendant FLORIDA BLUE KEY has historically involved
itself in University of Florida student government elections by
supporting parties and candidates for office and other means.
3. Defendant FLORIDA BLUE KEY has historically employe6 a
house and group system of control over members and aspiring members
to determine candidates for student government elected an6
appointed offices, Frorida Blue Key membership, and slates of
candidates to run for student government offices and. political
parties controlled by Florida BIue Key through its house and group
system or otherwise.
4- At the time of the Spring 1995 University of Florida

a) in the conduct of its official corporate business

supported the Focus Party;
b) in the conduct of its official corporate business
participated in or endorsed the tortious conduct
alleged to have been conducted against the
Plaintiff; or
c) in any capacity, official or otherwise, is
responsible for the activities of the Focus party.
