subject noted above.
In this regard, it is submitted that inquiry into the matter was conducted
secretly and thoroughly by the undersigned.
During the course of inquiry, it has found that dispute has been going on since
long between both the parties over a land situated at Deh Nasirabad District KamberShahdadkot. In this context, in addition to this application an FC Suit vide No. 37 of 1995,
in the Honourable Court of IInd Senior Civil Judge Larkana, a criminal
complainant/application vide No. 10 of 2013 in the Honourable Court of Additional
Sessions Judge, Kamber and a criminal revision application vide No. 20 of 2014, in the
Honourable High court of Sindh, Circuit Court Larkana, were also filed by the applicant
party against the respondent party. Out of which, the FC suit vide No. 37 of 1995 and
criminal complainant/application No. 10 of 2013, were dismissed by the Honourable Courts
concerned, while the criminal revision application vide No. 20 of 2014 is pending in the
Honourable High court of Sindh, Circuit Court Larkana.
Moreover, an FC suit into the same matter has also been filed in the
Honourable Court of Senior Civil Judge Kamber by the respondent Khalil-ur-Rehman
Massan against the applicant Habib-ur-Rehman and others, the suit is also pending in the
Honourable Court.
It is further submitted that allegations regarding issuing threats by the
respondent party to the applicant party could not be proved.
