Subject:- Regulation of National Spot Exchanges

I am directed refer to your letter No. 7/3/2016-MKT-I dated 15.07.2011 on the subject mentioned
above and to say that three Spot Exchanges via. (h) National Spot Exchange of IncLa Ltd.(NSE.L.) (ii)
NCDEX Spot Exchange Limited (NSPCT) & H) National agriculture Produce Marketing Company of
India Limited (National APMC) were set Up by issue of three notifications dated 05.0h.2007, 23.07.2008
and 11.08.2010 exempting, all forward Contracts of one day duration under section 27 of the Forward
Contract Regulation Act, 1952 with certain conditions from operations of the provisions of said Act for
the purpose of sale and purchase of commodities traded in there Spot Exchanges

As per conditions (iv) mentioned in all the aforementioned notifications all information or returns
relating to the trade as and when asked for shall he provided to the Central Government or its designated
agency.

3. In order to safeguard the interest of the investors and to ensure that the conditions stipulated for want
of exemption are complied with, the competent authority has decided to nominate the Forward Markets
Commission as a Designated Agency for providing oversight over all the Spot Exchanges which are
granted exemption under section 27 of the Forward Market Contract Regulation Act, 1')52.

4. In view of the above EMC may ensure that the conditions stipulated for grant of exemptions are
complied with In case, there is any breach of conditions subject to which exemption is granted, the INC
will be competent to take action as deemed necessary and fit.
