“Constitutionally speaking, the COMELEC can not adopt a rule


prohibiting the filing of certain pleadings in the regular courts.
The power to promulgate rules concerning pleadings, practice
and procedure in all courts is vested on the Supreme Court
(Constitutioin, Art. VIII, Sec. 5 (5).”

PART VI, COMELEC Rules of Procedure:

Thus, the Rules of Court is applicable to election protests and


quo warranto cases pending before the regular courts aside
from the specific rules provided for under the COMELEC Rules of
Procedure on election contests and quo warranto cases before
the trial courts.
