Sexually Violent Predator Classification- come out of jail for crime then have to go to institution
to get help until they say so.

The “Terror” Control Model

Relies on fear to justify:
 Intense scrutiny of all citizens
 Constriction of rights to due process
 More likely to be killed by police than terrorist

The War Model

 40 years War on drugs
 lot of money spent
 help justify attack on certain people
 help target Black and Hispanic
 many lives ruined (doors closed)
 there is no change in drug use
 at least 800,000 people in prison in US on drug related crime
 No Knock warrants (if you shoot police then you get in trouble)
 Making police like the military

The Second Dilemma

Equality vs Discretion
 Equality: same consequence for the same crime
o Proportionality- magnitude of the offense in proportion to
magnitude of the punishment
 Discretion: allows flexibility in the application of the law

Discretion Points
 Judge and pick what they want to give you
 Police can pick to be nice or punish you based on whatever (could be race)
 Government can erase crimes off record
The Third Dilemma
 The judge here is more like a referee and make sure everything is being
done right but doesn’t have the answers.

The Fourth Dilemma

 Unlike other sciences the refer to the past to help make future decisions
 The past holds standards that they want to keep
