URGENT MOTION TO RESET HEARING

Plaintiff, through counsel, to this Honorable Court, most respectfully

states:

1. In an Order dated 31 August 2018, the Honorable Court set the Pre-
Trial for the above-captioned case on 2 October 2018 at 2:00 o’clock in the
afternoon.

2. That the undesigned Counsel for the Plaintiff has a conflict of hearing
on 2 October 2018 at 1:30 in the afternoon at the Honorable Fourth Division,
Sandiganbayan, which was set earlier than this Honorable Court’s setting.
Attached herewith as Annex “A” is the Order dated 14 August 2018 issued
by the Honorable Fourth Division, Sandiganbayan.

3. In view of the foregoing conflict, Plaintiff most respectfully prays that

the Honorable Court reset the next hearing of the captioned case to 23
October 2018 at 2:00 o’clock in the afternoon, subject to the availability of
the Honorable Court’s calendar.

4. This Motion is made in good faith and is not intended to delay the
proceedings in the instant case.

WHEREFORE, Plaintiff most respectfully prays that the Pre-Trial for

the instant case be reset to 23 October 2018 at 2:00 o’clock in the afternoon.

Other reliefs, just and equitable are likewise prayed for.
