LAW INTERN: Good Morning Your Honor!

I am Jose Paolo Ojano, law intern from University of Sto. Tomas (UST) – Legazpi City, most
respectfully appearing as counsel for the Accused pursuant to Rule 138-A of the Rules of
Court and accredited by the Supreme Court in Bar Matter No. 1388 under the direct
supervision and control of Atty. Mary Ailyne Zamora.

Ready with one witness, Your Honor.

SECOND CALL:

LAW INTERN: The same appearance as counsel for the Accused, Your Honor. Ready.

COURT: Call in your witness.

LAW INTERN: We are calling Your Honor our witness Mark Joseph B. Pasahol to take the
witness stand.

(interpreter asks the personal circumstances of the witness, introduces the witness to the
Court, then swears in the witness)

COURT TO THE LAW INTERN: Your witness.

LAW INTERN: Thank you, Your Honor.

Your Honor, the testimony of this witness is being offered for the following purposes:

1) To prove the allegations set in his Judicial Affidavit and to support the allegations
of the Accused with regard to his version of the incident.

LAW INTERN: With the kind permission of the Honorable Court, may I proceed?

COURT: You may proceed.

LAW INTERN: Thank you, Your Honor.

Mr. Witness, do you recall having executed a Judicial Affidavit in connection with this
case?

WITNESS: Yes sir.

LAW INTERN: If this Judicial Affidavit will be shown to you, will you be able to identify it?

WITNESS: Yes sir.

LAW INTERN: I am showing to you a Judicial Affidavit dated October 17, 2013 found on
pages ______ to ______ of the record (kelangan ito agahan sa Court bukas para
macheck yung pages), what is the relation of this affidavit to the one you were referring
to?

WITNESS: That is the same Judicial Affidavit.

LAW INTERN: On the 4th page of this Judicial Affidavit, there appears the name of MARK
JOSEPH B. PASAHOL and above it, is a signature. Whose signature is this, Mr. Witness?

WITNESS: That is my signature.

LAW INTERN: Mr. Witness, did you read this Judicial Affidavit?

WITNESS: Yes sir.

LAW INTERN: Did you understand the contents of this Judicial Affidavit?

WITNESS: Yes sir.

LAW INTERN: Is there anything that you want to add, modify or change in this Judicial
Affidavit?

WITNESS: None sir.

LAW INTERN: Now Mr. Witness, will you consider this Judicial Affidavit as your direct-
examination in this case?

WITNESS: Yes sir.

LAW INTERN: Your Honor, I would like to request that the Judicial Affidavit of Mark Joseph
B. Pasahol be marked as Exhibit _____ and the name and signature found on the 4th
page of the same, be bracketed and collectively marked as Exhibit _______.

COURT: Mark it.

LAW INTERN: Mr. Witness, do you attest to the truthfulness and veracity of the statements
contained in your Judicial Affidavit?

WITNESS: Yes sir.

LAW INTERN: I have no further questions, Your Honor.

CROSS-EXAMINATION (OBJECTIONS):

1) Your Honor, may we know the relevancy of the (subject matter of cross-examination)
in this case. Because Your Honor, such (___________) is irrelevant in this case. Moreover,
Your Honor, that matter was not covered during the direct examination. It is well to
emphasize Your Honor that the witness is a mere witness and he is not one of the Accused
in this case, hence, he must only discuss those matters being discussed during the direct
examination.

4) Misleading Your Honor.

5) Your Honor, there is a need for the cross-examiner to show the document to the
witness. It bears stressing Your Honor that this incident happened sometime in the year
of 2013, and it is already 2018 Your Honor. There is a possibility that the witness cannot
remember such document Your Honor. Besides Your Honor, if the cross-examiner is in
good faith in asking such question, he would not hesitate to show the document to the
witness.
