Notification/Commitment Letter of Beijing Performance Brokerage
Institutions Regarding Commercial Performances Involving Foreign,
Hong Kong, Macao or Taiwan Parties

兹有演出举办单位（演出经纪机构）： 北 京 金 色 之 梦 文 化 艺 术 有 限 公 司
与表演团体（或个人） 霍普金斯·塞奇林盖 ，就将在中国北京 北京朗丽兹西山花园酒店
举办 DONGZEL TRIO 驻场乐队 演出活动共同签订本告知承诺书。
Hereby performance organizer (performance brokerage institution): Beijing Golden Dream Art
& Culture Co., Ltd and performance organization (or individual) HOPKINS SICHILENGE ,
jointly sign this notification/commitment letter regarding the performance of DONGZEL
TRIO to be held in Palace Garden Hotel , Beijing, P.R. China.

根据国务院《营业性演出管理条例》和文化部《营业性演出管理条例实施细则》的规定以
及北京市文化局关于加强营业性演出管理的有关要求，演出主办单位（演出经纪机构）与
演出团体、个人共同承诺，遵守演出地法律、法规和相关政策要求并承担相关权利、义务与
法律责任。
In accordance with the “Regulation on the Administration of Commercial Performances” of the
State Council, the “Detailed Rules for the Implementation of the Regulation on the
Administration of Commercial Performances” of Ministry of Culture and relevant requirements
of Beijing Municipal Bureau of Culture regarding the strengthening of administration on
commercial performance, the performance organizer (performance brokerage institution) and
performance organization or individual make joint commitment to follow the requirements of
laws, regulations and relevant policies of location of performance and undertake relevant
rights, obligations and legal liabilities.

一、演出举办单位（演出经纪机构）承诺：

I. Commitment of performance organizer (performance brokerage institution)

（一）依法获得文化行政部门演出项目批准文件的演出经纪机构是法定的演出经营主
体，对演出活动承担举办责任。文化部《实施细则》第二十三条规定，营业性演出经营主体
举办营业性演出，应当履行办理演出申报手续、安排演出节目内容、确定演出票价并负责演
出活动的收支结算、依法缴纳或者代扣代缴有关税费、自觉接受演出所在地文化主管部门的
监督管理等具体义务。
(I) Performance brokerage institution that has acquired performance project approval
documents from culture administration department in accordance with law is the
legal performance operation body, and takes the organization responsibility of
performance event. As stipulated in Article 23 of “Detailed Rules”, during
organization of commercial performance, commercial performance operation body
should fulfill specific obligations such as handling of performance application
procedure, arrangement of performance program content and determination of
performance ticket price, and should be responsible for clearing payment of
performance event, payment or withholding and remittance of relevant tax in
accordance with law, and self-conscious acceptance of supervision and
administration by local culture competent authorities.

（二）举办营业性涉外或者涉港、澳、台演出，举办单位应当负责统一办理外国或者港、
澳、台文艺表演团体、个人的入出境手续，巡回演出的还要负责其全程联络和节目安排。

 (II) For organization of commercial performances involving foreign, Hong Kong, Macao
or Taiwan Parties, the organizer should be responsible for unified handling of
entry/exit of organizations or individuals from foreign countries, Hong Kong, Macao
or Taiwan, and entire tour liaison and program arrangement in case of performance
tour.

（三）国务院《营业性演出管理条例》第二十六条规定，营业性演出不得有下列情形：
(III) According to Article 26 of the “Regulation on the Administration of Commercial
Performances” of the State Council, commercial performance should be free from
following circumstances:

1、反对宪法确定的基本原则的；
2、危害国家统一、主权和领土完整，危害国家安全，或者损害国家荣誉和利益的；
3、煽动民族仇恨、民族歧视，侵害民族风俗习惯，伤害民族感情，破坏民族团结，违
反宗教政策的；
4、扰乱社会秩序，破坏社会稳定的；
5、危害社会公德或者民族优秀文化传统的；
6、宣扬淫秽、色情、邪教、迷信或者渲染暴力的；
7、侮辱或者诽谤他人，侵害他人合法权益的；
8、表演方式恐怖、残忍，摧残演员身心健康的；
9、利用人体缺陷或者以展示人体变异等方式招徕观众的；　
10、法律、行政法规禁止的其他情形。

1. Violate against the basic principle specified in the constitution;

2. Jeopardize national unity, sovereignty and territorial integrity, imperil the
national security, or damage national honor and benefit;
3. Instigate ethnic hatred and discrimination, infringe ethnic custom, harm ethnic
emotion, or disrupt the ethnic unity, or violate the religion policies;
4. Violate social order or damage social stability;
5. Damage social morality or national excellent culture tradition;
6. Propagate obscenity, eroticism, evil cult, superstition, or violence;
7. Insult, slander others or violate other's lawful rights and interests;
8. Terrible or brutal performance which harm physical/mental health of performer;
9. Attract audience by using physical disability or display of human body
deformation, etc.;
10. Other circumstances prohibited by laws and administration regulations.

演出举办单位要在演出前对演出人员进行中国法律法规的宣传，提出明确的注意事项。
对演出人员的演出行为及演出现场进行监管，并做好各项安全工作，设置现场监督人员，
做好监督记录。一经发现有违反法律、法规或者不按审批内容进行演出的行为，应立即采取
有效措施进行处置、消除影响，并向监管部门报告。演出方对违规行为要承担相应的违约责
任。
Performance organizer should conduct propaganda of Chinese laws and regulations
to performer before performance, and clarify items to be noticed, supervise
performance behavior of performer and performance site, and optimize all safety
works, assign onsite supervisor and make good supervision records. In case of
discovery of violation against laws, regulations or performance behavior in violation
against the scope of approval, adopt effective measures to deal with and eliminate

 the influence, and report to supervision departments. Performer party should take
liabilities for breach of contract in case of violation against regulations.

（四）演出主办单位要对演员表演时的演出服装、舞台设计、表演形式、大屏幕VCR内
容等进行审查，不得出现违反法律法规的情形，并且应当符合当地观众的欣赏习惯和公序
良俗。
(IV) Performance organizer should examine and inspect the performance costume,
stage design and performance mode to be used during performance and VCR
contents on large screen, so as to prevent violation against law and regulation, and
performance should be in compliance with habit of local audience, public order and
good practice.

（五）演出主办单位要对演职人员进行禁毒宣传教育，演职人员不得有吸食毒品的行
为；
(V) Performance organizer should conduct propaganda and education of drug
prohibition to performer/staff, no drug taking behavior of performer/staff is allowed.

（六）为确保演出安全，演职人员在演出前和演出中不得饮用含有酒精的饮料。
(VI) In order to ensure safety of performance, no beverage containing alcohol should be
taken by performer/staff before performance or during performance.

二、演出团体、个人承诺：

II. Commitment of performance organization and individual

本演出方郑重声明：对上述演出经纪机构告知的内容已阅知并表示接受，演出方承诺
将严格履行合约，遵守演出地的法律法规，遵守监管部门的管理，现场表演将按照文化行
政部门依法许可批准的内容进行，不擅自增加或变更。演出中如有违反承诺行为，将对所
引发的一切后果承担全部法律责任。
The performance party solemnly declares: the above mentioned notification from
performance brokerage institution has been read and accepted, the performance party
makes the commitment to fulfill contract strictly, follow laws and regulations of
performance place and comply with administration of supervision department. The live
performance will be conducted as per the contents licensed and approved by culture
administration department in accordance with law, no content will be added or changed
at discretion. In case of breach of commitment during performance, the performance
party will take all legal liabilities caused.
