EX-PARTE MANIFESTATION

UNDERSIGNED COUNSEL, to this Honorable Court, respectfully

states that:

1. He received a notice and order from this Honorable Court

showing that he is the counsel for the private prosecution. This maybe on
account of his appearance as counsel for the private complainant before the
office of the Provincial Prosecutor when this case was yet at the preliminary
investigation stage;

2. However, he already informed the private complainant that he

may not be able to represent her once this case is filed before the proper
court for some personal reasons to which the private complainant gave her
assent;

3. He would like to formally manifest before this Honorable Court

that he had not and is not entering his appearance as counsel for the private
prosecution and in the event is his appearance as such is already made of
record the same please be withdrawn.

PRAYER

WHEREFORE, foregoing considered, it is prayed that this

manifestation be duly noted and granted.
Other relief and remedies consistent with justice are also prayed for.
