SHDA-HUDCC NATIONAL DEVELOPERS


CONVENTION RESOLUTION
October 14, 2011
Dusit Thani Hotel, Makati City

WHEREAS, the Subdivision and Housing Developers Association (SHDA) and the
National Government, through the Housing and Urban Development and Coordinating
Council (HUDCC) and key shelter agencies (KSA’s), share the common goal of
producing at least 1.5 million housing units by 2016;

WHEREAS, the 2011 SHDA-HUDCC National Developers Convention has adopted the
theme “A Roadmap towards Addressing the Country’s Housing Needs: A Public-Private
Sector Collaboration”;

WHEREAS, there is strong recognition of the need to standardize the requirements and
reduce the approval timelines for land classification and conversion as well as
development permits and licenses, and access to financing, involving not only the
housing sector, but other national government agencies, the LGUs, and other
stakeholders, as well;

WHEREAS, a closer partnership and collaboration between private developers and


government is vital in effectively addressing the country’s 3.7 million units of housing
backlog as well as in significantly contributing to the growth of the economy;

WHEREAS, during the convention workshops, various housing issues and concerns
were raised resulting in the adoption of resolutions from the four breakout groups as
follows:

SESSION A

1. R.A. 9485 ANTI-RED TAPE ACT (ARTA)

1.1 To urge the Civil Service Commission (CSC) to set up a centralized


nationwide monitoring website within its offices to effectively track and
evaluate the existence and compliance of Citizen’s Charters by Local and
National Government Agencies as mandated under the Anti-Red Tape Act
(ARTA), initially, with respect to the processing and issuance of Housing
Related Certifications, Clearances, Permits and Licenses.

1.2 To enable the CSC, through this website, to determine violations of Citizen’s
Charters as well as other provisions of the ARTA and to institute appropriate
corrective measures.

1.3 To enable Housing Developers, likewise through this website, to check the
status of their applications through a “Track Your Application” system
incorporated in the website.

2. LOCALIZE ADOPTION OF ARTA

2.1 To set up an ARTA Technical Working Group (TWG) as a joint effort


between SHDA and the League of Cities of the Philippines (LCP), League of
Municipalities of the Philippines (LMP), Department of Interior and Local
Government (DILG), Housing and Land Use Regulatory Board (HLURB),
HUDCC, Department of Agriculture (DA), Department of Agrarian Reform
(DAR), Department of Environment and Natural Resources (DENR) for the
purpose of crafting a standard ordinance:

towards the adoption of a common template for Citizens' Charters of


Local Government Units
to promote the adoption of the ARTA by the local councils for its
implementation and enforcement at the local government unit level
and
to standardize permits and licensing requirements and streamline
processing timeline.
2.2 Finally, it is proposed that the members of the ARTA TWG work closely
together to promote and urge LGUs to regularly review and update their
respective Citizen’s Charters for a more transparent and expeditious
processing and issuance of Housing Related Certifications, Clearances,
Permits and Licenses.

SESSION B

3. CREATION OF DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT

3.1 To support the creation of the Department of Housing and Urban


Development (DHUD) and push for mandatory review/ automatic
adjustment of the ceiling on socialized housing requirement.

3.2 To press advocacy to provide powers to the DHUD to act as arbiter on


inaction and/or abuse on the part of clearance, permit and licensing
agencies and LGUs, based on EO 45 and Anti-Red Tape Law.

4. AMENDMENTS TO THE RESA LAW

4.1 To work for the immediate approval of the amendments to the RESA law, in
order to make it friendlier towards generating more jobs, such as:

Making the educational criteria more flexible by allowing holders of


college bachelor degrees who are able to gain credits on real
estate courses to become brokers and high school graduates with
real estate training to become salespersons;
Allowing the real estate developer as a juridical entity to sell or
lease its properties for its own account;
Removing the limit of one real estate broker for every twenty
salespersons;
Removing the newly minted restrictions to developers on
“advertising, promotions and disseminating via listing in
publications” because these are part of the broader marketing
function which are rights of the owner/developers;

4.2 To urge the Professional Board on Real Estate Service and Professional
Regulations Commission to provide developers representation in the
prospective Continuing Professional Education (CPE ) Council.

5. LOCAL HOUSING BOARDS

5.1 To ensure that if the bills on Local Housing Boards will push through, effort
should be made to:

Transfer functional jurisdiction over housing concerns from LGU


Councils to the Local Housing Boards, especially the development
permits;
Ensure high competence levels among members of Local Housing
Boards;
Include representatives from developers’ associations.

6. AMENDMENTS TO THE MAGNA CARTA FOR HOME OWNERS

6.1 To work towards amendments to the Magna Carta for Home Owners to
ensure that the property rights of developers are equally respected as those
of homeowners.

SESSION C

7. MODES OF SOCIALIZED HOUSING COMPLIANCE

7.1 To come up with practical modes of compliance to harmonize the


Socialized Housing (SH) requirements of HLURB/BOI, that will include:

Consideration of SHDA’s position in the new Memoranda and


Circulars to put into operation the Implementing Rules and
Regulations (IRR’s) of RA 7279, such as allowing a subsidiary or
an affiliate to implement the requirement in behalf of the proponent
of the main housing project;

Establishment of acceptable modes for BOI, in the Interim, to attain


20% project cost equivalent in socialized housing compliance; and

Consideration by HLURB of other modes of compliance, such as


a) Refurbishing Non-Performing Assets of National Housing
Authority (NHA), Government Service Insurance System
(GSIS), Social Security System (SSS) and Pag-ibig.
b) Shelter repair kits for disaster recovery programs.

7.2 To urge the Board of Investments (BOI) & Bureau of Internal Revenue
(BIR) to revisit their Memorandum of Agreement (MOA) on the Availment
of Income Tax Holidays (ITH).

7.3 To provide for explicit statement/s in Certificate of Exemption (COE) or


BOI approval letter that no other additional requirement will be needed to
avail of the tax exemptions and/or ITH.

7.4 To consider Investment Promotion Unit (IPU) network of BOI to resolve


issues with other agencies like BIR (bring it to the attention of the higher
level).

7.5 To study possibility of increasing the price ceiling or flexible definition of


socialized housing in view of urban location, depending on LGU class.

SESSION D

8. HDMF COMMITS TO THE FOLLOWING:

8.1 To implement the new draft criteria under its Credit Underwriting
Policies/Borrower Evaluation System that seeks to further enhance access
to housing credit for Pag-IBIG members.

8.2 To adopt flexible Residency Requirement for Housing Loan Eligibility with
the easier Payment Options for incoming new members and OFWs.

8.3 To implement reduced processing time in transactions.

8.4 To implement recent Amendments to HDMF Circular 259 on Conversion


Performance, Substantial compliance, and Submission of proof of
payment with BIR.

8.5 To enhance efficiencies with respect to Accounts/Receivables for


Developers.

8.6 To further strengthen linkages in Government to Government


Transactions, enhance transparency and efficiency, improve coordination
with Agencies that have Automated Systems:

9. LRA COMMITS TO THE FOLLOWING:

To complete its computerization project by 2012.


To continue to have open communication with and to support SHDA
and its member developers.
To professionalize the ranks of its RDs and employees.
To extend MOA with Pag-IBIG up to December 2011.
To undertake G2G2G Arrangements with BIR and Pag-IBIG.
10. BIR COMMITS TO THE FOLLOWING:

To undertake G2G2G with LRA and Pag-IBIG.


To meet the 5-days issuance of CAR based on Citizen’s Charter.
To urgently address concern of developers as may be communicated
or emailed by stakeholders, especially housing developers.

NOW, THEREFORE, BE IT RESOLVED BY THIS CONVENTION, to adopt all of the


above agreements, commitments and consensus gathered by the various breakout
Sessions.

RESOLVED, FURTHER, that SHDA shall initiate follow through actions, coordinate with
partners in government and LGUs as well as those in the private sector in order to
achieve and realize the goals and objectives as agreed upon during the Convention.
