Sub: Processing New / additional load applications under HT Category from JGY
Feeder.

Govt. of Gujarat as a flagship programme Jyoti Gram Yojna was implernented for
supplying 24 X7 = 365 days continuous power supply to all the villages by commissioning
special line named as JGY feeders for socia-economic transformation of the rural people.
Along with uninterrupted pow,er supply to village, there was also moto to promote light
industries like flour mill, dairy, i.T. related activities, artisan establishment like carpentering
/ smithing / welding etc. and to promote heath services in rural area. Therefore, DGVCL
has restricted not to release heavy load industrial bonnections from JGY feeders to avoid
interruptions and loading on feeders as this feeders are exclusively dedicated to village
supply.

Numbers of representations are received from existing consumers / lndustlial Associations

/ Agro based lndustries / Owner of Zinga Farms to process their industrial applications
from nearby JGY feeders. The matter uras put up to the cornpetent Authority and afler
careful consideration as a part to promote industries in rural area and remote places, it is
decided tg process HT applications up to load demand of 275 K'IA only from JGY feecers
conditionally as under.

1. Feeders Amp. loading and all technical parameters like HTVR etc. should be within
the limit.
* 2. Maxirnum load to be sanctioned is up to 275 KVA only for new as well as existing
consumers demand e>densio= of load.

3. An undertaking on Rs. 100^ tlon Judicial Stamp Papers to be obtained from the
applicant that they will bear the interruptions being a long feeder and as and when
industrial / urban feeders will cornmission, they will switch-over their connections
from JGY feeder to industrial i urban feeder at their cost by paying necessary line
charges.
4. They wili not objeci in any case load shedding imposed on JGy feeders.
5. lf there is sufficient load growth in remote areas where new applications are

Sub: Simplification of the procedure to be adopted for Change of

Name and the llst of documents to be obtained.

, As a part of Power Sector Reforms, DGVCL has adopted mission and vision of
Company to give reliable power and quick resolution of grievances as well as
provlding better services for consumer satisfaction. The Electricity Supply Code
details the obligations of the Licensee and Consumers.vis-i-vis each other and
specifies the set of practices that shall be adopted by the Licensee to provide
efficient, cost-effective and consumer friendly seruice to the consumers. It
specifically details the procedure for connection, disconnection, reconnection,
assessment of load, changes in existing connections (load modifications, change of
name, change of tariff category, etc.).

Gujarat State Electricity Regulatory Commission througii its notification No. 11 of

2005 unambiguously states the procedure, including the documents to be
submitted by the applicant for transfer of seruice connection, necessitated either
/
due to the change in ownership occupancy of the premises of the existing
connection or due to the transfer of ownership of the premises to the legal heir,
the Sub Divisional Officers still insist the applicant to produce a long list of
documents, which are often superfluous in nature. Many a times, the applicant
faces innumerable difficulties in the submission of these documents resulting in a
situation where the application fails to get registered on account of absence of
demanded documents. Hence, to minimise ihe inconvenience caused to the
applicant, it has been decided by the competent authority to simpliff the process of
the applications for change of Name on submission of the minimum required
documents by the applicant. The simplified procedure cases wise to be adopted is
as under:

A) For the applications for change of name due to transfer of ownership to the
legal heir(s) of the deceased, the application may be processed in the event of the
applicant producing the following documents. (Applicable in the case of name
transfer due to descendant succession):

 1) Application form duly filled in (A1 form) by the irrcoming party.

2) Pedhinama (Descendant Ceftificate) from Talati or consent or undertaking on Rs.

100/- SEamp Paper from other legal heirs "having No Objection" for the transfer of
seruice connection in the name of the applicant.
OR
2) Affidavit on Rs. 100/- Stamp Paper declaring that the Applicant is either the sole
successor (heirs) of interest in the said premises, or self declaration of pedhinama
with a specific mention that other legal heirs have no objection for the name
transfer and their cbnsent to be obtained separately and if any Legal heirs raise the
dispute onus lies on applicant for Concealing the facts.

OR
2) Duly attested Xerox copy of the Property Tax Bill raised by Local Authority
(Municipal Administration or Gram Panchayat) for the said premises given in name
of applicant.

3) Copy of the latest Energy bill with proof of payment. ( Not necessarily required
as the arrears position can be verified at S/D)

B) For the applications for change of name due to transfer of ownership /

Occupancy of the premises , the application may be processed in the event of the
applicant producing the following documents

1) Application form duly filled in (A1 form) by the incoming party.

2) Registered sale deed/transfer deed or copy of Index registered before sub

registrar of respective District / area.

) a In case of unregistered sale deed the consent in writing from the previous
holder for the transfer of service to be submitted. In case of unregistered transfer
Deed (Kabja Rashid) additionally an undertaking to be taken on Rs. 100/ stamp
paper duly notarised. The version on stamp paper should clearly state that "if any
dispute arises by way of Civil suit in Court or objection raised by any individuals,
DGVCL can disconnect the Power supply without any further notice for which they
will raise no objection. An additional paragraph states that" As per provision of
Electricity Act as an obligation to give access to the Electricity to all, Utility is bound
- --Jo give electricitr, connectlon in i+s licensee area. By effecting the change of name as
per application, the applicant does not conferred with title of ownership , the issue
of title and ownership is to be confirmed by competent civil court, in case of any
dispute. Even the local authority like Municipal Corporation/Municipality/Village
Panchayat is recovering the property tax and gives water supply connection.
Therefore by availing the electricity does not create any right of ownership or title
and any authority shall not consider electricity cortnectlon as an evidence when
there is any dispute of ownership or title. Even the collector as an authority to

 recover the Land revenue and it has fiscal value unless contrary proved and any
/, entry in revenue record has presumptive value. The collector also does not have a
right to confer a title or ownership. Therefore, on the same line by giving the effect
of change of name for purpose of Electricity Supply will not confer any right over
title or evidence of ownership. If any dispute arises, DGVCL will disconnect the
power as per the orders ofthe Competent Court or Authority.

OR

2) Duly attested Xerox copy of the propefi tax (Municipal Authority or Gram
Panchayat) bill for the said premises given in the name of applicant.

3) Indemnity bond on Rs 100/- stamp paper indemniffing the Distribution Licensee

from any litigation and undertaking to compensate the Licensee in the event of a
litigation involving a Distribution Licensee but where the licensee is not an interested
party, (as per attached draft)

4) Copy of the latest Energy bill with proof of payment. ( Not necessarily required
as the arrears position can be verified at S/D)

5) Consent letter from outgoing party (in case of the trahsfer of available Security
Deposit in their name to the new party.) If new applicant is ready to pay fresh
Security Deposit as per norms it should be recovered and when outgoing party ask for
'' refund, it should be refunded as. the case may be.

. -C) For Limited and Private Limited Company registered under Company Act :

1) Application form duly fllled in (A1 form) by the incoming party.

2) Memorandum and Article of Association of Incoming and list of directors of
incoming and outgoing party.
3) Board's Resolution authorizing the Director to sign the undertaking with
specimen signature.
4) Affixing common seal in case of M. Ltd. concern.
s) Copy of original agreement signed by party.
6) 7lL2 Utera or property card or Abstract of Final Plot under T.P. Scheme in the
name of the incoming party or notarised Underiaking regarding sole
proprietorship of the purchased property.
7) Sale Deed OR Index registered before the Sub-Registrar of respective District.
8) Execution of Fresh Agreement.

D) For Paftnership Firm :

1) Application form duly filled in (A1 form) by the incoming party.

2) Certified copy of registered partnership deed.
3) Authentic documents of dissolution of old partnership and settlement with
outgoing partne,s.
4) Affixing rubber stamp in case of partnership / proprietorship firm.

 s) Tlt2Utara or property card or Abstract of Final Plot under T.P. Scheme in the
name of the incoming party or notarised Undertaking regading sole
proprietorship of the purchased property,

7) Execution of Fresh Agreement.

At present O & M Deptt. Of Corporate Office is moving the Change of Name case file
to the Legal Deptt. for scrutiny in the case of HT applications. It is decided that after
obtaining the above documents, due verification should be carried out by the O & M
Deptt. and no need to send the files to Legal Dept. for their Opinion unless there is
question of interpretation of Law.

The list of the undertakings applicable case wise to be obtained from the applicant is
enclosed herewith for fufther action.

All the field officers are instructed to adhere to this circular and act , wide
publicity of this circular may be given to the public at large.

Consumer on whose behalf this Bank Guarantee has been
issued. lf this Bank Guarantee has not been extended to the
satisfaction of the Distribution Company atleast 2 months prior
to the original date of expiry, or extended date of expiry, as
the case may be, the Distribution Company shall be entitled to
make demand under this Bank Guarantee-

3 This Bank Guarahtee shall not be revoked during its Gurrency

without the Distribution Company's expressed written consent
and neither our.obligation contained in this Bank Guarantee
nor rights, powers and remedies conferred upon the
DistribJtion Company by this Bank Guarantee or by law shall
be discharged, impaired or otherwise affected by :-

expressed on the part of the \n,

(a) any of the obligations
Consumer under the Power Supply Agreement or under
any other security relating thereto being or becoming
illegal, invalid, unenforceable for ineffective in any
respect;

(b) any time or indulgence being granted or agreed to be

granted to the Consumer in respect of the Consumer's
obligations under the Power Supply Agreement or under
any other securitY;

(c) any failure to realize or fully to realize the value of or any

release, discharge, exchange or substitution of, any
security taken in respect of the Consumer's obligations
under the Power SuPPIY Agreement; \-
(d) any other act, event, or omission which, but for this
clause, might operate to discharge, impair or othenruise
affect any of our obligations contained in this Bank
Guarantee.

4 We agree that the Distribution Company shall be entitled, at

its option, to enforce this Bank Guarantee against us, as a
Pr-rncipal Debtor, in the first instance, without proceeding-
against the Consumer [by making a demand, taking any
action in any Court or making any claim or proof in a winding
up or dissolution of the Consumerl and notwithstanding any
 other security, guarantee or a requirement of arbitration or
any other form of alternative dispute resolution mechanisms
ihat the Distribution Company may have, in relation to the
Consumer's liabilities under the Power Supply Agreement.
Our obligations under this Bank Guarantee shall be in addition
to and independent of every other security which the
Distribution Company may have in respect of the Consumer's
obligation under the Power Supply Agreement.

5, We agree that any provision of the power Supply Agreement

or any other documents, which may have been made
between the Dlstribution Company and the Consumer,
pursuant to the Power Supply Agreemerrt may be terminated,
warved, amended, varied, supplemented or otherwise
modified without our consent in any manner, and we agree

that no such termination, waiver, amendment, variation,
supplement or modification shall release, affect or impair our
t liability under this Bank Guarantee. We waive any
requirement for notice of any of the foregoing. No allowance
of time or other indulgence of concession or any other act or
omission that, but for this Clause, might exonerate or
discharge us shall in any way release us from the liability
hereun der.

6 Our obligations hereunder are continuing, absolute,

.rrrevocable and _unconditional irrespective of lhe termination,
validity, regularity or enforceability of the power Supply
Agreement and shall not be in any way affected by any action
or circumstance that might constitute a legal or equitable
discharge or defense of a guarantor or surety, all of which we
expressly waive.

7. Notwithstanding anything to the contrary contained herein

above, this Bank Guarantee shall be valid and effective for 1(

enabling the Distribution Company to lodge a claim for

payment under this Bank Guarantee within three months after
the original date of expiry or the extended date of expiry (as
the case may be).

8. We shall not assign or transfer our obligations under this Bank

Guarantee without the prior written consent of the Distribution

continuing obligation and shall continue to be so irrespective
of any reorganizalion or restructuring of any nature

As a part of power sector Reform DGVCL has adopted
mission and
vision of company to give reliable power with consumer
satisfaction.
while reviewing Mis for the month of June '20!2 for
HT apprications,
it is observed that there are 219 nos. of registered pending
applications with demand road of 22r.455 Nve

connections, stiil the progress is not satisfactory.".rrv

other reason like shortage of rabour contractor, way reave
and forest
related probrems etc., DGVCL courd not rerease
l\ the connection in
stipulated period. Due to price hike of Gas and
other petroleum
products as well as coal, the customer,
€ who were getting power
supply through their cpp's have stopped their generation
and
applying for power suppry to their unit from Discoms
and hence it is
observed by the competent authority that the inflow
of registered
pending as well as paid pending applications
for HT connections are
quite on higher side. Looking to the work
invorved to crear out huge
registered and paid pending apprications and
arso to rerease the
connection in the time bound period as per
tne SOp of the company,
 and as per GERC parameters it is utmost necessary to expedite the
work as early as possibre and also a good quarity work is expected
to
compete with the other company. Due to huge pending work, the
quality sometimes hampers and arso derays took prace. sometimes
it
may happens to have shortage of material as well as manpower
which hampers the execution of work and hence derays the rerease
of HT connections, though Gujarat power system have surprus power
and utilities are loosing revenue and not in a position to cater power
supply timely, Which results into production loss.

Therefore after long consideration as a part of simprifuing procedure

to execute the work expeditiousry. competent authority has decided

the policy as in case of EHT appiications, there are three options
(, exists for the applicants among one is option-Ill, in which the work
is to be carried out by the appricant himserf and onry superuision
charges are to be recovered from the pai-iy. So if same option is
offered in case of HT appricants, it is assumed that some of the HT
applicants may go for this option, and by this way work will be
completed more faster and arso the quaiity work wiil be carried out
by the applicants.

During meeting with various Industrial Associations of South Gujarat

and southern Gujarat Chamber of Commerce & Industries, have
represented that the policy tike option-Ill of GETCO should also be
t
allowed by DGVCL in case of HT appricants to earry release of HT
( Connections. Further here to add that president, Federation of
Gujarat Industries (FGI) vide its letter dated r4lL5.o6.zorz
addressed to GUVNL also suggested that Discom may allow option II
like GETCO to avail power by laying of lines by the consumers himself
to expeditious release of power.

In view of the ahove esmpete+t authority ol, DGVCL have appi-oved

option-Il for erection of HT line by an applicant (like option-Ill of
It
GETCO for EHT applicants). In which if an applicant come forward to

erect HT line work on their oyvn and decide to go for Opiion-Ii ai the
time of application he may choose this option-Il subject to fulfilling of
following terms and conditions for carrying out their work for early
completion of line work and subsequently early release of HT
connection.

1) Applicant should not use sub standard material, it must be ISI

& BEE standard.

2) All the materials like RSi / PSC poles, conductors, all types of
insulators & hardware for HT lines, G.I. Wires, Stay sets, Nuts
& Bolts and M.S. Angles channels etc. should be procured
/
i through registered vendors and approved suppliers of the
company as per DGVCL's specifications only or Venders
/Suppliers of private utility supplier like Torrent, BSES, NDPL,
Tata Power etc.

J) lhe contractor shall carry out the work as per specification
given by DGVCL and supervision of work will be done by DGVCL
official. On completion of the erection work the same is
required to be got inspected by the Electrical Inspector by
dolng all the necessary formalities at applicant's cost.

4) DGVCL wiii recover 15 7o towards supervision charges & taxes

of estimated amount so worked out.

s) Applicants have to carry out the work as per REC specifications

and standards and method / practices adopted by private utility
as mentioned in para.2 and under the supervision of engineer
in charge of company.
 6) The llne so erected by the applicant will be handed over to
DGVCL and shaii remain the property of the DGVCL by whom it
is to be maintained and hence DGVCL reserves the right to tap
this line for giving power supply to any other consumer.

7) The way leave clearances for line work, crop compensations,

legal issues / statutory permissions and any other Govt. i public
authority clearance shall be arranged by the applicant at his
cost. DGVCL will not be responsible for delay, if any on this
account.

8) The criminal and civil liability in case of accident during the

^l execution of work slrall lie entirely with the applicant.

9) The inspection of materials shall be cai-ried out at the
manufacturer's works only from which it is purchased subject to
all tests meeting the relevant Indian Standards and as per
DGVCL's testing criteria and specifications or NABL approved
agency. The charges for inspection shall be borne by the
applicants.

10) If the testing facilities are not available at the manufacturer,s

works, the same will be carried out at Government approved
laboratory like ERDA / CPRI at the cost of applicants with prior
approval of DGVCL.

11) The supplier shall replace the offered lot of materials if not
found as per the specific requirements at no extra cost to the
DGVCL including testing charges.

12) The DGVCL reserves the right for third party inspection of the
erection work carried out by the contractor.
 , 13) In case of any variance in the quality or specifications, the
material shail be liable for rejection without any liability to the
company.

14) If the applicant opts for this Option to carry out the work on
their own, they will have to execute an Agreement for the work
which shall be carried out by them on Rupees One Hundred
Non-Judicial Stamp paper. Only after execution of this
agreement, connection will be released.

shall be carried out by them on Rupees one Hundred Non-Judicial
stamp Paper. onry after execution of this agreement, connection
will be released.

6. The prospective consumer will execute the work as per statutory
rules only and arrange for electrical inspection of work done.
Consumer will be responsible for cornplete work done.
7. The Parties hereto, have put their signatures and seals in

Respected Sir,

At present, DlscoMS are granting Time Limit Extension (TLE) for payment of
, fstimate in respect of HT applications at their discretion. UGVCL has referred the

\r\ t" Hr applicant submits a written request, within the original time limit of one

for time limit extension, then-
' 1) One month time limit extension can be granted initially with the t:ondition that
cost data is not chanled, but S.D. to be paid at theFvised rate.
The Competent authority for granting extension will be Chief Errgineer of
. DISCOM.

eUY2) lf extension is required beyond above (i.e. one month originat + one month
extension) then one more month extension can be granted with fresh

registration charges, revised estimate and revised S.D.

) ^ , O The Competent authority for granting extension will be MD of DISCOM.

)Y-1"'t No further extension after the expiry of three month's time limit (original +
exlensions) should be allowed, as ii wourd adversely affect the TFR of
subsequent applicant falling on the same network.
It is requested to take necessary actio_n for implementation of above.
