PETITION

Petitioners ANTHONY T. GO, ALBERT T. GO, ALEXANDER T. GO,

LUCY G. SO, NANCY G. TY, JUDY G. TAN, and EMILY G. CHUA
(“Petitioners”), by counsel, respectfully state:

I.

NATURE OF THE PETITION

1.1. This is a verified Petition for the Cancellation of Annotation under

the second paragraph of Section 86, Presidential Decree 1529 (“Property

Registration Decree,” which relevantly provides:

Section 86. Extra-judicial settlement of the estate. xxx Upon the

expiration of the two-year period and presentation of a verified
petition by the registered heirs, devisees or legatees or any other
party in interest that no claim or claims of any creditor, heir or
other person exist, the Register of Deeds shall cancel the two-year
lien noted on the title without the necessity of a court order. The
 verified petition shall be entered in the Primary Entry Book and a
memorandum thereof made on the title.

II.

PARTIES

2.1. Petitioner ANTHONY T. GO, is Filipino, single, of legal age.

2.2. Petitioner ALBERT T. GO, is Filipino, of legal age, and married to

Marilyn Go.

2.3. Petitioner ALEXANDER T. GO, is Filipino, of legal age, and

married to Susan C. Go.

2.4. Petitioner LUCY G. SO, is Filipino, of legal age, and married to

Manuel T. So.

2.5. Petitioner NANCY G. TY, is Filipino, of legal age, and married to

Daniel Y. Ty.

2.6. Petitioner JUDY G. TAN, is Filipino, of legal age, and married to

Frank O. Tan, Jr.

2.7. Petitioner EMILY G. CHUA, is Filipino, of legal age, and married to

Ruben S. Chua.

2.8. Petitioners may be served with notices and other processes through
the undersigned counsel, MAULEON CHUNPENG & PARTNER, with office
address located at Suite 1105, State Centre Building, 333 Juan Luna Street,
Binondo, Manila.

ALLEGATIONS IN SUPPORT OF THE PETITION

3.1. Petitioners are the true and registered owners pro-indiviso of a

certain parcel of land located at the City of Malabon, and covered by Transfer
Certificate of Title No. M-36638, and more appropriately described as follows:

3.2. The above-described property was received by Petitioners from the

estate of the late Carlos Chua Gochuyu and Ruth Tangimkim Gochuyu, which
Petitioners settled among themselves extrajudicially pursuant to Rule 74 of the
Revised Rules of Court.

3.3. As a consequence and pursuant to Section 4, Rule 74 of the Revised

Rules of Court, Entry No. 83606/M-36638 was inscribed on the dorsal portion of
Transfer Certificate of Title No. M-36638, which states:

“Entry No. 83606/M-36638: LIABILITY OF ESTATES AND

DISTRIBUTEES;

Within two (2) yars (sic) from this settlement and

distribution, to the heirs, creditors, and other persons unduly
deprived of their share of participation, in this estate of the late
Carlos Chua Gochuyu and Ruth Tangimkim, Gochuyu, pursuant to
Sec. 4 Rule 74, of the Rules of Court.

Date of instrument: April 4, 2006

Date of inscription: May 24, 2007 at 11:00 am.”

3.4. The effectivity and efficacy of the above referred entry has since
expired as shown by the dates thereon.

3.5. Thus, the instant Petition is filed for the purpose of cancelling Entry
No. 83606/M-36638 pursuant to the second paragraph of Section 86, Presidential
Decree 1529.

 PRAYER

WHEREFORE, Petitioners respectfully pray that the Honorable Register

of Deeds of the City of Malabon cause the cancellation of the two-year lien under
Entry No. 83606/M-36638 and cause the entry of the instant verified Petition in
the Primary Entry Book and a memorandum thereof made on the title.

Petitioners pray for other just and equitable relief.

correct based on our personal knowledge and authentic records at hand.

4. We hereby certify that we have not commenced any action or

proceeding involving the same issues before the Supreme Court, the Court of
Appeals, or any Division thereof, or any other tribunal or agency, and that to the
best of our knowledge, no such action or proceeding is pending therein.

5. Should we hereafter learn that a similar action or proceeding has

been filed or is pending before the Supreme Court, the Court of Appeals, or any
Division thereof, or any tribunal or agency, I undertake to report that fact to this
Honorable Office within five (5) days from receipt of that information.
