JUDICIAL AFFIDAVIT OF
BRIXTON OCHOA and ESTER SANCHEZ

We, BRIXTON OCHOA of legal age, single, Filipino citizen, and a resident of
Barangay Trancoville, Baguio City, and ESTER SANCHEZ of legal age, single,
Filipino citizen, and a resident of Barangay Honeymoon, Baguio City, Philippines,
witnesses-respondents , after having been fully sworn to in accordance with law,
hereby depose and state:

PRELIMINARY STATEMENT

The person examining me is Atty. RENZ KHO with address at Central Buyagan,
Poblacion, La Trinidad, Benguet, Philippines. The examination is being held at his
Office at #20 Session Road, Baguio City, Philippines. I am answering her questions
fully conscious that I do so under oath and may face criminal liability for false
testimony and perjury.

This affidavit/testimony of BRIXTON OCHOA and ESTER SANCHEZ is

executed to serve as their direct testimony in the instant case and offered to prove:.
(1) That we caused the publication of an article entitled “Cosmetics: It’s
Harmful Effects” in one of the columns of Midland Courier dated July 7,
2019.
 (2) That the article was published subjectively and without specifically
providing the identity of the shop or owner of the shop indicated in the
article; and
(3) All matters, facts and circumstances related thereto, with reservation to
present additional exhibits in the course of the proceedings of the instant
case, in case a need arises.

Answer 1: We were BRIXTON OCHOA and ESTER SANCHEZ of legal ages,

single, Filipino citizens, and a resident of Barangay Trancoville and Barangay
Honeymoon, Baguio City, Philippines, respectively. We were both writers in
Midland Courier.

Question 2: Were you the same BRIXTON OCHOA and ESTER SANCHEZ
charged of this case?
Answer 2: Yes, sir.

Question 3: Do you know Mr. Reign M. Camlas, the complainant in this case?
Answer 3: Yes, sir.

Question 4: Showing you a (document), which we request to be marked as

our Exhibit A. Do you happen to recognize it?

Answer 4: Yes sir. It is the copy of the opinion page of the article we printed and
published in one of the columns in Midland Courier dated July 7,2019.

Question 5: What is the title of the article you printed and published?

Answer 5: Cosmetics: It’s Harmful Effects sir.

Question 6: In the article you mentioned the phrase or sentence, ”A cosmetic shop
located at 3rd floor Palangdao Building”, who do you actually pertain to that?
Answer 6: None exactly sir. We created the article subjectively and without
specifying the exact identity of the subject of our article.

Question 7: Why do you say that you created the article subjectively and without
specifying the exact identity of the subject of your article?
Answer 7: Because there were actually two (2) Palangdao Buildings located in
Baguio City and there were several proprietor in both buildings who owns and
operates a business in the line of cosmetics.

Question 8: Showing you a document (map of Baguio City), which we request to

be marked as our Exhibit B. Can you exactly point out where are the (2) Palangdao
Buildings located?

Answer 8: Yes sir. One is here at Session Road and the other one is at General
Luna.

Question 9: Do you attest to the truthfulness of your statements and

allegations in this Judicial Affidavit??
Answer 9: Yes sir.
