Illegal Trading of Petroleum Bote-bote/Gasoline Related Fire

ON THE ILLEGAL SELLING OF LIQUID
PETROLEUM PRODUCTS AND USING Products. Incidents
INAPPROPRIATE CONTAINER .

The Department of Energy (DOE) warns the

public that selling of petroleum products
without authority is a CRIMINAL ACT
under BP33 as amended by PD1865 and if
convicted shall be punished with a fine of
not less than P20,000.00, but not more than
P50,000.00, or imprisonment of at least two
(2) years, but not more than five (5)years,
or both.

In addition, DOE Department Circular(DC)

2017-11-0011 Section14b “liquid fuels shall
be transferred only from Underground Tank
by means of fixed dispensing pumps designed
and equipped to allow the controlled flow of
the Liquid Fuels and prevent leakages or
accidental discharges”, Section14c “Liquid
Fuels shall only be dispensed to appropriate
containers..”, and a “Retail Outlet or company
or any entity/person who supplies Liquid
Fuels to any person selling or dispensing such
Liquid Fuels through the use of drums,
barrels, bottles, or “bote-bote, shall be
deemed to be committing Illegal Trading.
However, the use of drums may be allowed for
customers own use in pre-determined situations
and where a duly notarized certification attesting
to the fact is presented.” Any person or entity
caught engaging in the said unsafe and illegal
activities will be held administratively liable
and shall be penalized with a fine of
P10,000.00 each for every act of violation
as enumerated in Section 29 of the said
DOE DC.
