LGBT MANDATORY WEARING OF PRESCRIBED SCHOOL

UNIFORM:ITS IMPACT ON

ACADEMIC INTEREST

1
CHAPTER 1

INTRODUCTION

In Philippines, the student uniform act was initially declared by DepEd and has been im effect
through present day, and almostall Filipino students who are enrolled in public and most private
elementary ang high schools as well as those whose studying for undergraduate from the
secondary level.

Among the country more than 903 primary and secondary and 354 universities, only a few
institutes offer flexibility regarding their student uniform policies. At present, most of school
where there are several variations of the student uniform that students are required to wear
whrn attending classes, as well as sport uniforms. The main given for the strict uniform
regulation is to promote orderliness and unity. Furthermore, students, often are proud to wear
the uniform of their school. However,om the other hand, the institutionalization of student
uniforms can lead to the violation of LGBT right as students have to follow the rule even they
feel uneasy to do so. Especially transgender and tomboy, who would like to wear differently
from their gendet of birth.

With a firm uniform policy in place, as almost all Filipinos schools have in place, transgender
students need to wear a uniform that differs from the gender they identify more with, which
can lead to a lack of confidence anf insecurity. Some members of the LGBTstudent community
feel funny wearing a uniform that reflects the gender of their birth, and this discomfort may
lead other students to think they are not common. Therefore, LGBT students, especially

2
transgender students, often have experienced homophobic bullying from their classmates. The
type of bullying varies including mocking, sexual harassment and physical abuse usually
committed by male heterosexual classmates. Teachers and other students basically know what
is happening but they do not do anything tp defend and protect the rights of these bullied
students. Also bullied LGBT students often decline to tell their parents in order to avoid
compounding the problems and discrimination further.

Homophobic bullying in school and stigmas against LGBT student have occurred on Philippines
since the society first recognized the exsistence of LGBT. Their have been attempts to eliminate
homophobic bullying in school against LGBT students and make school become a safer Place for
them to study by establishing specific LGBT restrooms, along with Providing sex education that
spreads awareness of different sexual preferences. However, the policy of flexible uniform has
been not been taken seriously as a policy that could be offered to support LGBTs whpmay have
self-esteem issues since this idea is quite new in Filipino society. Currently, there are few
educational institutes that have established such a policy for their students in some colleges. At
present, the idea of instituting a flexible uniform policy is still being debated as to whether or
not the policy may effectively help ensure the protection of human rights amongst LGBT
students as well as advocate for their rights as much as those institutes claim.

While the general policy is that the wearing of a school uniform shall not be required in public
schools (as embodied in DepEd Order No. 45 s. 2008), it is necessary to provide guidance on
what constitutes proper school attire. The following principles should serve as a guide:

A student’s basic right to go to school, study and learn is of paramount importance and should
be respected and promoted at all times.

A student’s attire should reflect respect for the school as an institution for learning.

A student’s attire should not become a cause for discrimination particularly for students

Belonging to a lower socio-economic status.

4
Promoting physical hygiene and proper school decorum is part of the teaching- learning process
in schools, thus a student’s attire and physical appearance should manifest learnings from this
process.

Given the above principles, the suggested attire for elementary and secondary students

may be:

For Boys – Polo shirt/T-shirt with sleeves – any plain color, with a minimum of prints

Pants (long or short) – any color

Footwear – any

For Girls – Dress, skirt and blouse, blouse and pants – any color, any print Footwear-any

For students with existing uniforms, they can still continue wearing them, if they so desire.

Students are discouraged from wearing expensive (signature or designer brands) or flashy
clothes, tight-fitting pants/blouses/dresses, mini-skirts, short shorts, blouses with plunging
necklines, hip-hop pants for boys, and sleepwear.

For immediate dissemination and strict compliance.
