EVIDENCE BY WAY OF AFFIDAVIT ON BEHALF OF PW-1

I, Aneesha W/O Noor Khan Aged About 43 Years R/O Ward No.39, Shri
Krishna Nagar, Bhind, Bhind, Madhya Prasad-477001, presently at New Delhi,
do hereby solemnly affirm and declare as under:-

1. That I am the petitioner in the above noted case and being well
conversant with the facts and circumstances of the case and such I am
competent to swear this affidavit.

2. That the deceased namely Shafiq was working as a labourer and at the
date of the accident, the injured was earning more than Rs.15, 000/- per
month and the injured was sole earning member of the family consisting
of his parents and due to the injuries sustained in the accident, the
family members of the deceased had to suffer great financial and
irreparable losses and the family members of the deceased is struggling
to survive.
 3. I say that Present evidence by way of affidavit is Ex. as PW 1/A; Copy of
the Criminal Documents is Ex. as PW 1/1 (Colly); Copy of the Post
Mortem Report is Ex. as PW 1/2; ID proof of the Petitioner Ex. as
PW1/4.

4. That I further say that the said accident has been caused by Rash and
Negligent driving by driver/respondent No.1 who is the driver of the
offending vehicle. The Respondent No.2 is the owner of the offending
vehicle. Respondent No.3 is the insurance Company with whom the
offending was insured at the time of accident, therefore, all the
respondents are jointly and severally liable to pay compensation to the
petitioner.

5. That the Petitioner has spent more than Rs.50, 000 on the last and final
rites of the deceased.
