CITY ORDINANCE NO. 0112-94


AN ORDINACE REGULATING THE SALE OF UKAY-UKAY ALONG MAJOR ROAD
THOROUGHFARES IN UNIVERSITY AREAS IN CEBU CITY
Section 1. Short Title. – This Ordinance shall be known as the “UKAY-UKAY SALE REGULATION
ORDINANCE”
Section 2. Declaration of Policy. - It is the policy of the State to promote conducive and decent
learning environments for students. As such, the State shall regulate and improve the facade and
minimize distractions on major roads in Universities in Cebu City.
Section 3. Definition of terms. — Whenever used in this Ordinance, the term:
a) "Ukay-Ukay" shall mean all kinds of store wherein secondhand apparels such as clothes, bags,
shoes and other accessories are being sold at a very cheap and bargained prices.
b) "Thoroughfares" shall mean a main road for public use or a passage of people and
transportations.
c) “Universities” shall mean an educational institution designed for instruction, examination, or
both, of students in many branches of advanced learning, conferring degrees in various faculties,
and often embodying colleges and similar institutions.
Section 4. Purpose-The passage of this Ordinance is aimed to achieve the following goals:
1.To promote order and cleanliness in major road thoroughfares in all Universities in
Cebu.
2.To greatly reduce or minimize the display of Ukay-Ukay stalls in roads as it hinders the
easy passage of the students and transportations.
3.To build a respectable and decent image for Universities.
4.To eliminate or reduce any forms of distractions to students.
5.To give the students a conducive learning environment free from any
Section 5. Duties of Public Officials—it is the duty of the officials of the Local Government Units
to aid in regulating the Ukay-Ukay vendors and to check every day if the law is faithfully
complied. Failure of the officials to perform their daily duties shall be subject to sanctions.

Section 6. Penalties. –Any vendor who will be caught violating this ordinance, shall be punished
with a fine not exceeding three thousand pesos (3000). Violations of this ordinance for the third
time shall be punishable by imprisonment of not less than ten days.
Sec. 7. Repealing Clause. - All laws, decrees, rules and regulations inconsistent with the
provisions of this Ordinance are hereby repealed or amended accordingly.
Sec. 8. Separability Clause. - If, for any reason, any part or provision of this Ordinance is
declared invalid or unconstitutional, any part or provision not affected thereby shall remain in
full force and effect.
Sec. 9. Effectivity. - This Ordinance shall take effect fifteen (15) days after its complete
publication in at least two (2) newspapers of general circulation and posting for three (3)
consecutive weeks in all conspicuous places in the City Hall or in the local bulletin board.
