For the purpose of this Ordinance, the following shall be defined as follows:
b) Plastic stirrer refers to a polymer stick used for stirring coffee and other
beverages.
d) Reusable straw and stirrer refer to a straw and stick made of stainless
steel, titanium, glass, or bamboo.
Exceptions shall be made in favor of senior citizens, children under the age
of 1 year old, and those with physical deformities, sicknesses, or ailments
which render them unable to drink from a glass, a cup, or a reusable straw.

Six months upon the effectivity of this Ordinance, all food establishments
will be required to carry either reusable or nonreusable stirrer and straw
options as an alternative to plastic straws and stirrers.
The food establishment, should it choose to offer reusable stirrer and straw
options, must ensure the cleanliness of the reusable stirrers and straws.
The Sanitation Division of City Health Office and CENRO shall set protocols
and promulgate and implement necessary rules and regulations for cleaning
reusable stirrers and straws to be adopted by the food establishment. The
Sanitation Division and CENRO shall, through their duly authorized
inspectors and monitoring teams, conduct a random check regarding
compliance with the duly set protocols and rules and regulations it issued
for cleaning reusable stirrers and straws.
All operators of food establishments shall have special bins for the recovery
and disposal plastic straws and stirrers apart from other waste such as
paper, biodegradable, and other kinds of waste. Should customers choose
to dine within the establishment’s premises, the food establishment shall
demand the proper collection and disposal of the plastic straws and stirrers.
The food establishment shall keep a record as to the proper collection and
disposal of all plastic waste generated by the food establishment.
Establishments shall also educate their customers of this Ordinance and its
provisions.
Section 7. Penalties.
Third Offense : PhP5,000.00 and/or imprisonment of not more than six (6)
months upon the discretion of the court, and revocation of business permit.

Section 9. Implementation.
Upon the effectivity of this Ordinance the CENRO, Business Permit and
Licensing Division (BPLD), Public Market Administrator, Barangay Affairs
Office, Liga ng mga Barangay, are hereby directed to draft and implement
the Implementing Rules and Regulations of this Ordinance to be approved
by the Sangguniang Panlungsod through a resolution. It may also adopt
and amend guidelines, rules and regulations and forms to implement this
Ordinance.
The Local Government unit shall deputize agents to assist CENRO Enforcers
and the local police to ensure compliance with the provisions of this
Ordinance. The CENRO or deputized agents shall issue citation tickets to
violators of this Ordinance stating the violation and its corresponding
penalty thereof. In case, the penalty is only fine and the violator does not
contest the citation ticket issued, he/she shall pay the fine within the Office
of the City Treasure immediately.
All ordinances, rules and regulations, or parts thereof, whose provisions are
in conflict with or contrary to the provisions of this ordinance, are hereby
repealed, amended and modified accordingly.
If for any reason or reasons, any part or provision of this Ordinance shall be
held unconstitutional or invalid, other parts or provisions hereof which are
not affected thereby, shall continue to be in full force and effect.
This Ordinance shall take effect one (1) week following its publication in at
least one (1) newspaper of general circulation in Angeles City and after the
adoption by the Sangguniang Panlungsod of the Implementing Rules and
Regulations.
