Re : Notice of Preventive Suspension

Dear Mr.________,

Company records and X-Ray report show that, on February 11, 2020, an
annual medical examination was done in your chest and the apicolordotic view
shows fibronodular densities in both upper lobes. By this medical findings, you re
found to be positive to Pulmonary Tuberculosis (PTB) minimal and bilateral.

As you know, Pulmonary Tuberculosis is a contagious (nakakahawa) bacterial


infection that involve the lungs. Moreover, _________________ is a company employing
more than ten (10) personnel and, at the same time, it is engaged in food processing.
As such, the company shall implement a suitable Occupational Safety and Health
policy to prevent and control the transmission of the disease within the workplace
for your own safety as well as for your co-workers pursuant to DOLE Department
Order No. 198, series of 2018. Similarly, Section 8 of the Omnibus Rules Implementing
the Labor Code of the Philippines provides:

“Section 8. Preventive suspension. The employer may place the worker


concerned under preventive suspension only if his continued
employment poses a serious and imminent threat to the life or
property of the employer or of his co-workers.

Based on this findings, Management has more than substantial bases to


subject you to a preventive suspension of at least thirty (30) days or until you have
been subjected to a treatment.
