PETITION

PETITIONER, by counsel, to the Honorable Court, most respectfully states

THAT:

1. Petitioner is of legal age, Filipino, married and a resident of P-3, San

Luis, Cauayan City, Isabela where she may be served with orders, notices and
other processes of the Honorable Court;

2. Public Respondent Local Civil Registrar of Jones, Isabela is a

government official charged with the recording and safekeeping of registrable
documents particularly facts of births, marriages, etc. and presently holding office
at the Municipal Building, Jones, Isabela, where summons and other judicial
processes may be served;

3. Petitioner was the premium of the marital union of spouses Efren

A_____ and Magdalena S____A_______ as evidenced by her Certificate of
Live Birth herewith attached as Annex “A”;

4. In Annex “A”, Petitioner’s date of birth was erroneously entered as

“June 28, 1981” instead of her true and correct date of birth as January 29, 1975.
Entry No. 12 (in Annex “A”), referring to the maiden name of the Petitioner was
not filled up; it was open blank. It does not reflect the maiden name of the
Petitioner. The maiden name of Petitioner’s mother is Carbonel;
 6. Petitioner has been consistently using her correct date of birth as
January 29, 1975 and is publicly known to have been born on January 29, 1975
as evidenced by the public records. Copy of the public records are herewith
attached as Annexes “B”, “C”, “D”, “E” and “F”, respectively;

7. There is a need to immediately correct the entries in the Certificate of

Live Birth of the Petitioner so that her true and correct date of birth be clearly
reflected in her public records;

8. Petitioner has no intention to evade criminal prosecution or civil

obligation because the Petition is being filed solely for the purpose of correcting
her public records and to conform to her actual date of birth.

PRAYER

WHEREFORE, on the basis of the foregoing, it is respectfully prayed of the

Honorable Court to favorably grant the instant petition by directing the Local Civil
Registrar of Jones, Isabela to correct the entry in the Certificate of Live Birth of
Gemma A_______-________ by replacing the date of her birth from June 28,
1981 to January 29, 1975 and encode the maiden name of her mother as
Carbonel in entry no. 12 of Annex “A”.

Other reliefs just and equitable under the premises are likewise prayed for.
