AFFIDAVIT OF ADVERSE CLAIM

I, ROSELLER V. BUCOG, of legal age, single, Filipino Citizen, and currently

residing at Sitio Tuburan Tres de Abril St., Barangay Punta Princesa Cebu City Philippines,
after having been duly sworn to in accordance with law do hereby depose and states;

1. That I bought from Ma. Carmelita A. Acibo a parcel of land covered by a Transfer
Certificate of Title (TCT) No. 149286 with an area of 102 square meters more or less located
in Barangay Basak Cebu City more particularly described as follows:

A parcel of land Lot 5688-D-5-B-3 of subdivision plan, Psd-07-041524 being a

portion of lot 5688-D-5-B, Psd-07-05-011865) situated in Brgy. Basak City of Cebu, Island
of Cebu. Bounded on the SW., along line 1-2 by lot 8087 Cebu Cad.; on the NW., & SW.,
along line 2-3-4 by lot 5688-D-5-A, Psd-07-05-011865, on the NW., along line 4-5 by lot
5688-C(LRC) Psd-83967;on the NE., along line5-6 by lot 5688-D-5-B-2 of the subdivision
plan; on the SE, along line 6-1 by lot 5688-H (LRC) Psd-83967 ( with perpetual right of
way .50 m. wide). Beginning at a point marked “1” on plan being S. 81 deg. 50’W., 11-.118
m. from BM 46, Cebu Cadastre;

2. That we agreed that the consideration of the sale is Eight Hundred Thousand Pesos
(P800,000.00) and upon the execution of the Deed of Conditional Sale, I paid P500,000.00 in
cash and P55,00.00 pesos covered by post dated checks leaving a balance of P245,000 to be
paid in installment basis. As evidence of the transaction we executed a DEED OF
CONDITIONAL SALE hereto attached;

3. That in order to protect and preserve my right over the property and as notice to other
persons who may deal with the property sold to me, it is my desire that the our Deed of
Conditional Sale be annotated in the Transfer of Certificate of Title No. (TCT) No. 149286;

4. That I asked Ma. Carmelita A. Acibo her duplicate copy of the Transfer of Certificate of
Title No. (TCT) No. 149286 so that the Deed of Conditional Sale can be annotated in the
face of the title, however, she refused to give me the duplicate copy of the Transfer of
Certificate of Title No. (TCT) No. 149286;

5. That I execute this Affidavit to request the Register of Deeds Cebu City to annotate this
Adverse Claim and Deed of Conditional Sale in the Transfer of Certificate of Title No.
(TCT) No. 149286 which is on their file and for whatever legal purposes that this Affidavit
may serve.
