 FOR PERFORMANCE GUARANTEE

This article should include:-

 An amount equal to 5% of the tendered and accepted value of the work
(without limit) as performance guarantee.
 The time allowed for submission of the performance guarantee.
 Time for The Performance Guarantee shall be refunded to the
contractor soon after completion of the work on issuance of completion
certificate.

ARTICLE 8
 SHOULD BE INCLUDED

REPRESENTATIONS AND WARRANTIES OF THE PARTIES

1. The CLIENT hereby warrants that it is a business organization duly

incorporated and validly existing under the laws of Ethiopia and has the
corporate power to enter into and execute the present CONTRACT.

2. The CLIENT also warrants that the present CONTRACT shall be valid,
binding on and enforceable against it when executed by its authorized
executive official.

3. The SERVICE PROVIDER hereby warrants that it is a business organization

duly incorporated and validly existing under the laws of Ethiopia and has
the corporate power to enter into and execute the present CONTARCT.

4. The SERVICE PROVIDER also warrants that the present CONTRACT shall
be valid, binding on and enforceable against it when executed by its
authorized executive official.

5. The SERVICE PROVIDER further warrants that it has the requisite

professional skill and long-standing experience to carry out the elevator
Installation services contemplated by the present transaction.
 ARTICLE 10
 SHOULD INCLUDE:-

1. The supplier should be liable and penalize for delays in performance

2. A Party shall exercise its right to cancel the CONTRACT by giving thirty
days advance written notice to the Party in default setting forth the
details of the material breach complained of.

3. All written notices required by virtue of the provisions of the present

CONTRACT shall be deemed as delivered when actually delivered by
hand or when sent by registered mail to the other Party and receipt of the
same is acknowledged in writing by the receiving Party.

ARTICLE 9
 SHOULD INCLUDED

1. The SERVICE PROVIDER shall warrant that the maintenance works it

Carries out by virtue of the present CONTRACT shall be free from any
defects in craftsmanship and shall be liable for any damage caused to
persons or property due to defects in workmanship.

2. The SERVICE PROVIDER shall correct or rectify, at its own expenses, any
defects in workmanship performed by its personnel.
