purpose of removing the top soil and filling materials to improve the road subgrade.

We did a joint site visit at Zimbili road and found that the existing 4 cells box
culvert has been scoured, the apron and two wing walls at the outlet side have
broken due to heavy rains continuing to rain in since the month of March, 2018
up todate.
Since the box culvert was not included in the BOQ during the design stage of
Zimbili road, therefore, the Contractor must be instructed to take measures
however possible so that people can well pass through from one side to other
side.
We also look forward for your advice on the permanent solution to make sure
that at the completion of Zimbili road there won’t be any problem again.

Dear Sir,
As you are aware that, in package 5 at Kiwalani Ward there are three (3) market
structures required to be constructed as per contract. We have been waiting for
compensation money from higher level of our Government so that the exercises
can be done at the same time finding another means of how we can resolve it.
Meanwhile, we have made several discussions with the local people who are
doing business at Bombom Market to vacate the market and give room for
development. The area was jointly inspected and checked before by
representative from Client, Contractor and Consultant its dimensions and
seems to suit with the available design.
Near by the market area there is an area along the road where by, we discussed
and agreed with the business people to use it for temporary while the
construction is going on.
You are now required to survey that area and advice on how can be levelled and
allow the business people to vacate the old market required to be developed.

Dear Sir,
The Technical Team from World Bank, PORALG, Ilala Municipal Council,
Consultant, Technical Assistant, and Contractors was done the joint site
inspection on 24th August, 2018 through DMDP project to determine the
progress in general.
Several issues were raised, discussed and instructed to CSC for more
actions as follows;
The Team cautioned the CSC to strictly make closely and serious
supervision to Contractors so that to accomplish all works in time
and in quality.
The Team advised the CSC to instruct the Contractor have more
groups of work in different sections so that to fast track the work
because more time have lost/elapsed.
The Contractor has only one motor grader on site, Key staff are not
enough ‘’ Social Expert not employed’’, in general the Contractor
not fully mobilised. CSC was instructed to ask all Contractors to
submit their list of Key Staff with their CVs as well as their work
Contracts to the Client/ PORALG as soon as possible.
Generally, the Team instructed the CSC and TAs to submit their list of
Key Staff to Client/ PORALG for further action too.
Therefore, from these basis, the CSC is required to act upon those
challenges and weakness as shown so that the project to be completed in
time as well as in quality.

On 4th September, the Team from TA and Client’s side did the site visit at
package 5 and observed some issues which need early action to be taken
by the Contractor before rain season starts; -
At Bush, Mnara and Gude roads, the Contractor has excavated the
roads and start filling up pavement layers but there is a need of
providing the quick protections to the excavated road sides either
by constructing side drains or whatever to avoid erosion in which if
it rains can cause fallen of nearby buildings and lead to
unnecessary claims from the owners.
To date, the Contractor has not yet started the construction of
Bombom market regardless that there is a free site to start
construction for more than 3 months now with no reason.
Most of the site sections found not busy, only one motor grader
found moving around for the whole site. This leads to delay of
works and completion time in general. The Contractor will not be
entitled to claim for extension of time basing to all of these delays.
For all roads already started construction, there are water ponds
with water changed colour to green and not moving because there
are no side drains provided to allow surface and subsurface water
to flow and leave the road pavement layers safe. The ponding water
has started wetting the pavement layers which is endangering the
road.

The heading above refers to your letter with no reference number dated on 06 th Julay,2018 regarding the Intention
carry on the construction of your building at Plot no. 19 Block 49 FLUR BIBI TITI MOHAMED.
We have inspected your site and seen the existing structure physically is still fit, and it is at first floor level with
erected starter bars for columns. But relaying on your Structural Engineer’s commitment and advice, we are allowing
you to proceed with your construction by basing on the following conditions; -
Make sure that you follow the Building Permit no. 2292 dated on 30.07.2012 conditions issued by Ilala
Municipal Council.
Make sure that there is safety at your site during construction,
Make sure that you follow all the construction regulations.
The Ilala Municipal Council will cancel your Building permit if you won’t obey and observe the said above and granted
Building Permit conditions.

SUB: Observations after Inspection done by CAG and IMC on two different
days at Package 1
Reference has made to the heading above and the joint inspection done by a
team from CAG, Consultant, Contractor and Client, also refer to our letter
dated on 17th Aug, 2018 Ref. number IMC/HD.20/2.
The Inspection team observed that still there are snags and defects at package
1 in which the major works were completed on 27 th February, 2018 and Project
Manager issued the Certificate of Completion such that is in the Defect Liability
Period. Regardless that, another team did inspection on 17 th August, 2018 and
required you to instruct the Contractor M/S China Railway Seventh Group to
attended and rectify all snags and defects, still the following defects and snags
were found on 12th September, 2018 during CAG inspection and auditing;
I. Non supply and fixing of more than 30 pcs of kerb stone at the office
building near the generator house,
II. Poor finishing of the part floor inside the generator house
III. Failure to put terrazzo floor on the part which is on the floor top of the
main office building
IV. Security guard house was not yet installed with electricity and its
facilities
V. Poor finishing on the places where the roof top stairs were fixed
VI. Most of the roads under package 1 were not installed with all required
road signs.
VII. Some office furniture and equipment were not yet supplied as required
on the contract agreement.
Therefore, we strictly require you again to instruct the Contractor to attend and
rectify all the observed defects and snags immediately and the re-inspection has
scheduled to be done on 29th September, 2018.

Health Care Dispensary at Ukonga for treatment and there he referred to
Muhimbili National Hospital.

Reference has made to the 2 sec August, 2019 joint meeting with TARURA CEO and the
above heading.
We regret to inform you that we are not happy with your performance basing to the
following general and specific facts;
I. Contractors on site are not well supervised in terms of quality control, pushing
them to complete their works in time and be active on works as per their
Contracts. This has resulted most of the works to lag behind the Contracts time
of completion.
II. Your Client had been instructed you several time through letters and meetings
to act on different matters like preparation or producing proper and important
reports (regarding your supervision works example Final Draft report for
package 1 and the whole status), to take Contractual actions to Contractors
who are not performing with no concrete reasons, but at the end you are failing
to do so or you do differently.
III. It has also noted that, within your Staff, only few are active in a manner that
you are not able to supervise effectively the available works and leading to poor
and unsatisfactorily products as well Contractors not completing their works on
time as stipulated in the Contracts.
Basing to these weaknesses mentioned above, we are again cautioning and needing
you to resume your activeness in supervision before the Client think of suspending
your Contract as stipulated in Clause GCC18 of your Contract.

hitimisho letu lilivyojiridhisha kuwa kampuni inayolalamikiwa iitwayo M/s Chongqing
International Construction Corporation (CICO) haijasimamishwa au kufungiwa kushiriki
kwenye mchakato zabuni ya aina yeyote ile.
Aidha, Barua hiyo kutoka Benki ya Dunia inaielekeza Halmashauri kuondolewa kwa zuio
lililokuwa limewekwa juu zabuni hiyo wakati wa uchunguzi, na hivyo kuendelea na
mchakato wa zabuni tajwa kwa haraka ili kuikamilisha.
Pamoja na barua hii, naambatisha nakala ya barua kutoka Benki ya Dunia kwa ajili ya

We are reminding you to make follow up and push the two Contractors in
Package 2 and 3 respectively to prepare and submit their Program of Works
which will match with the available corridors as we jointly inspected and
agreed. For Package 2 Msibazi River Basin drains; Mafuriko drains 1.23km,
Tenge Liwiti drain 0.96km, Buguruni Kisiwani drain 1.5km, Bonde la Sungura
main drain at ch. 0+000 – 0+120 is free, 0+120 -0+700 is obstructed, 0+700
-0+840 is free, Bonde la Sungura small drain 1 at ch. 0+000 – 0+040 is free,
Bonde la Sungura small drain 2 at ch. 0+000 – 0+104 is obstructed, Tembo
Mgwaza main drain at ch. 0+000 – 0+880 is free, ch. 0+880 – 1020 is
obstructed and Tembo Mgwaza small drain at ch. 0+000 – 0+200 is free. A total
of free corridor to work is 4.95km which is 80% of the free corridor.
For Package 3 Yombo River Basin drains; Food Security no.1 at ch. 0+000 –
0+400 is free & 0+400 – 0+700 end of drain is obstructed, Food Security no.2
at ch. 0+000 – 1+300 is free, 1+300 – 2+700 is obstructed although we have
paid 80% and are demolishing up to 15 th Oct, 2019 95% free corridor will be
there, Mpogo River at ch.0+000 – 4+700 is obstructed and evaluation was done
we are making follow to get money for compensation, Minazi mirefu drain at
ch. 0+000 - 0+200 is obstructed by 40% & ch 0+200 – 0+700 is free so 90% the
drain is free. The issue of detention pond, we jointly agreed that you will do
setting out so that everyone can see clearly the area to be utilized and decision
to be made quickly by the owners and client side.

Generally, we are working for the obstruction for the sections seen to be
obstructed and up to December, 2019 all obstructions will be completely
removed.
Therefore, you are asking to instruct all Contractors to updated and submit
their program of works basing to the available corridors and they are required
to start their physical works and mobilize the full equipment and staff as per
their Contracts.

Utekelezaji wa mradi wa DMDP unaoendelea katika Kata zenu unajumuisha uwekaji wa taa za
solar ambazo tayari zimekwisha wekwa katika barabara za Dispensary, School, Zimbili,
Kampala, Chunge na Limbanga. Taa hizo za barabarani zimekaguliwa kwa mara ya kwanza
nyakati za usiku na kuonekana zinawaka vizuri na kupunguza adha giza.
Hata hivyo, wakati taa hizo zinawekwa kumetokea changamoto kwa baadhi ya wananchi wasio
waaminufu kuziiba pamoja na sola zake jambo ambalo lilipelekea Wakandarasi kuweka ulinzi
kwa kipindi chote wakati zikiwekwa. Kutokana na hali hiyo, ni vyema sasa maeneo tajwa hapo
juu ambapo uwekaji umekamilika mkaweka ulinzi pamoja na kuwajulisha wananchi wao
wenyewe kuwa walinzi wa taa hizo na miundombinu mingine yote iliyoboreshwa ili kuwasaidia
kama ilivyokusudiwa.
Pia, utekelezaji bado unaendelea kwa maeneo mengine yote ambapo mradi wa DMDP
unatekelezwa.

Reference has made to the above subject and the joint site visit which was
done on 5th October, 2019 to all on going sites.
As we visited at Zimbili road and found an accident caused by rain water due
to incomplete side drain which was abandoned by Contractor and rain water
crossed to the local people’s houses as a result of block fencing wall felt and
crushed 3 motor vehicles which were parked.
We are reminding you to make follow up and instruct the Contractor to take
immediate measures to protect the possibility of more effects to happen to the
people due because rain is continuing, to make follow up for the remedial or
reconstruct the fencing wall felt and the repair of the 3 motor vehicles crushed.
Also, we remind you to instruct all Contractors to move around their areas or
road sites and check where the rain water is stagnated to avoid flooding to the
people.

Mbilinyi road paid to 129.8%, Part G Jamaka road paid to 113.3%, Part H
Zahanati road paid to 143.4%, Part K Binti Musa road paid to 125% and Part L
Bethel road paid to 198%.
We remind you too that, the budgets for this package and other packages are
constrained so please make sure all works have to be completed within the set
budgets. (I have attached a copy for IPC no.14)

It was found that, the side drain which was constructed from Limbanga road
and it was suppose to direct storm water to the major drain, was left hanging
and lead storm water to be uncontrollable as a result people come up with
complains.

For that sense, we are worring that items 1.1 to 1.3 of Other Community based
Facilities (Kigilagila sub-ward 1.1, Minazi Mirefu sub-ward 1.2 & Yombo sub-
ward 1.3 Buildings) which their costs indicated in the BOQ as lumpsum
amounts at the end will not reflect VALUE FOR MONEY. (Refer Package 5).

Hata hivyo, tarehe 11/10/2019 na 15/10/2019 vilifanyika vikao vya pamoja kwa
kushirikisha uongozi wa Serikali ya Mtaa na Mheshimiwa Diwani ili kupata suluhu
ambapo wananchi zaidi ya 14 walihudhuria na kuelimishwa umuhimu wa kujengwa
mfereji huo.
Kwenye kikao hicho, Wananchi walitoa malalamiko na madai yao kama ifuatavyo;-
Hata hivyo, walipewa elimu ya umuhimu wa kujengwa mfereji huo kwa haraka ili
kuondoa adha ya maji kuingia kwenye makazi yao hasa vipindi hivi vya mvua, pia
walijulishwa kuwa si vyema mfereji huo kutojengwa haraka kwa kigezo cha kusubiri
fedha za fidia na hatimaye kubakia hoja ya kuonyeshwa ni kiasi gani kila mmoja
anastahili kuja kulipwa kama fidia pamoja na Halmashauri kuwapa mikataba.
Hivyo, basi naleta kwako suala la wananchi kuhitaji kuonyeshwa fidia zao kuwa
watastahili kiasi gani ili ushauri kulingana na taratibu za Uthamini wa Ardhi pamoja
na kushauri kuhusu kupewa Mikataba na Halmashauri. Ushauri huo ni vizuri
uelekezwe kwa Mkurugenzi wa Manispaa ili mgogoro huo utatuliwe na mfereji uweze
kujengwa mapema.
Kwa kuwa uejnzi wa daraja hilo unakaribia kuanza kabla ya mwezi Disemba,
2019, ni vyema ukalishughulikia suala hilo mapema.
Ujenzi wa Mifereji ya maji ya mvua kwenye Bonde la mto Msimbazi km 6.14 unaofanywa na
Mkandarasi M/s Chongqing International Construction Corporation (CICO) kazi imeanza
kwenye mfereji wa Mafuriko Ilala tangu tarehe 15.08.2019 inatakiwa kukamilika ndani ya miezi
15 ya Mkataba,
Ujenzi wa Mifereji ya maji ya mvua kwenye Bonde la mto Yombo km 9.82 unaofanywa na
Mkandarasi M/s China Railway Seventh Group (CRSG) kazi imeanza kwenye mfereji wa
Mafuriko Ilala tangu tarehe 15.08.2019 inatakiwa kukamilika ndani ya miezi 15 ya Mkataba,
Wakandarasi M/s Nyanza Road Works na M/S Group Six wa package 6 na 5 waliomba malipo
ya kazi zilizoidhinishwa na Mhandisi Mshauri M/s UWP Consulting kwa IPC No. 15, 16 & 17
na IPC No. 12, 13 & 14 kwa takribani miezi 3 sasa hawajalipwa na Kimkataba Mkandarasi
alitakiwa kulipwa ndani ya siku 28 tangu kuidhinishwa na Mhandisi Mshauri kifungu cha
Mkataba ‘’GCC 41.1’’.
Kutokana na hali hii naleta kwako ombi la kutusaidia kufanya ufuatiliaji wa malipo hayo ili
Wakandarasi waweze kukamilisha miradi hii kama ilivyopangwa na kuepuka kuomba malipo za
ziada ‘’Interest’’ kwa kucheleweshewa malipo yao ikizingatiwa kuwa Mhandisi Mshauri
amewasilisha barua kumb. Na 51312/6/01/01/02/055/pm ya tarehe 16/10/2019 ya kusudio la
Wakandarasi kususia kazi. Hata hivyo, nilimwandikia Katibu Mkuu Tamisemi barua Kumb. Na.
IMC/DMDP/D.1/1/46 ya tarehe 19 Septemba, 2019 kumjulisha pia hali ilivyo (Naambatisha

Utekelezaji huo unafanyika kupitia miradi ya DMDP, Mfuko wa barabara Road Fund na kwa kutumia
fedha za Makusanyo ya Ndani ‘’Own Source’’.
Hata hivyo, kutokana na ufinyu wa bajeti katika maeneo yote hayo ya vyanzo vya fedha, Halmshauri
imeshindwa kuweka lami baadhi ya barabara muhimu zenye urefu wa km 15.49 ambazo wakazi na
wafanyabiashara wakubwa wanapata adha sana wakati wa vipi vya jua hali inakuwa ni ya vumbi na
wakati wa vipindi vya mvua hali inakuwa na mashimo ya maji na makorongo.
Kutokana na adha hiyo, Viongozi mbalimbali wa maeneo hayo wamekuwa wakiomba msaada
kutengenezewa akiwemo Mheshimiwa Mbunge Jimbo la Ilala na wengine kwa kuzingatia kuwa
wakazi na wafanyabiashara wa maeneo hayo ndio hulipa kodi ya Serikali kwa kiwango kikubwa
kutokana na umuhimu wa maeneo hayo.

anayetekeleza mradi wa package 5 M/s Group Six International Ltd.
1:0 UTANGULIZI
Ujenzi wa barabara kiwango cha Lami km 11.59 kwa namba zipo barabara kumi nne (14),
Ujenzi wa Masoko matatu (3) na maeneo mawili (2) ya kupumzikia Umma
Ujenzi wa vyoo vya Umma vitatu (3)
Ujenzi wa Vioski vya maji safi
Ununuzi wa magari ya taka ngumu na Ujenzi wa Vizimba vya kukusanyia taka ngumu, kazi zote
zikiwa na gharama ya Tsh 21,250,224,647.
Utekelezaji wa mradi huu ulianza tarehe 31 Octoba , 2017 na kutakiwa kukamilika ndani ya miezi kumi
na tano (15), hata hivyo Mkandarasi alipoanza utekelezaji, changamoto zilijitokeza kwa kuonekana
uwepo wa maji mengi kwenye tabaka la ardhi karibu na usawa wa ardhi ‘High water table’ hali ambayo
wakati wa usanifu wa mradi haikuwa imeonekana na kuhusishwa kwenye usanifu ‘unforeseen soil
condition’ uwepo wa maji mengi hasa wakati wa kuchimba tabaka la juu ili kuanza ujenzi ulipelekea
Mhandisi Mshauri M/s UWP kufanya usanifu mpya ‘Review of Design’ na kumwelekeza Mkandarasi
kuweka mawe ‘Rock fill’ kwenye baadhi ya maeneo yaliyokuwa na maji mengi na yanatitia ‘High water
table and soil gripping’ pamoja na kutumia mifereji ya kupitisha maji chini kwa chini ‘ Sub – Soil Drains’ .
Changamoto nyingine kwenye utekelezaji wa package 5 ilikuwa na kuwepo kwa vizuizi ‘PAPS’ wafidiwa
ambao walikuwa bado hawajalipwa ili kupisha utekelezaji wa Mradi kwa kuwa Halmshauri ilikuwa bado
haijapokea fedha za kulipa fidia, moja ya maeneo yaliyohitaji fidia ni maeneo ya kujengwa Masoko,
Vyoo vya Umma na Community Parks.
Kutokana na Changamoto hizo, muda wa utekelezaji wa mradi wa miezi 15 uliisha bila Mradi kukamilika
na kulazimika kumuongezea Mkandarasi muda wa miezi 4.5 ambapo bado Mkandarasi hakuweza
kumaliza kazi na kuongezewa tena miezi 2.5 lakini pia hakuweza kumaliza kazi na mwezi septemba, 2019
aliongezewa miezi miwili (2) na kutakiwa kukamilisha kazi zote ifikapo mwezi Octoba, 2019.
Aidha, kutokana na kwamba Barabara za Zahanati, Pepsi na Bombom zinaingiliana na ujenzi wa Mfereji
mkubwa uliopo kwenye package 3 unaotekelezwa na Mkandarasi M/s China Railway Seventh Group
ambao ujenzi wake umeanza mwezi Agosti, 2019, kazi hizi haziwezi kufanyika kama Mfereji wa huo
‘’Food Security two (IL2) drain’’ haujakamilika.
Ujenzi huu wa Mfereji wa Food Security two (IL2) wakati wa usanifu wa Mradi wa DMDP ulitakiwa
kuanza kabla ya ujenzi wa barabara hizo zilizopo package 5, kwa sababu hiyo imebidi barabara hizo
zisubiri ujenzi wa mfereji huo ujengwe suala ambalo linapelekea Mkandarasi wa package 5 kusimamisha
kazi akisubiri Mkandarasi wa package 3 kukamilisha kazi yake.
I. Kazi zote ambazo Mkandarasi M/s Group six hajaanza kuzitekeleza (hajazifanya) ambazo ni
Ujenzi wa barabara ya Zahanati, Bombom na Pepsi, Ujenzi wa choo 1 na ‘Community Parks 2
asizifanye.
II. Kazi zote ambazo Mkandarasi wa package 5 M/s Group six hajazifanya ziondolewe kwenye
Mkataba wake. Hata hivyo Mkandarasi M/s Group Six alishaandika barua kuomba kazi zote
ambazo zitamchelewesha na hasa zinazozuiliwa na utekelezaji wa package 3 kwenye utekelezaji
wake ziondolewe kwenye Mkataba wake.
III. Kazi zote ambazo zimeondolewa kwenye Mkataba wa M/s Group Six package 5 zijumuishwe
kwenye package 3 inayotekelezwa na Mkandarasi M/s China Railway Seventh Group, na ifanyike
‘addendum’ kwenye mkataba wa package 3 ikionyesha kazi za awali pamoja na zilizoongezwa.
Baada ya zoezi la kutambua kazi zinazoondolewa kutoka package 5 kwenda package 3 addendum
iliandaliwa na kuwasilishwa kwa Mwajiri, TAMISEMI na Benki ya Dunia inayoonyesha kazi zilizoongezwa
kwenye mradi wa package 3. Baada ya mabadiliko haya ambapo kumekuwa na kazi za nyongeza na kazi
zilizohamishwa, kwa sasa gharama ya mradi wa package 5 haitazidi gharama ya awali ya Mkataba.
2:0 SABABU ZA KUONDOA KAZI HIZO KWENYE MKATABA WA PACKAGE 5 NA KUZIJUMUISHA KWENYE
MKATABA WA PACKAGE 3.
i. Muda wa utekelezaji wa package 5 umeisha licha ya kuongezwa muda mara 4 mpaka sasa, na
kazi ambazo hazijaguswa na Mkandarasi wa package 5 haziwezi kuendelea mpaka hapo
Mkandarasi wa parkage 3 atakapokuwa amekamilisha utekelezaji wa mkataba wake.
ii. Mkandarasi wa package 5 ili aweze kutekeleza kazi ambazo hajazigusa analazimika kusubiri
Mkandarasi wa package 3 kumaliza ujenzi wa mfereji wa Flood Security unaopita kwenye
barabara hizo, jambo ambalo itampasa mwajiri kumlipa gharama ya kuendelea kuwepo ‘site’,

The Zimbili Bridge need urgent Construction, because it is in critical condition and at any time it can be
broken if immediate measure will not taken
After CICO completed the emergency work on zimbili bridge, they closed the bridge off with concrete
bollards to ensure that only right passenger vehicles can cross the bridge, but the Public shift the
concrete bollard to allow heavy duty vehicles to cross the bridge, this situation is dangerous to the
existence of the Bridge, and if this situation continues the bridge will collapse at any time (t).
In order to rescue the situation and to avoid the Severe effect that may occur for the current use of the
bridge and the coming rainy season we recommend that the work should be done by CICO under
urgency.
The reason to propose Construction of Zimbili Bridge to be done by CICO as additional work is as
follows:-
i. The location of the ongoing work (package 2) is in proximity with the location of the Bridge
(Zimbili Bridge) .
ii. The Work shall be done under urgency due to critical condition of the bridge; the structure is
unsafe and can cause serious damage to the user. (see the photo)
iii. The fund to be used to finance the Project comes from the remaining funds from other
completed projects
iv. The work is not on the current approved World Bank package and there is no specific budget
allocated except to spend the remaining funds on the other project after getting approval from
world Bank.
v. The Contractor is undertaking similar works and he has already mobilized with plant and
equipment on the same area.
vi. The Bridge can easily be accommodated and completed within the ongoing package 2 contract
period
To avoid possible consequences of communication breakdown that may occur if the Culvert eventually
collapses, you are advised to authorize additional work to CICO based on the reason above, and we have
revealed that the contractor has adequate experience on construction of bridges of similar size

SUBJECT: RE PACKING OF THE WORK FROM PACKAGE 5, AND ADDITIONAL WORK TO PACKAGE 3:
The Contractor group six is working on package 5 project; his contract period has expired despite having
been extended four times to date. In the light of this, the expert session from TAMISEMI, Council,
TARURA, Consultant Engineer – UWP and Contractor Group six sat down and agreed to re - pack some of
the work from package 5 due to the following reasons:-
i. The period for Contract for package 5 has expired despite being extended four time so far, and
the work not implemented by Contractor cannot continue until package 3 contractor has
completed his work
ii. For a package 5 contractor to implement the remaining works he has to wait for a package 3
contractor to complete the construction of a flood security, this can require the Employer to
pay the contractor (Group Six) the cost of remaining to the site as well as compensation, and
give the employer the cost that would be inevitable by doing the packaging so that the work
could be done by package 3 contractor
iii. The contractor for package 5 Group Six Company has agreed to the re- scoping and re
packaging of work without claiming any cost or compensation of any kind
Either, we recommend that these reduced works from package 5 to be added to package 3 due to the
following reason
i. The location of the ongoing work (package 3) is in proximity with the location of the remaining
work from package 5.
ii. The Contractor is undertaking similar works and he has already mobilized with plant and
equipment on the same area.
iii. The work can easily be accommodated and completed within the ongoing package 3 contract
period.
iv. To prevent the possibility of paying the contractor for package 5 compensation if he remains on
the site while waiting for the package 3 contractor to finish the work, so that he can complete
his work.
To ensure the project is completed without Legal and financial complication we advise the employer to
re – pack Package 5 and do additional work to package 3.

UTANGULIZI:
Awali wakati wa ujenzi wa barabara ya zimbili iliyopo kwenye package na 6 ilipoanza kutekelezwa mwezi
October, 2017, ndipo ilipogundulika kuwa kuna uhitaji wa ujenzi wa daraja hilo. Wakati wa usanifu wa
Mradi wa Ujenzi wa barabara hiyo ya Zimbili pamoja na kazi zingine za package 6 kulikuwa na Makalavati
(Box culverts) ya midomo mitano (5 cell) kuvuka mto msimbazi ambapo hakukuwa na haja ya kujengwa
kwa daraja hilo.
Baada ya mvua kubwa zilizonyesha mwezi machi hadi mei, 2018, mto Msimbazi katika maeneo
mbalimbali ya Jiji la Dar es Salaam ulifunikwa na kupelekea kupanuka na kusababisha mmomonyoko
ulioharibu vivuko mbalimbali na nyumba za Wananchi na mali zao kwa Wakazi waliokuwa wanaishi
kando kando na Mto Msimbazi..
Kutokana na kupanuka kwa Mto Msimbazi pia kulisababisha Makalavati ‘5 cell box culvert’ kwenye
barabara ya Zimbili kuathiriwa na kusababisha barabara kutopitika kabisa na kupelekea usumbufu kwa
wananchi wa Gongolamboto na Ukonga wanaotumia barabara hiyo.
Halmashauri ilichukua hatua za dharura kutengeneza eneo hilo kwa kushirikiana na Wananchi pamoja na
Mkandarasi CICO kwa ajili ya kutumika kwa muda, ingawa mpaka sasa kinaendelea kutumika kama
kivuko cha muda japokuwa makalavati yamebomolewa na maji.
Kwa kuwa eneo hilo la daraja awali halikuwepo kwenye mpango wa kujengwa Mhandisi Mshauri
alimwandikia barua Mwajiri wake (Hlmashauri ya Manispaa ya Ilala) taarifa kuhusu hali halisi ya
makalavati hayo kutoa ushauri wa mapendekezo yake akimuomba amruhusu kufanya usanifu wa nini
kifanyike katika eneo hilo.
Mkurugenzi ambaye ni Mwajiri wake alimruhusu kuendelea na usanifu, ambapo vikao vya pamoja na
Wahandisi kutoka TMISEMI – Kitengo cha Mradi waDMDP na Benki ya Dunia vilikaa baada ya
kutembelea Mradi na kumwagiza Mtaalamu Mshauri kufanya usanifu wa haraka.
Mtaalamu Mshauri alifanya usanifu na kupendekeza kujenga daraja lenye urefu wa mita 40 na upana wa
mita 8 pamoja na mita 600 za barabara na ujenzi huo utagharimu TZS 4,304,066,255
Baada ya Mtaalam Mshauri kukamilisha usanifu aliwasilisha taarifa hiyo ya usanifu kwa Mwajiri,
Kitengo cha Mradi wa DMDP – TAMISEMI, TARURA, Wataalam Wahandisi TA na Benki ya Dunia. Baada
ya taarifa ya usanifu kuwasilishwa maeneo tajwa ilifanyiwa marekebisho mbalimbali ya Kitaalamu na
kisha kuwasilisha taarifa ya mwisho yenye makadrio ya Kihandisi (Final Design Report with BOQ).
Hata hivyo mjadala wa upatikanaji wa fedha kwa ajili ya Ujenzi huo ulifanyika kwa pamoja na Wahandisi
kutoka Benki ya Dunia, Tamismi – Kitengo cha Mradi, Manispaa ya Ilala, TARURA na Mtaalam Mshauri
UWP, na Mhandisi Mshauri aliagizwa kuwasilisha taarifa kuonyesha endapo fedha zinazobaki kwenye
utekelezaji wa miradi maeneo mengine ya miradi iliyokamilika kama zitatosha kugharamia ujenzi wa
daraja hilo.
Baada ya Mhandisi Mshauri kuwasilisha taarifa hiyo ya fedha zitakazobaki, TAMISEMI kwa kushirikiana
na Halmashauri waliomba kibali cha kutumia fedha hizo zitakazobaki kutoka Benki ya Dunia kwa ajili ya
kujenga daraja hilo la Zimbili ambapo awali halikuwepo kwenye mradi.
Wataalam na viongozi wa Benki ya Dunia walipitia taarifa hiyo ya Mtaalam Mshauri na kuruhusu
utekelezaji wa kazi uendelee na kushauri kazi hii ya ujenzi wa daraja la Zimbili apewe Mkandarasi
anayeendelea na kazizenye asili sawa na ujenzi wa daraja.
Baada ya Benki ya Dunia kuruhusu ujenzi wa daraja hilo, kikao cha pamoja kati ya Tamisemi Kitengo cha
Mradi, Mhandisi Mshauri UWP, TAs, Halmashauri na TARURA walikubaliana kuwa, kazi hii ya ujenzi wa
daraja apewe Mkandarasi M/s CICO ‘Chongquing International Coorporation. Hata hivyo, Mhandisi
Mshauri alishaandaa Addendum na kuiwasilisha kwa Mwajiri.
SABABU ZA KUMPA MKANDARASI CICO KUFANYA UJENZI WA DARAJA HILO KAMA KAZI YA
NYONGEZA NI KAMA IFUATAVYO:-
i. Kazi hiyo ya ujenzi wa daraja ina asili sawa ‘same nature’ na ujenzi wa mifereji kwenye bonde la
mto Msimbazi unaofanywa na Mkandarasi M/s CICO. Mkandarasi huyo ameonyesha alishawahi
kufanya kazi za ujenzi wa madaraja.
ii. Kazi hii ya ujenzi wa daraja haikuwepo kwenye mpango ‘PAD’ wa awali, hivyo isingeweza
kujengwa kama kazi mpya kwa kuwa Miradi yote inayotekelezwa kwa awamu hii ya kwanza ni ile
iliyopo kwenye mpango ‘PAD’ ambayo Benki ya Dunia ilishaidhinisha.
iii. Fedha za ujenzi wa daraja hilo zinatokana na fedha zitakazobaki kutoka kwenye miradi mingine
ya DMDP inayotekelezwa.
iv. Mkandarasi anayeendelea na kazi M/s CICO hahitaji kulipwa fedha za kuwasilisha vifaa,
wataalamu na vifaa vingine (Mobilization and demobilization cost) kwa kuwa yupo eneo ambalo
mradi unapaswa kutekelezwa.
v. Mkandarasi wa Package 6 ambaye alikuwa anajenga barabara ya Zimbili Mkataba wake umeisha
yupo kwenye umaliziaji na muda wa matazamio ‘’Snaglist and DLP’’.
vi. Ujenzi wa daraja hilo kwa kumtumia Mkandarasi aliyepo Kazini tayari kutaharakisha upatikanaji
wa daraja hilo kwa wakati ili kuepuka usumbufu unaweza kujitokeza endapo daraja la muda
lililopo litasombwa na maji kwa kuwa tayari limekwisha dhoofika sana.
USHAURI NA MAPENDEKEZO
1. Sheria na Kanuni za Manunuzi zizingatiwe wakati wa utekelezaji wa mapendekezo haya.
2. Kwa kuwa gharama ya ujenzi huo wa daraja ikiwa kazi ya nyongeza utagharimu billion 4.30 na
ukilinganisha na gharama ya ujenzi wa Mfereji ya Mkandarasi pendekezwa ni sawa na ongezeko
la asilimia 30% ya Mkataba wa CICO unaendelea, ni vyema maombi haya yakapata idhini ya Bodi
ya zabuni na Kikao cha Kamati ya Fedha na Utawala kabla ya utekelezaji
Kwa kuwa kazi hii inapaswa kutekelezwa mapema ili kuweza kuzuia madhara yanayoweza
kujitokeza muda wowote kwa sababu ya udhaifu wa makalavati yaliopo na mvua zinazoendea,
nawasilisha kwa ajili ya kutolewa maamuzi ili kazi iweze kutekelezwa mapema.

kwaajili ya kujenga daraja la Zimbili linalovuka mto Msimbazi kama kazi ya nyongeza kwenye mradi wa
package 2 Mkandarasi CICO ambapo daraja hilo la Zimbili package 6 iliyokuwa inajengwa na
Mkandarasi Nyanza Road Works ambaye kazi yake ipo kwenye kipindi cha matazamio.
Ujenzi wa daraja hilo unatarajia kufanyika kama kazi ya dharura ama muhimu kutokana na kivuko/box
culvert lililokuwepo kuwa bovu na hatarishi kwa kuvuka ama kutumiwa na watu baada ya kusombwa na
maji ya mto huo na kusababisha kuta na nguzo kuvunjika. Kwa sasa kivuko hicho kimefanyiwa
marekebisho ya dharura ili kiweze kutumika kwa muda tu ila endapo mvua za masika zinazo kisiwa
kuanza hivi karibu zitakuwa nyingi, barabara hiyo muhimu haitakuwa na mawasiliano na wananchi
wanaweza kupata adha.

Dear Sir,
Reference is made to the above subject as well to the written complaint addressed and
sent to our higher level office of the Government and World Bank regarding the delay
of the completion of the mentioned project above.
We have received an email attached with written letter from World Bank which was
addressed and sent to their office showing and mentioning various weakness within
the package 5 project (Copy that letter is attached for your reference). Among the
weaknesses is delay of completion of drainage works, road humps, road signs,
markets and all other works.
Due to that complaint letter, the World Bank team has decide to organize themselves
to visit Ilala Municipal Council DMDP project and they have scheduled the visiting to
be on 29th and 30th January, 2020 and the Bank has required the PORALG and Ilala
Municipal Council to respond by writing on the complaint as quick as possible basing
the Time frame for completion this package 5 including Bombom markert, provision of
street lights, road safety/furniture’s and storm water drains.
7Therefore, we are then asking you to respond on this rised matter and prepare for the
coming of the taem from World Bank and PORALG as scheduled.

Dear Sir,
Please refer to the above Subject and the received email attached with a hand
writing letter from a local person Mr. Mtengeki of Kiwalani Ward regarding
package 5 DMDP project.
The complaint letter which has 19 pages, in summary has mentioned the
failure of project completion timely especially on storm water drains, Bombom
market, provision of street lights and road safety/ furniture’s.
For the case of road safety; most of the roads have installed with road signs
except the provision of road humps which the Contractor has instructed to
make sure that are early provided to all roads although, the Contractor is
claiming for his IPC no. 14 and 15 payments for more than 2 months now.
