TUTORIAL 3

Identify the appropriate Islamic legal maxim and explain the application of the maxim to
the case (s).

(Your answer must cover: definition of the identified maxim, origins of the maxim,
application of the maxim to the case. State reasons of the selected maxim) :

1. The city of Paris was bombed by terrorist. Many buildings and citizens were
destroyed and killed. It has been a week and Ismail is the only person who is still
alive and trapped in the building. It was an extreme situation with no water and
food that he has to eat the flesh and blood of the people who died in the
building.

2. Due to demand of housing in Kuala Lumpur in 2000, more housing areas were
expanded and developed on the hillside nearby Gombak. However, the
development has destroyed and harmed the natural ecology (wild and protected
animals homes and deforestation were affected). The situation became worst
where there were landslides incidents especially during the monsoon season.
The investigation which was carried out since the past 3 years ago indicate that
destruction is caused due to the improper house planning, geological features
and maintenance. The case against the developer is now being brought and
heard to the court.

3. MH300 was crashed in the India Ocean on 25/11/2015. After one week of
searching, the search and rescue (SAR) team has decided to call it off. An
announcement was made by Kepoh news that the search has been discontinued
since no passengers nor the debris was found anywhere at the scene of the
crash. The announcement has caused anger among the family members of the
passengers and the crews. Now they are suing and seek compensation from the
airlines. The case is now being brought and heard to the court.
