JUDICIAL AFFIDAVIT

I, ANECITA DIATE, Filipino, married, 55 years old, and a resident of Brgy.

Buac Gamay, Sogod, Southern Leyte after having been duly sworn to in accordance
with law, hereby depose:

That in accordance with A.M. No. 12-8-8-SC, which prescribes the use of
judicial affidavits to serve as the direct examination testimony of a witness, I hereby
execute this judicial affidavit in a question and answer format;

That conformably with Section 3(b) of the said A.M. No. 12-8-8-SC, I also
state that ATTY. JOSE JULIUS P. OBUS was the one who conducted the
examination of the undersigned affiant at Public Attorney’s Office, Sogod, Southern
Leyte;

That also pursuant with Section 3(c) thereof, I hereby state under pain of
perjury that in answering the questions asked of me as appearing herein below, I am
fully conscious that I did so under oath, and that I may face criminal liability for false
testimony or perjury;

Q-1. Nganong nia manka dinhi? (Why are you here?)

A-1. Arun mutestigo pabor sa ahong mga tagibaryo nga gikasuhan nga
ipatangtang sa listahan sa mga voters sa Brgy. Buac Gamay, Sogod, Southern
Leyte. (To testify in favor of my barriomates that are filed with a case for exclusion
from the list of voters of Brgy. Buac Gamay, Sogod, Southern Leyte.)

Q.2 Unsa man diay ang imong itestigo? (What will you testify?)

A.2 Mutestigo ko sir nga kana si MARCELA BIONG ug VICENTE ALICO,

lumad nah nga taga Buac Gamay, Sogod, Southern Leyte, managsoon nah sila,
kanah si Vicente Alico, ulitawo nah, ug kana si Marcela Biong, balo na unja naay
duha ka balay sa Brgy. Buac Gamay, ug temporary nah sila nga nipuyo sa Brgy.
Zone V, Sogod, So. Leyte sa dihang nagtukod ug balay ang anak ni Marcela nga tua
sa abroad, pero kanunay gihapon nah sila nga nag ulian sa Brgy. Buac Gamay bisan

pa ug naa nah silay gipuy-an sa Zone V. (I will testify sir that MARCELA BIONG and
VICENTE ALICO are siblings, native of Brgy. Buac Gamay, Sogod, So. Leyte, and
Vicente Alico is single, and Marcela is already a widow and have two houses in
Brgy. Buac, Gamay, Sogod, Southern Leyte, but temporarily resided in Zone V,
Sogod, So. Leyte when her child who is already out abroad built a house there, but
they still constantly return home in Brgy. Buac Gamay even if they lived in Zone V.)

Q-4. Unsa pa man? (What else?)

A-4. Kanang mga tawo sa Buac Gamay, kahibalo gajud nah nga lumad nah
nga taga diha si Marcela ug si Vicente kay diha man nah sila nagdako, unja daghan
pud nah sila ug basakan ug kalubian diha sa Brgy. Buac Gamay, ug mga balay. (the
people in Buac Gamay know for a fact that Marcela and Vicente are native of buac
Gamay because they lived and grow there, and they have plenty of Riceland, coco
land and houses in Brgy. Buac Gamay.)

A-5. Kanah si EDUARDO GONO ug CELYN DIONSON, nakamatngon

judko anah nila nga nagpuyo nah sila diha sa Buac Gamay ug dili tinood ang
aligasyon nga dili nah sila residente diha kay naa gajud nah sila nagpujo sa ilang
kaugalingon nga panimalay nga naa diha gitukod sa Brgy. Buac Gamay, Sogod,
Southern Leyte. (That EDUARDO GONO and CELYN DIONSON, I really noticed
that they are living in Buac Gamay and their allegations that they are not residents
are not true because they truly lived in their own house that they built in Brgy. Buac
Gamay, Sogod, So. Leyte)

A-6. Kanah si IRENEA TUBLE, lumad nah sija nga taga Buac Gamay ug
kasamtangan nga naa nagpuyo sa balay sa iyang anak nga si Carlos Lanic, Sr..
sukad pa kaniadtong February 2013. (That IRENEA TUBLE, is a native of Brgy.
Buac Gamay and currently residing in the house of her son Carlos Lanic, Sr., since
February 2013.)

Q-7. Naa pa kay laing isulti? (Do you want to add more?)

A-7. O, sir, kana si GERALDYN ug GERALD OLO, lumad pud nah nga
lumulopyo sa Brgy. Buac Gamay, Sogod, So. Leyte, ug nga bisan pa ug naa nah
silay kapuy-an sa laing baryo dinhi sa Sogod, kanunay ra gihapon nah sila nga nag-
ulian sa Buac Gamay. (Yes,sir, Those GERALDYN and GERALD OLO, they are
also native residents of Brgy. Buac Gamay, Sogod, Southern Leyte, and even if they
have house to stay in other barangays in Sogod, they still constantly return home in
Buac Gamay.)

Q-8. Naa pa kay ipuno? Do you wish to add some more to these
statements?

A-8. Wala na sa pagka karun. (I have none for the moment.)

Q.9. Sa ubos dinhi, adunay gipatik nga imong ngalan, andam ba ka nga
boluntaryong muperma ani? (Below this Judicial Affidavit is your printed name. Are
