MARINE PROTEST

I, Robin Cantos Padilla, Filipino, of legal age, single, with address at


Calapan Transport Services (doing business under the name and style
Calapan Bullet Express), Bonifacio Drive, Ibaba East, Calapan City,
Oriental Mindoro, after being duly sworn in accordance with the law, do
hereby declare and state on protest:

1. That I am the Master of M/V Calapan Bullet Express .45, a marine


transport vessel, owned and operated by Calapan Transport Services
(CTS), with Official Number CAL1334490, Certificate of Ownership
No. 14344, Home Port – Calapan City, Call Sign Kalibre Kwarentay
Singko, Gross Tonnage 1,115.00, Net Tonnage 578.00;

2. That my vessel figured in an unfortunate mishap when it sunk near the


Isla Verde Passage in the evening of January 8, 2020;

3. That before leaving port, my vessel, M/V Calapan Bullet Express .45
was inspected and cleared for departure particularly by the Coast
Guard Clearing Team;

4. That I left the port of Calapan City on January 8, 2020 at around


1800H on a regular voyage from Calapan City to Batangas City. It
was windy and shortly after the vessel sailed it started to rain and a
tornado appeared around 300 meters from the starboard side. As the
rain and wind got stronger due to the tornado, the ship tilted from side
to side, and after getting hit by sudden gigantic waves, the vessel
capsized;

5. That after noting down that the vessel might capsize, at point where
the ship tilted to 45 degrees after being hit by a big wave, I
immediately sounded the alarm and broadcasted “Mayday” several
times. I also instructed all crew to mustering stations and call for
evacuation;

6. That the search and rescue teams were able to rescue all the
passengers and all crew members of M/V Calapan Bullet Express .45;

7. That as a result of the incident, my vessel M/V Calapan Bullet


Express .45 suffered heavy damages and beyond salvage as per its
condition;

8. That the mishap happened at the following coordinates:


15o 14.17”W, 334o 78.90”S

9. That I am executing this Marine Protest in order to attest that my


vessel capsized due to a fortuitous event and publicly protest against
any and all damages to my vessel M/V Calapan Bullet Express .45
and her passengers and cargoes, as well as to the environment, and
hereby extending the right to extend this marine protest as may be
warranted at any time and place convenient and for whaterver legal
purpose it may serve best. I am likewise executing this marine protest
in order to protect the best interests of my vessel, M/V Calapan Bullet
Express .45, her officers and crew, her Owners/Operators, from any
liabilities arising from the incident.
